That account comes from New York Times reporting summarized by Benzinga; it is not an IRS-approved finding or proof that the credits were improper. Meta’s public filings do not independently identify the facilities as pilot models.
What does “pilot models” mean in this report?
The phrase describes the reported tax rationale for certain data centers: Meta allegedly classified them as pilot models—facilities used in research and development—and treated some equipment as research supplies for federal research-credit purposes. The reporting specifically mentions Nvidia chips. The public filing cited in coverage does not independently confirm that facility-specific classification, so “pilot models” should be understood as a description of Meta’s reported tax position, not an established IRS determination.

The reported research-credit tax savings increased each year. These figures are attributed to company filings by The New York Times, as relayed by Benzinga; they are not measures of data-center construction spending or total AI spending.
#1 Best Overall
| Year | Reported research-credit tax savings |
|---|---|
| 2023 | $700 million |
| 2024 | $2 billion |
| 2025 | $3.9 billion |
The reported $3.9 billion is a tax-savings figure, not Meta’s research-and-development budget. Meta’s 2025 Form 10-K separately reports $57.372 billion in R&D expense for that year. The two amounts measure different things: one is reported tax savings associated with research credits, while the other is the company’s R&D expense.
What do Meta’s filings say about tax uncertainty?
Meta’s 2025 Form 10-K, filed January 29, 2026, says unrecognized tax benefits were predominantly accrued for uncertainties involving research tax credits and transfer pricing. As of December 31, 2025, the filing reported $16.45 billion in gross unrecognized tax benefits and $11.23 billion in net uncertain tax positions. These are company-wide disclosures, not estimates of the tax treatment of AI data centers alone.
The filing explains that Meta recognizes tax benefits from uncertain positions only when it believes a position is more likely than not to be sustained on examination based on its technical merits. It also identifies uncertainty about supporting documentation for research activities as part of its assessment. This describes Meta’s general accounting approach; it does not establish how the IRS will decide the specific data-center claims.
Has the IRS challenged the reported data-center credits?
The available filings do not establish a final IRS decision on the reported AI data-center tax-credit strategy. A separate matter should not be mistaken for one: in a September 2025 notice concerning tax years 2017–2019, the IRS asserted $15.89 billion in additional tax, plus interest and penalties. Meta’s Form 10-Q for the quarter ended June 30, 2026 says the notice’s proposed adjustments are not a final determination. That dispute involves different years and is distinct from the reported research-credit savings tied to AI data centers.

AI.info reported that Meta spokesman Andy Stone said the company uses tax incentives established by Congress to encourage domestic investment. That is Meta’s stated defense of its approach; it does not resolve whether the specific classifications meet the requirements for research credits.
