NFL Backs New Jersey in Supreme Court Fight Over Sports Prediction Markets

The NFL is backing New Jersey’s request for the U.S. Supreme Court to review who regulates sports event contracts offered by prediction-market platforms: the federal Commodity Futures Trading Commission (CFTC), or states applying their sports-betting laws. But the Court had not agreed to hear the case as of an October 9, 2026, report by Front Office Sports, and the headline claim that “everyone” wants review overstates the support documented there.

What is the Supreme Court being asked to review?

The dispute concerns regulatory authority over event contracts tied to sports outcomes. Prediction-market platforms offer these contracts to users; the legal question in this case is whether federal derivatives oversight or state sports-betting laws govern them. It is not yet a Supreme Court ruling on whether these contracts are lawful or on how any particular contract must be regulated.

New Jersey petitioned the Court after two federal appeals courts reached different results on whether states could apply sports-betting laws to prediction-market platforms. That split gives the justices a reason to consider clarifying the issue, but it does not mean they will take the case. The October 9 Front Office Sports report describes the appellate results as conflicting; it does not set out the precise reasoning of each court.

Who is supporting New Jersey, and what do the sides argue?

The NFL filed a brief supporting New Jersey. The petition also had support from attorneys general for 39 states and the District of Columbia, and from a coalition of 145 tribal nations and organizations, according to Front Office Sports. Those filings show substantial support for Supreme Court review, not universal agreement about the right regulatory approach.

Stakeholder Position described in the October 9 report
NFL Supports New Jersey and argues that sports event contracts should face state-level rules. The league says those rules offer stronger safeguards for game integrity and consumer protection, and has raised concerns about manipulation risks, the CFTC’s resources, and age limits.
CFTC Said it had engaged with the NFL and regretted that the league declined a memorandum of understanding that could have supported cooperation and information exchange.
Kalshi Said market integrity is its top priority, described its surveillance and league-partnership approach, and said the CFTC actively polices sports-related markets.
Polymarket Said it was enhancing surveillance and working with regulators and leagues toward a harmonized federal framework.

The table summarizes positions as reported, not facts established by the courts. In particular, the NFL’s criticisms of federal oversight are the league’s claims; the report does not independently establish that the CFTC lacks adequate safeguards or resources.

Why does the NFL say state oversight matters?

The NFL’s concerns center on integrity protections, consumer safeguards, market manipulation, and whether a federal regulator can oversee the activity adequately. It also pointed to an access-rule difference: the league said some platforms allow users aged 18 to trade sports contracts, while many state-regulated sportsbooks set a minimum age of 21. That comparison is the NFL’s argument, not a finding that every platform or state follows those thresholds.

The league’s brief reportedly made its concern conditional: if federally regulated exchanges adopted robust safeguards and vigorous oversight comparable to those of state and tribal regulators and legalized sportsbooks, there might be less reason for concern. The brief’s quoted response to the present situation was: “But that is not what is happening.”

The NFL also cited the scale of sports-related activity. According to the league filing as reported by Front Office Sports, more than half of prediction-market trading volume on the first Sunday of the season—$1.8 billion of $3.3 billion total—related to the NFL. That is a figure for one Sunday, attributed to the NFL filing; it is not an independently audited measure or a season-wide total. An unnamed league source told Front Office Sports: “Given this volume of trading and the uncertainty around it, it is critical for the Court to act as soon as possible.”

What did the CFTC and platforms say in response?

The CFTC spokesperson’s response, as reported by Front Office Sports, focused on the league’s decision not to sign a memorandum of understanding: “It’s unfortunate the NFL declined” to do so. The agency said such an agreement could have enabled cooperation and information exchange.

Kalshi and Polymarket described surveillance and regulatory engagement, while Polymarket also called for a harmonized federal framework. These are the companies’ reported positions; the report does not establish how effective their surveillance is or resolve whether federal oversight alone addresses the NFL’s concerns.

What happens next?

As of the October 9 report, the Supreme Court had not agreed to hear New Jersey’s case. Kalshi’s response was due November 9, 2026, according to that report. An unnamed Supreme Court expert quoted by Front Office Sports said January was the earliest possible point for action and cautioned that it could take longer. That was an expectation, not a confirmed Court schedule.

If the justices decline review, the conflicting appellate outcomes would remain in place. If they accept the case, they would consider the dispute over the boundary between federal regulation and state sports-betting laws; accepting review would not itself decide which side is right. The immediate outcome to watch is therefore whether the Court grants New Jersey’s petition, not whether the legal merits have already been settled.
