The date of the qualifying event determines which rules to check. For an event before October 1, 2026, North Carolina’s Office of State Human Resources (OSHR) describes the former benefit as eight weeks for an eligible employee who gives birth and four weeks for another eligible parent. For an event on or after October 1, 2026, state law authorizes eligible full-time employees to take up to 12 weeks of paid parental leave. The new benefit is subject to eligibility and implementation rules, and OSHR says updated policy and guidance are forthcoming.
How many weeks of paid parental leave do NC state employees get?
Use the qualifying event date—not the date you read this—to identify the framework. The former amounts below are OSHR’s description for earlier events; do not assume its old eligibility or pay details carry over to the new law.

| Qualifying event | Leave described in official guidance | What to keep in mind |
|---|---|---|
| Before October 1, 2026 | Eight weeks for an eligible employee who gives birth; four weeks for another eligible parent, according to OSHR’s prior-program overview. | These are the former program’s amounts. Check with your agency HR office about eligibility and administration for your case. |
| On or after October 1, 2026 | Up to 12 weeks for an eligible full-time employee under Session Law 2026-40. | “Up to” is a maximum, not a guarantee that every employee will receive exactly 12 weeks. Part-time leave is to be prorated under Commission policy, and eligibility details are being set through policy. |
The new statute does not retain a distinction between birthing and other parents in its stated maximum. It provides leave after a qualifying event, while delegating important eligibility and administration details to policy.
Who is covered, and what counts as a qualifying event?
The law defines a qualifying event as becoming a parent to a child. A child includes a newborn biological child or a child under 18 who is newly placed with the employee for adoption, foster care, or another legal placement. The definition is not limited to employees who give birth.

OSHR’s existing overview describes the prior program as covering executive branch employees and participating public schools and community colleges. Public school and community college employees should confirm the rules that apply through their employer or governing policy as well as agency HR.
Service history and eligibility
OSHR’s old overview describes a 12-month employment requirement, with the employee in pay status for at least half that period. The new law assigns the North Carolina Human Resources Commission responsibility for setting a minimum service period and rules for aggregating service across an executive branch agency, public school, or community college. The final new-law service duration is not established in the currently posted materials, so do not treat the old 12-month description as confirmed for events on or after October 1, 2026.

Is the new leave paid at full salary?
OSHR says the former program paid eligible employees at 100 percent of regular pay. The statutory provision authorizing the new benefit does not itself specify a pay calculation, and OSHR says its policy is being updated. Ask HR how compensation will be calculated for a qualifying event on or after October 1, 2026, rather than assuming the former percentage applies.

No. For the statutory benefit, paid parental leave is available without first exhausting sick or vacation leave. The law also says it is in addition to shared leave and other leave authorized by state or federal law. It has no cash value when employment ends and is not used to calculate retirement benefits. See North Carolina Session Law 2026-40.

How does parental leave relate to FMLA?
OSHR lists Family and Medical Leave as a separate program with its own eligibility and rules. The statute makes parental leave additional to other state or federal leave, but that does not mean the programs have identical eligibility, timing, or payroll treatment. Ask your agency HR office how they coordinate in your circumstances.
How do you request paid parental leave?
- Contact your agency HR office promptly. Ask which policy applies based on the qualifying event date and request the current process for your employer.
- Confirm eligibility and leave calculation. For events on or after October 1, 2026, ask about the applicable service requirement, part-time proration if relevant, pay calculation, and any limits on repeated use.
- Ask what documentation and timing are required. The law delegates request and operational details to policy; the reviewed materials do not establish a universal deadline or documentation checklist.
- Use the current agency instructions and forms. OSHR’s page lists older policy materials and a request form while stating that the policy, FAQs, and guidance are being updated.
Start with the OSHR parental leave page and the enacted Session Law 2026-40, then confirm the current process with HR.

What details are still being set for events on or after October 1, 2026?
The law directs the Commission to address several issues through policy. The reviewed official materials do not yet establish the final answers for:
- the minimum service period and how service is aggregated;
- how part-time leave is prorated;
- the maximum number of uses in a 12-month period;
- available leave following a miscarriage or a child’s death during birth; and
- request deadlines, documentation, and other application procedures.
For any of these situations, ask your agency HR office for the applicable policy rather than inferring an answer from the 12-week maximum. OSHR identifies the October 1, 2026 effective date and says updated policy and guidance are forthcoming on its parental leave page.
