North Carolina’s new paid parental leave law took effect October 1, 2026. Eligible employees covered by the law may receive up to 12 weeks of paid leave for a qualifying event on or after that date. The amount depends on when the event occurred, the employee’s eligibility and employer coverage; the benefit is not an automatic 12 weeks for every public employee.
What changed on October 1, 2026?
Session Law 2026-40, Senate Bill 1041, created Chapter 126A and established the expanded benefit in G.S. 126A-71. The law says: “Any eligible full-time employee subject to this section may take up to 12 weeks of paid leave after a qualifying event.” The October 1, 2026 effective date separates the new benefit from the earlier amounts described by the North Carolina Office of State Human Resources (OSHR).

These amounts are OSHR’s description of the rules for eligible employees; an event before October 1 does not qualify for the expanded 12-week amount merely because leave is taken later. See OSHR’s Paid Parental Leave guidance and the enacted law, Session Law 2026-40.
Which events and parents are covered?
The law covers a qualifying event involving the birth of a biological child and the placement of a child under 18 for adoption, foster care or another legal placement. OSHR also describes birth, adoption, foster care and other legal placement as qualifying events. The statutory definition of parent includes adoption, foster care and another legal placement, so the benefit is not limited to employees who give birth.

Who qualifies for North Carolina’s paid parental leave?
OSHR’s current summary says an employee must have at least 12 months of employment with an executive branch agency, participating public school or community college, and must have been in pay status for at least half of that time. The statute directs the State Human Resources Commission to set eligibility details, including a minimum service period, and to credit aggregate service among covered executive-branch agencies, public schools and community colleges.
Coverage is tied to the law and applicable employer policy; it does not mean every employee of every North Carolina public entity automatically qualifies. Confirm with HR which employer rules cover your position and how prior service or pay status is counted. OSHR’s eligibility summary was current as accessed October 3, 2026, while the agency says its policy and FAQs are being updated.

Part-time employees
The statute directs the Commission to provide part-time employees a prorated amount of leave, capped at 12 weeks. The law provisions reviewed do not establish a calculation formula for an individual employee; ask HR how the current policy applies to your schedule.
How the leave relates to other leave and benefits
Paid parental leave is additional to shared leave and other leave authorized by state or federal law. An employee may take it without exhausting accrued sick or vacation leave. The leave has no cash value when employment ends and is not counted in calculating retirement benefits.

What public school and community college employees should check
The law directs local boards of education and community college boards of trustees to adopt policies substantially equivalent to the Commission’s policies. For public school employees, implementation has an additional transition issue: in a September 1, 2026 notice, the North Carolina Department of Public Instruction (DPI) said the State Board’s existing rule, 16 NCAC 06C .408, had not yet been updated and that proposed rulemaking was awaited. DPI said local units should consider its position and consult local counsel for specific decisions; its stated position was not legally binding on public school units absent a formal rule change.
DPI also said it planned to provide 12 weeks to eligible DPI employees for qualifying events on or after October 1. That statement concerns DPI employees and does not, by itself, settle how an individual local school unit must handle a claim. School employees should check their unit’s current written policy and ask HR how it applies. Community college employees should likewise confirm the institution’s current policy and request process.

OSHR says its policy will be updated to reflect the new law. Its policy page lists a policy effective July 17, 2025, a request form and 2026 FAQs; the public-facing leave page says new FAQs and guidance will be available soon and identifies linked resources as most relevant to events before October 1. For a current event, contact your employer’s HR office for the applicable policy, forms and deadlines rather than assuming an older form or FAQ reflects the new rules.
