A layoff does not automatically create a federal right to severance, but it can trigger several time-sensitive choices. Check the employer’s written plan or agreement, file for unemployment with the state where you worked, compare COBRA with other health plans, and protect retirement tax deferral before accepting a distribution.
The rules below are U.S. guidance. Your state unemployment rules, employer documents, plan terms and personal tax situation control the final result.

- Get the termination letter. Confirm your last day, reason given, final-pay date and the contact for human resources or the plan administrator.
- Request the severance plan or agreement. Ask for the payment amount, schedule, conditions, benefit continuation and signature deadline.
- Obtain your final-pay and paid-time-off statement. It should show wages, accrued vacation or sick pay and any deductions.
- Confirm the benefits termination date. Ask when medical, dental, vision, life and disability coverage stop and when the COBRA notice will be sent.
- Download retirement documents. Keep the Summary Plan Description and your latest account statement, including the vested balance.
- File an unemployment claim promptly. Use the unemployment insurance program in the state where you worked, provide complete wage and employment dates, and report payments exactly as the state form requests.
The Department of Labor says a first unemployment payment generally takes two to three weeks after filing, although state processing times vary. Delaying the claim can delay eligibility or payment.

Am I entitled to severance after a layoff?
Federal law usually does not require it
Severance is generally a matter of contract rather than an automatic federal benefit. The Department of Labor states: “There is no requirement in the Fair Labor Standards Act for severance pay.” An employer may still owe severance under a written severance plan, employment contract, offer letter, collective-bargaining agreement or established policy. State law can add requirements in particular circumstances, so a state labor agency or employment attorney may be relevant.
Do not infer entitlement from what another employee received. Eligibility can depend on job level, tenure, the reason for separation, signing a release, complying with post-employment restrictions or remaining employed through a specified date.
What a severance agreement can exchange
The Equal Employment Opportunity Commission describes a severance agreement as a contract that may exchange money or benefits for a release of employment-related claims. Signing can therefore affect your ability to bring certain claims even when the payment itself looks straightforward.
Before signing, verify each item in writing:
- Cash amount, payment dates and whether payment is one lump sum or a series of payroll installments.
- Whether payment is conditioned on signing a release and whether the release contains an age-discrimination waiver.
- The revocation period and the exact deadline for returning the signed agreement.
- Continuation of medical or other benefits, the length of any employer subsidy and the premium you would owe afterward.
- Treatment of bonus eligibility, commissions, restricted stock, options and other equity.
- Rehire, confidentiality, non-disparagement and restrictive-covenant terms.
- What happens if you find a new job, die, violate a condition or are rehired by the company.
Ask questions before signing rather than relying on a verbal promise. If the payment is substantial, the release is broad, or a noncompete or other restriction is included, have a qualified employment professional review it.

Can I get unemployment if I receive severance?
Apply through the state where you worked
Unemployment insurance is administered by the states. File with the state program for the location where you performed the work, not automatically the state where the employer’s headquarters is located. Each state sets its own wage, work-history, availability and separation rules.
Provide accurate employment dates, wages, the layoff notice and any requested severance documents. Continue weekly or biweekly certifications and job-search steps required by that state while the claim is pending.
Report severance and other separation payments
State treatment of severance differs. A payment may affect the weeks for which benefits are payable, the amount, or neither, depending on how the state defines and allocates it. Report the severance exactly as the application asks; do not assume that receiving it automatically disqualifies you or that it has no effect.

When the first payment arrives
The Department of Labor’s general estimate is two to three weeks for a first check after filing. A missing wage record, identity verification issue, employer response or question about severance can take longer. Keep confirmation numbers, notices and a log of every agency contact so you can respond by the stated deadline.
How long will health insurance last after a layoff?
COBRA keeps the former group plan temporarily
Federal COBRA generally applies to employer health plans maintained by employers with 20 or more employees. After job loss, continuation is usually available for up to 18 months. The former employee commonly pays the full plan cost plus an administrative charge of up to 2%, so the total can be as high as 102% of the plan’s cost.
COBRA preserves the same group plan, provider network and covered prescription benefits, subject to the plan’s normal rules. It does not make the coverage inexpensive. Ask the plan administrator for the exact monthly premium, the election deadline, the date coverage begins, and how the first payment must be made. Keep the COBRA election notice; it is the controlling document for your plan.

What should I do with my 401(k) after losing my job?
Your retirement balance does not disappear when employment ends. First ask the plan administrator whether a distribution is permitted, which employer contributions are vested, what fees and investment choices apply, and whether a prospective employer’s plan accepts rollovers.
The four common paths
| Choice | How it works | Main decision points |
|---|---|---|
| Leave assets in the former plan | The account remains invested under the old plan’s rules. | Compare investment fees, available funds, creditor protection, service quality and whether the plan permits the balance to remain. |
| Transfer to a new employer plan | The new plan receives a rollover if its rules accept that type of asset. | Confirm acceptance before requesting the distribution; compare fees, investment menu, institutional funds and administrative convenience. |
| Direct rollover to an IRA | The plan sends the eligible distribution directly to an IRA, maintaining tax deferral. | Review investment expenses, advice costs, creditor protections, withdrawal rules and beneficiary administration. |
| Take a taxable distribution | You receive cash rather than preserving the account in a retirement plan or IRA. | Expect ordinary income tax and, before age 59½, a possible 10% additional tax unless an exception applies. |
Why direct rollovers matter
An eligible distribution paid to you generally has 20% withheld for federal income tax. A direct rollover from the old plan to an eligible new plan or IRA generally avoids that mandatory withholding and keeps the money tax-deferred. You still need to confirm that the receiving account is eligible and that the transaction is coded as a rollover.
If the check is made payable to you, you become responsible for completing the rollover under the applicable deadline and replacing any amount withheld. Missing the rules can turn the distribution into taxable income. Ask the plan administrator and the receiving institution for written rollover instructions before requesting a check.
Vesting and plan-specific details
Your own salary-deferral contributions are generally yours, but employer matching or profit-sharing contributions may be subject to a vesting schedule. The account statement and Summary Plan Description show the vested amount and the plan’s distribution choices. A small balance may also be handled under special plan procedures, so read the notice rather than assuming the account will stay open indefinitely.

How are severance, unemployment and retirement withdrawals taxed?
Severance and unemployment
The IRS states: “Severance pay and unemployment compensation are taxable.” Severance is normally treated as wage income and may have payroll withholding. Unemployment compensation is taxable income even when no tax was withheld from the payment.
Set aside money for federal and, where applicable, state tax. Review each pay statement and unemployment notice to see what was withheld, then adjust estimated payments or future withholding if the total income for the year will be unusual.
Paid time off and retirement cash-outs
Accumulated vacation or sick pay is also taxable when paid. A retirement distribution taken as cash can add ordinary income, and a distribution before age 59½ may trigger a 10% additional tax unless an exception applies. A direct rollover generally avoids current income tax because the money remains in a retirement arrangement.

Tax treatment can change with the type of account, your age, the distribution code, state law and other income. A tax professional can calculate the result when the balance or severance is material.
A decision checklist for the next 30 days
- Keep a document folder: termination letter, severance agreement, final-pay statement, benefits notice, COBRA election materials, retirement SPD, account statement and unemployment confirmations.
- Calendar every deadline: severance signature and revocation dates, COBRA election and payment dates, Marketplace or spouse-plan enrollment window, unemployment certifications and rollover steps.
- Separate cash needs from retirement decisions: build a short-term budget before liquidating retirement assets solely to cover ordinary expenses.
- Verify vested retirement value: distinguish your total account balance from the amount you are entitled to keep.
- Use written answers: ask human resources, the plan administrator and the unemployment agency to confirm important interpretations by email or letter.
- Escalate when the stakes justify it: consult an employment attorney about a release or restrictive covenant and a tax professional about a large severance or retirement distribution.
When professional advice is especially important
Get individualized advice before signing if the agreement releases discrimination, wage or other legal claims; changes equity or bonus rights; imposes a noncompete, nonsolicit or confidentiality obligation; or pays a large amount over time. Seek tax advice before cashing out a retirement account, replacing a 20% withholding amount, or making a rollover involving company stock or multiple account types.
For benefits questions, the plan administrator’s written Summary Plan Description and COBRA notice control the plan-specific details. For unemployment, the state agency’s determination controls eligibility and the treatment of severance or other payments.
