Not every J-1 exchange visitor needs a waiver. A waiver matters only when section 212(e) of the Immigration and Nationality Act (INA) makes you subject to the two-year home-country physical presence requirement and you have a qualifying reason to request that requirement be waived. The three common triggers are qualifying government funding, coverage under the applicable Skills List, and U.S. graduate medical education or training. If you cannot determine whether 212(e) applies, request an official advisory opinion from the U.S. Department of State before assuming that a waiver is necessary.

What the J-1 two-year requirement means

Section 212(e) can require a current or former J-1 exchange visitor to spend an aggregate of two years physically present in the country of nationality or last legal permanent residence after completing the exchange program. Until the requirement is satisfied or waived, the person generally cannot obtain an H, L or immigrant visa, or adjust status in the United States to permanent residence. The requirement is a condition attached to certain J-1 programs; J-1 status alone does not automatically trigger it.

The Department of State makes the waiver recommendation through its Waiver Review Division. U.S. Citizenship and Immigration Services (USCIS) makes the final decision on the waiver in the immigration benefits process. A recommendation or a favorable finding on one part of the process does not itself grant a new immigration status.

Who may be subject to section 212(e)?

Check the facts of every J-1 program you held. The Department of State identifies three broad bases that can independently make the requirement apply.

Qualifying government or international-organization funding

The requirement can apply when the exchange program was financed in whole or in part by the U.S. government, your home-country government, or a qualifying international organization. Funding can be direct or routed through a scholarship, fellowship, employer, university or other program sponsor. Keep award letters, sponsor correspondence and financial records because the source and terms of funding may matter when the government reviews your case.

A field on the Skills List

The requirement can apply when your program involved a field of specialized knowledge that your home country designated as necessary and that appeared on the relevant Skills List. The list is tied to the country and the applicable rules at the time of your J-1 admission or status.

The 2024 Skills List changed how many cases are evaluated. The Department of State said the 2024 list took effect immediately for preliminary determinations. Under its current guidance, if you were admitted to the United States in J status or obtained J status before December 9, 2024, and your country is not on the 2024 list, you are not subject on the Skills-List basis. That conclusion does not erase an independent funding trigger or a graduate-medical-education trigger. A country’s absence from the list is therefore not, by itself, a complete answer.

Graduate medical education or training

A foreign medical graduate who received J-1 status for graduate medical education or training in the United States is generally subject to section 212(e). Medical residents and fellows should identify this basis separately from funding or Skills List questions because it can control the available waiver routes.

How to find out whether 212(e) applies

Start with your program records, not with assumptions based on your visa stamp. Review each Form DS-2019 or older IAP-66, your J-1 visa page, sponsor information, funding documentation and the field shown for the program. A visa annotation may be helpful, but it is not a substitute for a complete review when the annotation is missing, incorrect or inconsistent with the program facts.

If the answer remains uncertain, request an advisory opinion from the Department of State. The advisory-opinion survey available online is not itself an official determination. The Department’s advisory-opinion process is the formal route for deciding whether the two-year requirement applies to your record.

What to include with an advisory-opinion request

  • A description of every J-1 program you completed or began.
  • The start and end dates for each program.
  • Funding sources for each program, including government or international-organization support.
  • Every DS-2019 and IAP-66 issued for the programs.
  • A copy of the J-1 visa page.
  • The supplementary applicant-information page requested by the Department of State.
  • Proof of time spent in your home country that may already satisfy all or part of the two-year requirement, if applicable.

The request is submitted by email using the Department’s current instructions. The Department currently estimates 4 to 6 weeks for review of an advisory-opinion request. That estimate applies to the advisory opinion only; it is not a forecast for a waiver case, USCIS action or visa issuance.

The five waiver bases

The Department of State lists five waiver bases. Its FAQ states that an applicant may apply under only one basis, so treat them as alternative legal routes rather than a menu of requests that can be combined. Each route has a different initiating party, evidence package and limitation.

Waiver basis Qualifying circumstance Who sends or makes the key request USCIS threshold finding? Important limits
No Objection Statement Your home government does not object to your remaining in the United States and to possible permanent-residence processing. Designated officials of the home government transmit the statement through the required channel after the waiver case number is issued. No separate Form I-612 finding is required. A foreign physician who obtained J-1 status on or after January 10, 1977 for U.S. graduate medical education or training cannot use this basis.
Interested U.S. Federal Government Agency Your departure would harm a U.S. federal agency’s program or activity or otherwise be detrimental to its interest. The agency head or authorized designee sends a signed request to the Waiver Review Division. No separate Form I-612 finding is required. The applicant cannot substitute a personal letter for the agency’s official request.
Persecution You would face persecution in your home country because of race, religion or political opinion. You file Form I-612 with USCIS; the Department of State reviews the case after USCIS makes the required finding. Yes. USCIS must make a persecution finding. The claim must fit the statutory protected grounds and be supported with evidence.
Exceptional hardship Your return would cause exceptional hardship to a qualifying U.S. citizen or lawful permanent resident spouse or child. You file Form I-612 with USCIS; the Department of State acts only after the USCIS finding. Yes. USCIS must find exceptional hardship. Ordinary family separation is not enough.
Conrad State 30 You are a foreign medical doctor who completed qualifying U.S. graduate medical education or training and will serve a state’s public-health needs. A designated state public health department or equivalent requests the waiver. No Form I-612 threshold finding is described for this basis. If your exchange program had home-country government funding, a No Objection Statement is also required.

How each waiver basis works

No Objection Statement

After you receive a waiver case number, ask the designated authority in your home country for a No Objection Statement. The statement must address two points: that the government does not object to your not returning to satisfy the two-year requirement, and that it does not object to your possibly becoming a U.S. lawful permanent resident. The home government transmits the statement directly through the channel specified by the Department of State; you should not mail an applicant-created substitute.

This route is unavailable to a foreign physician who acquired J-1 status on or after January 10, 1977 for graduate medical education or training. If your home government refuses to issue a statement, the Department’s FAQ indicates that you may pursue another basis only if that basis independently applies. Otherwise, you must satisfy the two-year requirement.

Interested U.S. Federal Government Agency

A federal agency must decide that your departure would be detrimental to its interest. The agency head or authorized designee sends a signed request to the Waiver Review Division explaining the public interest and the specific harm that your departure would cause to the agency’s program or activity. Your personal explanation can support the agency’s review, but it cannot replace the agency’s formal submission.

Persecution

This basis is for a person who believes they would be persecuted in the home country because of race, religion or political opinion. File Form I-612 with USCIS and provide evidence addressing the protected ground, the feared persecution and why return creates the claimed risk. The Department of State will consider a waiver recommendation under this basis only if USCIS makes the required persecution finding.

Exceptional hardship to a spouse or child

The qualifying relative must be a U.S. citizen or lawful permanent resident spouse or child. The analysis concerns exceptional hardship if you return to the home country, not simply the emotional or financial difficulty of living apart. The Department of State’s Waiver Review Division states: “Mere separation from your U.S. citizen (or lawful permanent resident) spouse or child is not sufficient to establish exceptional hardship.”

File Form I-612 with USCIS and document the circumstances that make the hardship exceptional, such as the effects of relocation, serious medical needs, unusual educational or caregiving conditions, security concerns or combined financial and family consequences when supported by evidence. The Department of State proceeds under this basis only after USCIS makes an exceptional-hardship finding.

Conrad State 30

This route is limited to foreign medical doctors who held J-1 status for graduate medical education or training. A designated state public health department or equivalent must request the waiver so the physician can address a qualifying physician shortage and meet the state program’s service conditions. The state agency, rather than the physician alone, initiates the key request.

If the doctor’s exchange program received funding from the home-country government, a No Objection Statement is also required. That additional requirement does not turn Conrad State 30 into a general No Objection case; it is a special condition attached to this physician route.

Step-by-step application sequence

  1. Determine whether 212(e) applies. Review every program, funding source, field and medical-training record. If the answer is unclear, request an advisory opinion before treating a waiver as necessary.
  2. Select one waiver basis. Match your circumstances to the five alternatives and check special restrictions, especially the physician restriction on No Objection Statements and the medical-doctor requirement for Conrad State 30.
  3. Complete the online Form DS-3035. Use the Department of State’s online form and follow its current payment instructions. The Department says an incorrect form version is returned and the processing fee is non-refundable.
  4. Record your waiver case number. You need the number for case tracking and, for a No Objection Statement, to request transmission from the home-country authority.
  5. Build the supporting-document checklist for your basis. Identify which items must come from a home government, U.S. federal agency, USCIS or a state public health department. Confirm the destination and transmission method in the live Department instructions.
  6. Arrange direct third-party submissions. The required agency, government or department must send its material as instructed. Do not assume that uploading your own copy will satisfy a direct-submission requirement.
  7. File Form I-612 when the basis requires it. Persecution and exceptional-hardship applicants must file Form I-612 with USCIS. The Department allows DS-3035 to be completed before or after the USCIS finding, but warns that the DS-3035 fee is not refunded if USCIS does not make the required finding.
  8. Submit your applicant documents exactly as instructed. Keep copies of the DS-3035, payment confirmation, identity documents and every supporting item. Use consistent names, dates and case numbers across all submissions.
  9. Monitor the online case status. Use the Department’s J Visa Waiver Online status function after the application and supporting documents have been submitted. Status updates can take at least 3 to 4 weeks to appear after supporting documents are received. This is an update delay, not an overall processing-time estimate.
  10. Respond to a request or decision. If the Department or USCIS asks for additional evidence, answer through the channel and deadline stated in the notice. A favorable Department recommendation still must move through the remaining USCIS and immigration-status steps relevant to your case.

Documents to organize before filing

A complete record reduces avoidable delays and makes it easier to explain conflicting information. Create a dated file for each J-1 program and retain both the original-language document and a certified translation when required.

  • All DS-2019 and IAP-66 forms, including forms from prior programs.
  • The J-1 visa page and passport identity pages.
  • Program dates, sponsor details and a plain-language description of the field or training.
  • Scholarship, fellowship, salary and grant records identifying every funding source.
  • Evidence of time physically spent in the home country if you have already completed part or all of the requirement.
  • The supporting transmission or receipt information for the selected waiver basis.
  • For Form I-612 cases, evidence tailored to the persecution or exceptional-hardship claim.
  • For Conrad State 30 cases, the state department’s request and records showing the qualifying medical training and service arrangement.

Common mistakes and how to avoid them

Assuming every J-1 visitor needs a waiver

Do not file simply because you held J-1 status. First identify whether funding, the applicable Skills List or graduate medical education or training creates the requirement. A waiver cannot substitute for a requirement that never applied.

Treating the 2024 Skills List as the only test

The December 9, 2024 cutoff and the 2024 list affect the Skills-List analysis for earlier admissions or status, but they do not cancel funding or medical-training triggers. Evaluate all three categories.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Relying on the online survey as a final answer

The Department’s online advisory survey is not an official determination. When records conflict or the answer is uncertain, submit the complete advisory-opinion request with program, funding and immigration documents.

Sending a third party’s document yourself

A No Objection Statement, federal-agency request or state public-health request generally must come from the designated issuing authority. The Waiver Review Division warns that it will not follow up on missing third-party documents. Ask the sender when and how it transmitted the document, then retain proof.

Paying before checking the basis and form

Use the current online DS-3035. An incorrect version is returned, and the fee is non-refundable. In persecution and exceptional-hardship cases, the Department also warns that the fee is not refunded if USCIS does not make the required finding.

Confusing a status-update delay with processing time

Three to four weeks is the Department’s warning about when an online status update may appear after supporting documents arrive. It is not a promise that the waiver will be decided in that period. The advisory-opinion estimate of four to six weeks likewise applies only to that opinion request.

Choosing what to investigate first

Use these questions to narrow the correct route without guessing at approval odds:

  • What makes me subject? Identify government funding, Skills List coverage and medical education or training, including more than one trigger if present.
  • Who must initiate the request? Is it your home government, a U.S. federal agency, USCIS, or a designated state public-health department?
  • Is a USCIS finding required first? Persecution and exceptional hardship require Form I-612 and a favorable threshold finding.
  • Does a special limitation apply? Check the post-January 10, 1977 physician restriction for No Objection Statements and the foreign-doctor and state-request requirements for Conrad State 30.
  • Can I document the trigger and the remedy? Gather program records, funding proof, status documents and the direct-submission evidence required by the chosen basis.

There is no current, broadly applicable success-rate statistic that can predict an individual applicant’s result. Eligibility facts, evidence, the initiating agency and the legal basis control the analysis; historical recommendation tables do not establish current personal odds.

When professional advice is sensible

Consider individualized immigration advice when you have multiple J-1 programs, unclear or changing funding, inconsistent visa annotations, prior time in the home country, a medical-training history, a persecution or hardship claim, or a request from an agency that has not confirmed its role. A professional can help organize evidence and identify the correct route, but no private service can guarantee a waiver. Always verify the current Department of State and USCIS instructions, fees, mailing or email channels, Skills List coverage and case procedures immediately before filing.
