LiveLawBiz’s October 14, 2026 corporate-law round-up, published under Kirit Singhania’s byline and updated October 15 at 04:37 GMT, covers insolvency, taxation, intellectual property, arbitration, securities regulation, real estate and money-laundering enforcement. The most consequential headlines concern the date from which NCLAT appeals are limited, possible GST relief for companies in liquidation, new insolvency admissions, arbitration-seat rules, proposed SEBI action against promoters and bail in a ₹6,210 crore PMLA case.

The digest is headline-led rather than a collection of verbatim judicial quotations. Each item below identifies the forum, procedural stage and immediate business implication; parties should read the underlying order or notice before relying on a headline as a complete statement of law.

NCLAT appeal limitation starts at pronouncement

The Supreme Court headline says the limitation period for challenging an NCLAT order runs from the date the order is pronounced, not from the later date on which a certified copy is received. Companies and insolvency professionals therefore need a reliable record of the pronouncement date and should not assume that waiting for a certified copy extends the filing window.

GST pre-deposit issue for companies in liquidation

The Delhi High Court is to examine whether a company already in liquidation can obtain an exemption from the statutory GST pre-deposit required to pursue an appeal. The issue matters because a liquidator may have limited cash and must balance litigation costs against distributions to creditors. The headline records an examination by the court, not a final exemption.

Personal-guarantor insolvency involving Sagar Autotech

NCLT Indore admitted an insolvency application against Sagar Autotech’s personal guarantor in relation to debt of ₹3.95 crore. Admission moves the matter into the insolvency process and places the guarantor’s repayment and creditor claims under the framework administered by the tribunal.

GIMCO admitted to corporate insolvency resolution

NCLT Ahmedabad admitted GIMCO into the corporate insolvency resolution process under Section 10, the provision used when a corporate debtor itself seeks commencement. The tribunal also appointed an interim resolution professional, who takes control of the process and begins collecting claims and preserving the debtor’s records and assets.

Outgoing resolution professional must hand over records

NCLT Indore held that an erstwhile resolution professional cannot refuse to transfer records to a liquidator by arguing that the professional is functus officio—no longer holding the assignment. The practical message is continuity: books, claim files and process records remain necessary for liquidation even after the earlier appointment ends.

Intellectual property and online content

ITC denied exemption from pre-litigation mediation

The Calcutta High Court refused ITC’s request to bypass mandatory pre-litigation mediation in a counterfeit-cigarette dispute. The ruling keeps the statutory mediation step in place before the infringement action can proceed, unless a recognized exception applies.

DAZN Serie A streams blocked

The Delhi High Court ordered blocking measures against 20 rogue websites that were streaming DAZN’s Serie A matches. Such dynamic-site injunctions are aimed at preventing repeated infringement as mirror domains appear, protecting the broadcaster’s rights during live sporting events.

Protection for Amazon film before release

In advance of the release of Amazon’s film Nayyi Naveli, the Delhi High Court granted protection against online piracy. The pre-release order is intended to stop unauthorized uploads and links before they can undermine the film’s launch.

Tax and customs

CKD electric two-wheelers without battery or charger

CESTAT Delhi held that completely knocked-down electric two-wheelers imported without a battery and charger do not qualify for the relevant customs-duty exemption. Importers using a component-based supply model must therefore verify that every condition of the exemption is met rather than treating the vehicle’s electric configuration alone as sufficient.

Airline cancellation charges treated as compensation

CESTAT Delhi characterized airline cancellation charges as compensation for breach of contract, not consideration for a taxable service. The classification affects whether the amount is brought within service-tax or GST-type charging provisions and may be relevant to airlines’ contracts and accounting treatment.

₹3.91 crore demand against security guard quashed

The Delhi High Court quashed an income-tax demand of ₹3.91 crore issued to a security guard after his PAN was misused. The decision underscores the need to distinguish a genuine taxpayer’s income from transactions attributed to an identity fraudulently used in tax records.

Pernod Ricard reassessment notice survives

The Delhi High Court declined to quash Pernod Ricard’s ₹8.12 crore income-tax reassessment notice. The ruling leaves the reassessment proceedings open; it does not itself decide the company’s ultimate tax liability.

New facts cannot be introduced in revision

The Supreme Court said a taxpayer cannot use revision proceedings to raise fresh claims that depend on new facts. Parties seeking revision must work from the factual record already before the revisional authority rather than attempting to build a new case at that stage.

Company law and shareholder settlements

Consent is essential for NCLT mediation

NCLT Ahmedabad rejected Lendingkart’s request to send a dispute to mediation, emphasizing that mediation requires the parties’ consent. A tribunal cannot compel that consensual process merely because one side proposes it.

Notion Press settlement and share cancellation

NCLT Chennai approved a settlement involving Notion Press and directed a ₹3.75 crore payment for cancellation of shares. The order gives the agreed corporate restructuring effect through the tribunal-approved settlement.

Arbitration

SpiceJet accounts to maintain ₹58.80 lakh

In a travel-agent dispute, the Delhi High Court directed SpiceJet to maintain ₹58.80 lakh in its bank accounts. The preservation order protects the identified amount while the parties’ claims continue and does not, by itself, represent a final determination of liability.

Conditional stay of Shapoorji Pallonji award

The Calcutta High Court conditionally stayed an arbitral award against the West Bengal Housing Board in the Shapoorji Pallonji matter. Because the stay is conditional, the parties must comply with whatever security or other terms the court imposed for the protection to remain effective.

Seat cannot be inferred from an arbitration clause alone

The Supreme Court held that an arbitration clause by itself cannot determine the juridical seat when the contract specifies multiple places. Drafting must therefore identify the seat clearly and distinguish it from venues, hearing locations or the courts that have supervisory jurisdiction.

NHAI’s nil award upheld; extra work needs proof

The Delhi High Court upheld a nil award in a ₹4.37 crore NHAI arbitration and said claims for extra work require evidence. Contractors cannot obtain additional payment merely by asserting that work went beyond the original scope; contemporaneous instructions, measurements and contractual entitlement remain important.

Securities regulation

SEBI proposes demat freezes for undisclosed IPO-fund use

SEBI has proposed freezing promoters’ demat accounts when they fail to disclose how initial-public-offering proceeds were used. This is a regulatory proposal, not a reported final rule. If adopted, it would add a direct market-access consequence to disclosure failures and increase the importance of timely, accurate statements on IPO proceeds.

Commercial procedure

Rejecting mediation does not defeat a later suit

The Delhi High Court held that a defendant who rejects pre-institution mediation cannot later challenge the suit solely for alleged non-compliance with that requirement. A party cannot create the procedural objection by refusing the mediation invitation and then rely on that refusal as a bar to the action.

Real estate regulation

Bengaluru homebuyer ordered to pay ₹2.45 lakh

Karnataka’s Real Estate Appellate Tribunal upheld an order requiring a Bengaluru homebuyer to pay ₹2.45 lakh in outstanding dues. The decision confirms the enforceability of the adjudicated payment in that dispute.

Unishire attachment and final K-RERA order

The Karnataka High Court upheld attachment measures concerning Unishire property and said a final K-RERA order cannot be reopened through a collateral challenge. Parties must use the prescribed appeal or review route rather than attempting to undo a concluded regulatory order indirectly.

Banking, NBFC and debt recovery

₹3 crore in State Nirmithi Kendra deposits remains blocked

The Kerala High Court rejected State Nirmithi Kendra’s request to withdraw ₹3 crore in bank deposits prematurely. The ruling preserves the deposits pending resolution of the underlying banking or recovery dispute.

Auction purchaser cannot obtain interest through writ jurisdiction

The Karnataka High Court held that an auction purchaser could not seek interest through a writ petition after the National Consumer Disputes Redressal Commission had already rejected the claim. The decision reinforces the limits of using constitutional writ jurisdiction to revive relief that failed before the specialist consumer forum.

Prevention of Money Laundering Act (PMLA)

Concast Steel managing director granted bail

The Supreme Court granted bail to Concast Steel managing director Sanjay Surekha in a PMLA case involving ₹6,210 crore as stated in the headline. Bail is a pre-trial liberty decision; it does not determine guilt, confiscation or the final outcome of the prosecution.

What companies should take from the round-up

  • Record pronouncement dates for NCLAT orders and calculate appeal deadlines from that date.
  • Preserve insolvency records for any transition from resolution to liquidation.
  • Separate procedural rulings, interim protection and regulator proposals from final merits decisions.
  • Document the contractual basis and evidence for extra-work and arbitration claims.
  • Review IPO-fund disclosures and maintain clear audit trails for promoter reporting.
