Mercenary spyware, stalkerware and ordinary malware are not interchangeable terms. Mercenary spyware is high-cost, government-directed surveillance aimed at a small number of selected people. Stalkerware is generally a consumer monitoring app secretly used by an intimate partner or another person who can access the victim’s device. Malware is the broad category of malicious software, which includes spyware but also ransomware, adware, botnets, trojans and cryptojacking.
The distinction matters because the likely attacker, installation method, evidence, personal danger and safest response differ. A suspicious battery drain may justify a routine malware check; the same action could be dangerous if an abusive partner is monitoring the phone. A suspected mercenary-spyware attack usually requires specialist assistance rather than a consumer scan.

The three terms in one view
| Question | Mercenary spyware | Stalkerware | Ordinary malware |
|---|---|---|---|
| Who operates it? | A commercial surveillance vendor selling to governments or state-linked customers | An individual abuser or another person who buys a monitoring app | A criminal group, fraudster, extortionist or other adversary |
| Who is targeted? | A small number of people selected for political, professional or public-interest reasons | A partner, ex-partner, family member or another person with device access | Broad or opportunistic victims, or selected companies and institutions |
| How is it installed? | Exploit chains and other highly sophisticated methods; user action may not be required | Usually physical access, an unlocked phone, sideloading, rooting or jailbreaking, or a disguised app | Phishing, malicious downloads, trojans, drive-by attacks, exposed services or supply-chain routes |
| What is the defining issue? | State surveillance using exceptional resources and stealth | Covert monitoring without informed, ongoing consent | Unauthorized access, harm, theft or disruption |
| Typical capability | Reading messages and files, tracking location, and activating microphones, cameras or other device functions | Tracking location, reading messages and email, viewing photos, recording conversations and monitoring online activity | Anything from advertising and credential theft to encryption, extortion, spam, botnet control or surveillance |
| Safest first response | Specialist incident response and guidance from the device maker or a trusted digital-rights/security organization | A personalized safety plan, ideally made from a safer device, before scanning or removing anything | Isolate the device, update it, scan with current security software, secure accounts and follow a recovery plan |
What “malware” and “spyware” actually mean
Malware is the umbrella category
Microsoft uses malware for malicious software designed to disrupt, damage or gain unauthorized access to systems. The word describes intent and behavior, not one particular program. Ransomware encrypts data and demands payment; adware displays unwanted advertising; botnet malware enrolls a device in a remotely controlled network; cryptojacking abuses its processor for cryptocurrency mining; trojans masquerade as legitimate software; and some malware steals credentials or spies on users.

Spyware is a functional type of malware
NIST defines spyware as software secretly or surreptitiously installed to gather information without the user’s knowledge and classifies it as malicious code. Spyware therefore describes what the program does: covertly collects information. It is one part of malware, not a synonym for the whole category.
Spyware can collect browsing history, credentials, messages, files, contacts, location or audio. The same surveillance capability can be packaged for a criminal campaign, an abusive relationship or a state-directed operation. The social context and installation method determine whether people call it ordinary spyware, stalkerware or mercenary spyware.
What makes stalkerware different
Consent and relationship context are central
The Federal Trade Commission describes stalkerware, also called spyware, as software or an app that someone installs on a phone or other device without the owner’s knowledge. It may track location, record conversations, read messages and email, view photos or monitor online activity.
The Coalition Against Stalkerware uses a narrower definition: software made available directly to individuals that lets a remote user monitor another person’s device without that person’s consent and without explicit, persistent notification. The purpose or effect can facilitate intimate-partner surveillance, abuse, stalking or violence.
That definition explains why an app’s marketing label is not decisive. A parental-control or employee-monitoring product may have legitimate, clearly disclosed uses. If a partner secretly installs it, hides its icon and keeps monitoring after consent is absent or withdrawn, the issue is stalkerware regardless of the product’s advertised category.
How stalkerware commonly gets onto a phone
- Physical access: The person may briefly use an unlocked phone or know its passcode.
- Sideloading: An app is installed outside the official app store.
- Rooting or jailbreaking: Security protections are weakened so monitoring software can hide or gain deeper access.
- Disguised software: The app uses a bland name or icon, or its launcher icon is hidden.
- Account takeover: A person who controls the victim’s cloud account may read synchronized data without installing a classic stalkerware app.
Capabilities vary widely. Some products expose only location; others copy texts, photos, calls, browser activity or microphone recordings. A monitoring app can also leave traces such as unusual permissions, a device-management profile or a new accessibility service, but a lack of visible traces does not prove that a phone is clean.
What mercenary spyware is—and why it is a different threat model
Commercial products sold to governments
Amnesty International defines commercial or mercenary spyware as surveillance products developed and sold by corporate actors to governments. A complete operation can include an exploit chain, a spyware agent installed on the target device, and backend systems that collect and analyze the information.

These operations select a small number of targets rather than infecting everyone who clicks a malicious advertisement. Targets may be journalists, activists, political figures, diplomats, lawyers, researchers or people connected to a government investigation. Selection alone does not prove an infection, but it changes the level of concern and the appropriate response.
Exceptional cost and short-lived campaigns
Apple says mercenary-spyware attacks are individually targeted, exceptionally resource-intensive and often short-lived. It says an attack can cost millions and that it has notified users in more than 150 countries since 2021. Those figures describe Apple’s notifications and its assessment of this threat class; they are not a prevalence estimate for all phones.
Because these campaigns may use previously unknown vulnerabilities, a normal antivirus scan can miss them or fail to establish what happened. A suspected target should preserve relevant information and seek specialist guidance from the device manufacturer or a trusted digital-rights or security organization.
Why the same technical feature can mean different things
Location tracking, screen capture, message collection and microphone access are capabilities, not diagnoses. A legitimate accessibility tool, a business-management system, an abusive monitoring app and a state-grade implant might all request overlapping permissions. The questions that separate them are:
- Was the installation disclosed clearly?
- Did the device owner give informed, ongoing consent?
- Who controls the account or backend receiving the data?
- How was the software installed, and did the installer have physical access?
- Is the likely operator an intimate partner, a criminal group or a state-linked customer?
- What harm could occur if the software is detected or removed?
These questions prevent a common error: treating every monitoring capability as evidence of mercenary spyware, or treating a dangerous domestic-abuse situation as a routine antivirus problem.
Can symptoms prove that someone is spying?
No single symptom proves stalkerware or any other spyware. Battery drain, a warm phone, higher mobile-data use, unexplained permissions, a hidden app or an abuser knowing private details are reasons to assess the situation, not proof of a particular infection.
Signs worth documenting
- Unfamiliar apps, device-administrator entries, accessibility services, VPN profiles or configuration profiles
- Unexpected changes to account passwords, recovery addresses, trusted devices or two-factor-authentication settings
- Location sharing, cloud backups or family-account memberships that the owner did not enable
- Rapid battery or data changes that began after a particular incident
- Someone accurately knowing messages, movements, searches or conversations that were not shared with them
- Security warnings from the phone maker, an account provider or a reputable security tool
These signs can also result from ordinary software bugs, legitimate synchronization, a compromised online account, a failing battery or a different kind of malware. Record dates, screenshots and account notices only if doing so is safe. Do not confront a suspected abuser or change settings on the monitored phone merely to test a theory.

If you suspect stalkerware: put safety before cleanup
Stalkerware is both a cybersecurity problem and a personal-safety problem. The FTC warns that contacting an advocate or researching removal on the monitored phone may alert an abuser. The Coalition Against Stalkerware likewise recommends a personalized safety plan and warns that removal can be detected.
Use a safer device first
If possible, use a friend’s phone, a public computer or another device the suspected person cannot access. From that safer device, contact a domestic-violence or survivor-support organization, a qualified advocate or local emergency services if there is immediate danger. Explain that the concern involves possible device monitoring; an advocate can help decide what evidence to preserve and when to make changes.
Decide whether preserving evidence is important
Removing an app can destroy evidence, while leaving it in place can allow continued monitoring. If legal action, a protection order or a workplace investigation is possible, ask an advocate or attorney how to preserve evidence safely. Photographing the screen with another device, writing down dates and retaining account-alert emails may be safer than exporting files from the suspected phone, but the right choice depends on the situation.
Consider the replacement and reset options
The Coalition Against Stalkerware says a new phone is the most effective route and a factory reset is almost as effective. A replacement phone should not be restored wholesale from a backup controlled by the suspected person; restoring a compromised app set or account can recreate the problem. Change important passwords and recovery methods from a clean device, enable multifactor authentication, review signed-in sessions and check whether the other person controls the mobile account or email address.
Scan only after considering visibility
Malwarebytes says its Android scanner detects known stalkerware-type apps, but it also warns that scanning can be visible to the person monitoring the device. A scan cannot prove that a phone is clean, particularly if the software is custom, well concealed or operating through an account rather than an installed app. Coordinate any scan or removal with the safety plan rather than treating it as a harmless first step.
If you suspect ordinary malware: contain, investigate and recover
For a typical malware incident without an intimate-partner safety concern, the priority is to stop further access and protect accounts.
- Isolate the device when practical. Disconnect from Wi-Fi and mobile data if doing so will not create personal danger or destroy evidence. For a business device, follow the organization’s incident-response instructions instead of improvising.
- Use a clean device for account security. Change email, banking, social-media and password-manager credentials from a device you trust. Revoke unfamiliar sessions, replace recovery details and enable multifactor authentication.
- Update the operating system and apps. Install current security updates from the device maker and remove software you do not recognize. Do not install “cleaner” tools from pop-up advertisements.
- Run a current security scan. Use reputable, up-to-date security software appropriate for the operating system. Record what it detects and when; a clean result lowers risk but does not prove that no compromise occurred.
- Protect important data. Preserve essential documents using a known-clean system. Avoid copying suspicious executables or scripts into the backup.
- Recover according to the incident. A factory reset may be appropriate for a personal device; an organization may need forensic imaging, credential rotation, log review and a documented rebuild. Follow the security provider’s or IT team’s instructions.
Ransomware, credential theft and botnet infections may require different containment steps. If money, identity documents, health information or business systems are involved, involve the bank, service provider, employer or an incident-response professional promptly.

If mercenary spyware is a possibility
Do not assume that a consumer antivirus result settles the question. A suspected mercenary-spyware target should avoid unnecessary changes that could erase forensic evidence and should seek specialist advice. Contact the device manufacturer’s threat-notification or security channel when one is available, and consider a trusted digital-rights or security organization with experience in targeted surveillance.
Preserve notification emails, unusual account alerts, device logs and relevant dates from a separate safe device. Keep the phone powered and connected only as advised by the specialist; disconnecting, resetting or updating can alter evidence, but leaving a device online can also expose more information. The correct choice depends on the investigation and the immediate safety risk.

Malwarebytes and the Coalition Against Stalkerware reported a 780 percent rise in monitor-app detections and a 1,677 percent rise in spyware detections during their January 1–June 30, 2020 reporting period. Those are historical vendor-telemetry changes for that period, not a measurement of how common stalkerware is today. Detection counts depend on the products, users, regions and definitions included, so they should not be converted into a personal probability of infection.
Prevention that works across all three threat types
- Keep the operating system, browser and apps current, and enable automatic updates where appropriate.
- Use a long, unique screen lock and do not share it with a partner, colleague or casual helper.
- Protect the primary email and cloud account with multifactor authentication and review signed-in devices regularly.
- Install apps only from trusted sources, examine the developer and permissions, and remove software that no longer has a clear purpose.
- Review location sharing, family groups, cloud backups, device-management profiles and accessibility permissions.
- Be cautious with links, attachments and urgent requests that ask for a password, payment or software installation.
- Separate personal and work accounts where possible, and report suspicious activity through the organization’s security process.
- If domestic abuse is a possibility, make technology changes with an advocate; ordinary “best practices” can increase danger when an abuser is watching.
Common mistakes and better choices
“Spyware” means every kind of malware
Why it fails: Ransomware, adware, botnets, trojans and cryptojacking have different purposes and symptoms.
Better approach: Use malware as the broad category, spyware for covert information gathering, and stalkerware for covert monitoring software used by an individual without informed consent.
A battery drain proves stalkerware
Why it fails: Batteries age, apps misbehave and network conditions change.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Better approach: Treat the symptom as one clue among several, check account and permission changes, and consider personal safety before taking action.
Best Value
Delete the suspicious app immediately
Why it fails: Removal can alert an abuser, destroy evidence or trigger escalation.
Better approach: Use a safer device to consult an advocate and choose between evidence preservation, a controlled reset or a replacement phone.
A consumer scan rules out mercenary spyware
Why it fails: Targeted operations may use custom tools, unknown vulnerabilities or backend account access that ordinary scanners do not identify.
Free tools Windows power users keep installed
One-click scans. No signup required.
Better approach: Escalate a credible targeted-surveillance concern to the device maker or a specialist organization.
A practical decision framework
- Start with the likely relationship and target. An intimate partner with phone access points toward a stalkerware safety plan; a broad phishing incident points toward ordinary malware; a high-profile, highly targeted concern may justify specialist escalation.
- Identify the data and behavior. Encryption, ransom demands and spam suggest non-spyware malware. Secret collection of messages or location suggests spyware capabilities, but not necessarily a particular operator.
- Check how access could have happened. Physical access and a known passcode support a stalkerware hypothesis. A zero-click exploit or highly unusual targeted notification raises the level of concern.
- Choose the response that minimizes harm. Safety planning comes before removal when another person may retaliate. Routine containment and scanning are reasonable for ordinary malware. Specialist handling is appropriate for suspected mercenary spyware.
The bottom line
Mercenary spyware is an expensive, state-directed surveillance service aimed at selected targets. Stalkerware is covert monitoring by an individual, usually enabled by physical access and defined by the absence of informed, ongoing consent. Ordinary malware is the larger family of malicious software, including spyware but also many programs that do not spy at all.
Because symptoms overlap, neither a warm phone nor a clean scan proves what happened. Match the response to the threat: make a safety plan before investigating suspected stalkerware, contain and recover from ordinary malware, and seek specialist guidance for a credible mercenary-spyware concern.
