What did the judge block, and where?
On October 2, 2026, U.S. District Judge Kathleen Cardone granted a preliminary injunction covering border-barrier construction in the Big Bend Border Patrol Sector within one mile of the Rio Grande and inside state and national parks, according to Marfa Public Radio. The ruling pauses covered work while the case continues; it does not block every border project in Texas or elsewhere.
Marfa Public Radio also reported that federal waivers for the sector are no longer in effect during the construction pause. The precise geographic scope described here is the outlet’s account of the injunction, rather than a quotation from the written order.
Why did the judge issue a preliminary injunction?
Cardone found that the plaintiffs were likely to succeed on at least one claim, likely to suffer serious and irreparable harm without an injunction, and favored by the balance of equities and the public interest. Marfa Public Radio quoted the judge as saying: “The Court finds that Plaintiffs are likely to succeed on the merits of at least one of the claims in suit, that there is a likelihood that they will suffer serious, irreparable harm without an injunction, and that the balance of the equities and the public interest weigh in their favor.”

Those findings explain why construction is paused before a final ruling. They do not establish that the plaintiffs have won the case on its merits or that every allegation has been proved.
What is the lawsuit challenging?
The Center for Biological Diversity, Friends of the Ruidosa Church, and Billy Miller—a river guide and landowner—are challenging five contracted border-wall projects on constitutional grounds, including separation of powers and the alleged deprivation of citizens’ land. The plaintiffs’ case also concerns federal waivers they say bypassed environmental, cultural, and archaeological protections. These are claims in the lawsuit, not final judicial findings.

Challengers and local residents have described possible lasting effects on the Big Bend landscape, river access, private property, livelihoods, historic resources, and protected areas. The administration’s stated position is that physical infrastructure is necessary for border security. U.S. Customs and Border Protection said on October 2, as reported by the Associated Press, “We stand by our assessment and remain confident in our legal authorities to secure the border while preserving the unique landscape of the Big Bend region.”
How large are the projects and the affected sector?
Reported figures refer to different things: the broader federal border effort, contracts for physical infrastructure in Big Bend, and the scale and activity of the local Border Patrol sector. They should not be treated as interchangeable measures.

Marfa Public Radio also reported, citing CBP data, that the sector has historically had the fewest apprehensions and drug seizures. Such context describes reported enforcement activity; it does not determine the legal claims before the court.
How does the injunction affect plans for the national park?
Before the injunction, the Associated Press reported on September 30 that the administration had backed away from plans for a wall through the national park while retaining other infrastructure proposals. CBP was considering adjustments after stakeholder input, but the agency had not specified them in that report. The October 2 injunction subsequently barred covered construction while the suit proceeds.
