NFT trading connects Polish creators and buyers to digital markets that can cross national borders, but the available official sources do not show how much it contributes to Poland’s economy. They establish a more concrete point: under the Polish Financial Supervision Authority’s (KNF) explanation of EU rules, crypto-assets that are genuinely unique and non-fungible are outside the scope of MiCA. That exclusion is not automatic for every asset marketed as an NFT.

What role can NFT trading play in Poland’s economy?

NFT trading can be an economic activity in Poland without being confined to Polish buyers, sellers or platforms. A creator based in Poland may sell a token to a buyer abroad; a Polish collector may buy through a service provider based elsewhere. The transaction can connect people and services across borders, but its existence alone does not show that the activity is large or economically significant at national scale.

The plausible economic channels are creator income, buyer spending, intermediary services and cross-border payments. These describe how NFT activity could generate or move money. They are not measured findings about Poland: the reviewed official sources provide no Poland-specific NFT transaction values or counts, participant or employment estimates, tax receipts, or contribution to GDP.

Creator income

A sale may bring revenue to a creator, depending on the terms of the transaction and any applicable fees. The available sources do not quantify Polish creators’ NFT income or establish how much of it stays in Poland.

Buyer spending

Purchases by Polish collectors can represent spending on digital assets. But a buyer’s expenditure is not, by itself, a measure of domestic economic output: the seller, marketplace and other service providers may be in different countries. No reviewed official source establishes the scale or domestic share of this spending.

Marketplace and intermediary services

Trading can involve services such as custody, a trading platform, exchange, order execution, asset transfer or advice. Such services may be supplied by centralised providers, while some activity may take place through decentralised services. KNF’s MiCA guidance identifies relevant service categories, but the sources reviewed do not quantify the Polish business activity, employment or revenue associated with NFT-related services.

Cross-border flows

Because NFTs and the services used to trade them are digital, a transaction involving someone in Poland may also involve parties or infrastructure elsewhere. This makes cross-border connections a plausible part of the activity, not evidence of a net benefit to Poland. The reviewed material does not measure where NFT-related revenues accrue.

What MiCA’s NFT exclusion means

MiCA is the EU regulation covering selected crypto-assets and crypto-asset services. KNF’s guidance, modified on 26 November 2024, says that MiCA does not apply to crypto-assets that are unique and not fungible with other crypto-assets, including digital art and collectibles. The key test in that explanation is whether an asset is unique and non-fungible—not simply whether its seller calls it an NFT.

Accordingly, the exclusion should not be read as a blanket exemption for anything issued or traded using NFT technology. Classification depends on the characteristics of the asset. KNF’s guidance also identifies other limits and exclusions, including decentralised services and certain financial instruments; those categories are distinct from the treatment of unique NFT crypto-assets.

How MiCA service rules may matter to trading

Even where a unique NFT itself falls outside MiCA, a service connected with crypto-assets may raise a separate question about the regulation’s scope. KNF lists custody, operation of a trading platform, exchanges, order execution, transfers and advice among the relevant crypto-asset services. Whether a particular activity or provider is covered depends on the applicable rules and the facts; the list is not a determination about every NFT marketplace or transaction.

This distinction helps explain why “NFTs are outside MiCA” is too broad. KNF’s stated exclusion concerns unique, non-fungible crypto-assets. MiCA’s treatment of a service provider is a separate issue, and KNF’s guidance also notes limits for decentralised services. Readers should not infer that every NFT-related service is either regulated or exempt solely from the label attached to a token or platform.

Poland’s implementation and supervision status

KNF’s notice updated on 23 June 2026 said the MiCA transitional period ended on 1 July 2026. The same notice said Poland’s implementing act had not entered into force and that no Polish public authority had yet been designated as competent for MiCA supervision, except for issuers of e-money tokens. These are statements in KNF’s notice as of 23 June 2026, not confirmation of the position on 11 October 2026; legal and supervisory arrangements may have changed since then.

The Senate’s legislative-history record shows that the Crypto-Asset Market Act went through Senate proceedings in October 2025 and was returned to the Sejm on 17 October 2025. That record describes the bill’s progress through that date; by itself, it does not establish what happened afterward or determine the law’s status in October 2026. The EU-wide MiCA framework and Poland’s national implementation and supervisory arrangements should therefore be kept distinct.

What the available evidence does—and does not—establish

The official material reviewed is useful for understanding regulatory boundaries, but it does not establish the size of NFT trading in Poland. It supplies no national transaction total, count, participant estimate, employment figure, tax-revenue amount or GDP contribution. Global NFT estimates or general cryptocurrency statistics would not fill that gap: they measure different markets or activities and cannot be treated as Polish NFT data.

For now, the grounded description is that NFT trading is a possible channel of digital-asset exchange linking Polish participants with domestic and international services, while its national economic weight remains unquantified in the reviewed sources. No conclusion about whether it is a significant Polish industry follows from the regulatory material alone.

Tax treatment is a separate question

The KNF and legislative materials described here address MiCA’s scope and Poland’s implementation arrangements; they do not settle how a particular NFT transaction should be treated for tax purposes. The reviewed sources do not provide official tax guidance sufficient to state a general Polish NFT tax rule. Anyone assessing an actual transaction should consult applicable Polish tax guidance or a qualified adviser rather than infer tax treatment from MiCA’s NFT exclusion.
