Royal Malaysian Customs Department (RMCD) guidance says construction work services for residential buildings and public facilities related to them are not subject to service tax. Keep a project file that establishes the building’s residential scope and the work and materials charged. If a contract includes taxable construction work—such as non-residential components—retain the invoices, payment and progress records needed to assess that work separately.
First determine whether the work is taxable
RMCD’s MySST FAQ states that construction work services for residential buildings and public facilities related to those buildings are not subject to service tax. It also says a contractor providing full construction services for a residential building does not need to register solely on that account.

Do not assume that a project is wholly outside the tax scope just because it is described as a housing development. Mixed developments and projects containing non-residential components may receive different treatment. Check the actual project approvals and the current RMCD Guide on Construction Work Services for the project and relevant period.
The sources do not prescribe an exhaustive statutory checklist of documents to prove residential classification. Keep existing project records that make the scope clear, and organize them alongside the contract rather than treating any particular record as a guaranteed test.

Documents to keep in the project file
| Document or record | What it helps establish |
|---|---|
| Executed construction contract, schedules, annexes and amendments | Parties, location, scope of work, residential and other components, pricing basis, and whether material and service charges are separately stated. RMCD’s guide also identifies contract documents as support for actual building-material costs. |
| Project invoices and credit notes | Amounts billed and later adjusted. RMCD says registered persons must issue invoices for construction work services. |
| Supplier invoices and related material-cost records | Actual cost of building materials and the basis for any separately stated material value. |
| Payment receipts, bank records and invoice reconciliations | When amounts were received and which invoices or claims they settle. |
| Progress claims and work-completion certificates | Work periods and completed stages linked to each claim, invoice and payment. |
| Retention statements and release or payment records | Amounts withheld as retention and when they are later paid or released. |
| Project plans, approvals, descriptions and other relevant project records | Context for the project’s residential character and boundaries, particularly where the development includes mixed or non-residential uses. |
How to document materials and service charges
For taxable construction work, RMCD’s guide says that when an invoice separates goods or materials from services, service tax applies to the construction service value. Material value is based on actual cost without mark-up and must be supported by relevant records, including supplier invoices, contract documents and related records.
If a lump-sum invoice does not separate the values, the guide says the full invoice value is subject to service tax. That valuation treatment applies to taxable construction cases; it does not override the stated exclusion for residential building construction services and related public facilities.

Track invoice, payment and retention timing for taxable work
RMCD’s FAQ says registered persons must issue invoices for construction work services. The normal accounting point for taxable construction service is receipt of payment, unless Customs has approved invoice-basis accounting. Keep payment evidence reconciled to invoices so the timing and amount can be followed.
For progressive-payment contracts involving work-completion certificates, the FAQ says to account for tax when payment is received. If payment remains outstanding 12 months after the service was provided, tax becomes due the following day. The FAQ also states that retention sums are subject to tax in taxable construction cases, so retain records of the withheld sum and its payment or release.

- Define the project scope. File the signed contract and relevant plans, approvals and project descriptions; identify residential, public-facility, mixed and non-residential components.
- Connect charges to work. Keep each invoice or credit note with the contract schedule, progress claim or completion certificate it relates to.
- Substantiate material values. Match supplier invoices and other cost records to the materials and amounts included in the contractor’s billing.
- Reconcile collections and retention. Link bank or receipt records to invoices and claims, and separately track retained amounts and subsequent releases.
- Record the accounting basis. For taxable services, retain evidence of payment timing and any Customs approval to account on an invoice basis.
RMCD’s FAQ describes its contents as general information subject to change. The FAQ and guide are administrative guidance; verify the legislation and current Customs materials applicable to the contract period and project facts. The cited materials do not establish a complete statutory record-retention period, so do not infer one from this practical file list.
