For development lenders, the key implication of England’s Building Safety Levy is a large project cost that must be funded before a scheme’s first completion or occupation certificate. A September 2026 white paper from LendInvest and MDA Consulting recommends budgeting the levy from the outset, verifying the calculation as a project changes, and aligning funding with its pre-completion payment date. Those are the co-authors’ recommendations, not independently verified lending-market outcomes.
What is the Building Safety Levy?
The Building Safety Levy is a charge on qualifying residential development in England. It took effect on 1 October 2026, according to the joint white paper Building Safety Levy: Implications for Lenders & Monitoring Surveyors. The paper says the levy is intended to raise £3.4 billion over ten years; that is the stated policy target, not a reported amount already collected.
The paper identifies the main thresholds as 10 or more dwellings, or 30 or more purpose-built student accommodation (PBSA) bedspaces. It says a scheme is not exempt solely because it is below a particular height. Whether a specific development is liable depends on the detailed rules, exclusions, exemptions and transition provisions, so the Ministry of Housing, Communities and Local Government’s current guidance and linked regulations are the appropriate sources for a project-specific determination.
How is the levy calculated?
The white paper describes the calculation as chargeable Gross Internal Area (GIA) multiplied by the rate for the relevant local authority. The calculation is therefore sensitive to both the authority and the floorspace included, rather than being a single national amount per home.

- Floorspace: Residential communal areas may count. Commercial floorspace and qualifying exempt space are excluded. Mixed-use schemes require apportionment.
- Local rate: The paper gives £12.70/m² in County Durham and £100.35/m² in the Royal Borough of Kensington and Chelsea as examples. These figures illustrate a range reported by the co-authors; developers should confirm the applicable authority’s current rate schedule.
- Changes to a scheme: The paper recommends recalculating liability when changes affect chargeable area.
For a lender’s appraisal, that means checking the measured GIA and its treatment—not just applying a headline rate to an early estimate. The white paper’s recommendations are set out in its technical paper; official requirements should be checked against the government guidance.
What is the brownfield discount?
The paper says a 50% rate discount may apply if at least 75% of the land covered by the consent meets the qualifying previously developed land (PDL) criteria. Brownfield status should not be assumed from a site’s appearance or past use: the qualifying test and supporting evidence matter, and the paper advises verifying them before relying on a reduced liability.

For lenders, a prudent appraisal should test whether the development remains viable at the full rate if the discount is unavailable. The government’s guidance links to the rules and relevant calculation information.
When does the levy have to be paid?
The joint paper says payment falls due before the first completion or occupation certificate. That makes timing as important as the final amount: a levy payment scheduled after the facility’s available funds have been committed could leave a project unable to meet the payment requirement. The paper warns that underfunding may prevent certification and delay completion, occupation, sales, refinancing and loan repayment.

It describes a transitional provision for building-control applications submitted before 1 October 2026, subject to conditions including substantive commencement within three years. Application type, submission date and the project’s transition facts can affect the answer; check the current official guidance and regulations rather than treating the date alone as determinative.
What does the levy mean for development finance?
LendInvest and MDA Consulting recommend that lenders treat the liability as a fixed, senior-ranked project cost in the initial appraisal and ensure funding covers the single payment before the first completion or occupation certificate. Their white paper also recommends confirming the authority rate and GIA, and testing viability at the full rate when a PDL discount is assumed.

Monitoring surveyors, the co-authors say, should track the liability through pre-commencement, construction and pre-completion reporting; revisit the calculation after changes to chargeable area; and confirm the liability notice and payment evidence. These are professional recommendations in the paper, rather than findings from independent testing of projects or lending outcomes.
LendInvest separately says it has adapted its underwriting models and facility structures to account for the levy. That statement is the company’s own commentary and should not be taken as evidence of standard practice across development lenders. LendInvest’s article describes its position.

What lenders and project teams should compare
There is no reliable single-rate shortcut for comparing schemes. The white paper’s analysis points to five project-specific checks:
- Confirm the relevant local authority and its applicable rate.
- Verify measured chargeable GIA, including treatment of residential communal, commercial, mixed-use and exempt floorspace.
- Establish whether at least 75% of consented land meets the PDL test and whether the evidence supports the discount.
- Review the building-control application and commencement dates against transitional rules.
- Match the payment date to the development facility’s draw schedule and available funding.
Mortgage Solutions reported the white paper’s publication on 1 October 2026, the date the levy took effect, and quoted MDA Consulting Director Chris Chadwick describing the calculation as requiring “disciplined, stage-by-stage verification.” Its report and the joint paper explain the co-authors’ concerns; they do not establish independent lending outcomes.
