Mamdani’s Rent Freeze Is in Effect for Covered Leases—but It’s Being Challenged in Court

New York City’s 2026–27 rent freeze is a 0% Rent Guidelines Board (RGB) increase for covered rent-stabilized apartment and loft leases—not a freeze on every rent in the city. It took effect for covered lease periods beginning October 1, 2026, and runs through September 30, 2027. Landlords have challenged the board’s decision, but a reported court order requiring disclosure of communications did not block or invalidate the freeze.

What the rent freeze covers

RGB Order No. 58 sets a 0% guideline adjustment for covered one-year and two-year rent-stabilized apartment lease periods that commence from October 1, 2026, through September 30, 2027. The order also sets 0% guidelines for covered loft leases over the same window. The city’s RGB describes its remit as covering approximately one million rent-stabilized dwelling units; the order does not apply to all New York City rentals. Rental or lease type What Order No. 58 says Practical meaning
Covered rent-stabilized apartment, one-year period 0% guideline increase for a period commencing October 1, 2026, through September 30, 2027. The guideline adjustment for that renewal period is zero.
Covered rent-stabilized apartment, two-year period 0% guideline increase for a period commencing October 1, 2026, through September 30, 2027. The same 0% guideline applies to a qualifying two-year period.
Covered loft lease 0% guidelines for covered one-year and two-year periods commencing in the same window. The order includes covered loft leases as well as apartments.
Market-rate or other rental not covered by the order Order No. 58 does not set its rent adjustment. This order is not a citywide cap or freeze on market-rate rents.

The order defines periods up to and including one year as one-year periods; periods longer than one year and up to and including two years count as two-year periods. A lease’s term and commencement date both matter. Order No. 58

How to check whether your apartment is covered

  1. Find out whether the apartment is rent stabilized. The freeze is tied to rent stabilization, not simply to being a New York City renter. If you are unsure whether your building is covered, Mayor Zohran Mamdani directed tenants to call 311 for the city’s tenant helpline. That is general guidance, not a determination of an individual lease’s legal status. October 2026 mayoral transcript
  2. Check the renewal’s commencement date. The covered period must begin on or after October 1, 2026, and no later than September 30, 2027.
  3. Check the lease period. The order’s 0% guidelines apply to covered one-year and two-year periods, including fractional periods as defined in the order.
  4. Read the order alongside the lease and rent history. Order No. 58 has technical provisions involving escalator clauses, prior lawful adjustments, special guidelines, and credits. It says that rent charged and paid above the levels established by the order must be credited against the next month’s rent. The 0% guideline is not a claim that every possible rent charge or lawful rent component in every covered building is automatically zero or can never change. Order No. 58

When the freeze started

The RGB adopted Order No. 58 on June 25, 2026. Its covered lease window began October 1. On that date, Mamdani said the one-year and two-year rent freeze “goes into effect today.” His statement describes the order’s start; it does not expand the order beyond the covered units and lease periods. What the court challenge has—and has not—established

Landlords are challenging the RGB’s decision or process. A September 16, 2026, New York Times report said a Manhattan judge ordered the Mayor’s Office to disclose specified written communications with the RGB from January 1 through June 26. That was a discovery ruling about producing communications, not a decision that the board acted unlawfully and not an order setting aside the freeze. The New York Times report

Order No. 58 remained published, and Mamdani said it was in effect on October 1. Those facts do not establish how the court will ultimately rule. No merits decision blocking the order is reported in the September account cited above.

Why the RGB’s decision is contested

Mamdani presented the vote as tenant relief. In his June 25 statement, he called it “a historic victory for New York City tenants” and credited the board’s review of data and public testimony. He also described the 0% two-year guideline as the city’s first-ever freeze for two-year leases; that is his characterization. Mamdani’s June 25 statement

The RGB is an independent body. The Mayor’s Office says its work considers housing’s economic condition, cost-of-living trends, housing supply and vacancy rates, tenants’ ability to pay, staff research, and public testimony. In February 2026, the administration announced six appointments to the nine-member board, including chair Chantella Mitchell. Appointment announcements and the board’s stated factors are relevant context, but neither resolves the landlords’ legal challenge. Mayor’s Office appointment announcement

Landlord groups, meanwhile, argued that a freeze could make it harder to cover rising operating costs and maintain buildings. The Associated Press quoted New York Apartment Association CEO Kenny Burgos warning of deterioration, foreclosures, and bankruptcies; those are stakeholder predictions, not demonstrated outcomes of this order. AP also reported that landlord representative Christina Smyth resigned, alleging the board had predetermined its result. That was her criticism, not a court finding. Associated Press report

What renters should take from the dispute

The immediate distinction is between a 0% guideline for a qualifying stabilized renewal and the broader phrase “rent freeze.” If your unit may be covered, verify its status and compare the renewal’s start date and term with Order No. 58. For help with coverage questions, Mamdani’s October 1 remarks point tenants to 311; a helpline inquiry is not a substitute for a determination based on the specific lease and rent history.
