Copyright and anti-circumvention rules raise separate questions, and the federal video-game exemptions cover specific situations—not a general personal-use right to bypass access controls. The technical process also differs: PCSX2 documents conventional CD/DVD dumping for PS2 games, while xemu requires Xbox games in XISO format and describes Xbox-specific backup routes.
What does “legally backing up” mean?
People often use “backup” to mean several different things: making a digital copy of a disc, changing or extracting files to make an image usable by an emulator, and playing that image. Those actions can raise different legal questions. A lawful physical copy is relevant, but it does not by itself answer whether a particular copying method is permitted or whether it circumvents an access control.

What U.S. federal law says—and what it does not say
Copyright and anti-circumvention are separate issues
Section 1201 of the Copyright Act addresses circumvention of technological measures that effectively control access to copyrighted works. The U.S. Copyright Office reproduces the statutory baseline: “No person shall circumvent a technological measure that effectively controls access to a work protected under this title.” A personal-use purpose or ownership of the disc is not, by itself, an answer to that separate anti-circumvention question.

That distinction matters because an image-making workflow can involve more than copying. Whether a particular step circumvents a measure, and whether a specific exemption applies, depends on the work and method. A technical guide explaining how to create or use an image is not a legal opinion about those steps.
The video-game exemptions are narrow and conditional
The current temporary rule at 37 CFR 201.40(b)(19) includes defined exceptions for certain video-game circumstances. Among them are cases involving lawfully acquired complete games whose copyright owner or representative has stopped providing an external server needed for authentication. The rule allows specified activity for personal local gameplay in that category, with additional requirements for institutional preservation. A separate category addresses preservation by eligible libraries, archives, or museums of certain complete games that do not need an external server and are no longer reasonably available commercially.

These provisions have specific definitions and conditions. They are not a blanket exemption for an individual who owns a PS2 or original Xbox disc and wants to make an emulator image. The Copyright Office describes the exemptions as part of a periodic rulemaking process. It has said the tenth triennial rulemaking is underway and existing exemptions are being considered for renewal for October 2027 through October 2030. Because exemptions are temporary and may change, check the current regulation and Copyright Office proceedings before relying on one.

Do not assume either a categorical yes or a categorical no
The federal sources do not establish that every personal image made from a PS2 or original Xbox disc necessarily infringes copyright; they also do not establish a general permission to bypass access controls for personal emulation. A legal assessment may turn on the jurisdiction, the measure involved, the exact act, its purpose, and whether every condition of a current exemption is met.

How the technical process differs by console
| Console | Emulator documentation | What the documented route involves |
|---|---|---|
| PlayStation 2 | PCSX2 | PCSX2 describes dumping PS2 CDs or DVDs with a standard optical drive that supports the relevant media. It documents workflows for Windows, macOS, and Linux. |
| Original Xbox | xemu | xemu requires game discs in XISO format and describes Xbox-specific backup routes, including transfer from a real Xbox or use of a specially reflashed DVD drive. |
The comparison is about technical requirements, not legal permission. Neither emulator project’s documentation determines whether a user’s particular backup method is lawful.
Backing up a PS2 disc for PCSX2
Disc image and drive
PCSX2’s official disc-dumping documentation says PS2 game discs are unencrypted CDs or DVDs and can be dumped with a standard optical drive that supports CD and DVD media. It gives instructions for Windows, macOS, and Linux. If the computer has no built-in optical drive, the documentation identifies an external USB optical drive as an option; check the specific model’s operating-system and media support before buying or relying on it.

PCSX2 also notes that an imperfect dump can cause problems when playing a game and describes a verification process to help identify a successful dump. Follow the project’s instructions for the relevant operating system rather than assuming that every file produced by a drive is a good image.

PCSX2 requires BIOS files to run games. Its documentation identifies the BIOS as proprietary software and says users must dump it from their own PS2. A game-disc image does not supply that BIOS, and having a disc does not change the emulator’s separate requirement.

Backing up an original Xbox disc for xemu
xemu requires XISO
xemu’s documentation says the emulator uses game images in XISO format. It describes two Xbox-specific routes for backing up a legally purchased game: transferring files over FTP from a real Xbox running a custom dashboard, or using a specially reflashed DVD drive. These are not the same as the ordinary optical-drive workflow PCSX2 documents for PS2 media.
Full disc images may need conversion or repacking
According to xemu’s documentation, a full Redump-style image contains two partitions and is not directly compatible with xemu as-is. The second partition must be extracted or repacked for use. Do not assume that an image made by a general-purpose disc-reading setup will already be in the format xemu needs.
The documentation does not establish an ordinary USB DVD drive as a verified way to read original Xbox discs. The fact that a drive works for PS2 CDs or DVDs is not evidence that it will work for Xbox disc backup.
xemu’s stated position
xemu says it does not endorse piracy, does not allow game sharing through its channels, and expects game files to come from a real physical copy. That is the project’s stated position; it is not a legal determination that every backup made from a physical copy is permitted.
Quick Recap
A practical way to evaluate your situation
- Identify your jurisdiction. The legal discussion here is limited to the U.S. federal baseline; another country may apply different rules.
- Separate the acts involved. Consider whether you are copying a disc, changing or extracting data, bypassing a measure, or using the resulting image. Do not treat “I own the disc” as a substitute for assessing each relevant step.
- Check the current exemption text. If you think an exemption may apply, compare the exact facts with the current language and conditions in 37 CFR 201.40(b)(19). The categories described above are limited, and the rulemaking cycle can change them.
- Use the correct technical path for the console. Consult PCSX2’s disc-dumping and BIOS documentation for PS2, or xemu’s documentation for original Xbox format and backup requirements. A technically successful image does not itself establish legal permission.
- Get jurisdiction-specific advice when the stakes warrant it. A lawyer can assess a particular title, protection, method, and intended use against the applicable law.
