Short answer: UK law does not make “emulation” one single lawful or unlawful act. Writing or distributing emulator software, copying or downloading a game ROM, copying BIOS or firmware, and bypassing a technological protection measure (TPM) raise different questions under the Copyright, Designs and Patents Act 1988 (CDPA). An independently written emulator may be treated differently from an unauthorized ROM, and owning an original cartridge or disc does not automatically give you permission to download a matching file. The result depends on what was copied, how it was obtained or shared, and whether protection technology was bypassed.
What UK law actually asks
The CDPA protects computer programs and other creative elements of video games. Copyright owners control important acts including copying, distributing copies, adapting protected material and communicating it to the public or otherwise making it available online. Those rights can apply to game code, artwork, music, text, firmware and other components, not just to the physical cartridge or disc.

“Emulation” describes a technical method: software on one device imitates the behaviour of another platform so that software made for the original platform can run. The technical description does not answer the legal question. Three separate acts must be examined:

- Emulator software: how it was written, whether it contains copied code or other protected material, and whether its development involved restricted reverse engineering or decompilation.
- Game files: whether a ROM, disc image, download, BIOS or firmware file reproduces protected material and how that file was acquired, stored or shared.
- TPM circumvention: whether a device, service or process bypassed an effective technological protection measure and what the person supplied or did.
There is no definitive UK ruling identified that declares every emulator legal or every emulator illegal. Government guidance and the statute provide the framework, but a particular program, game, licence and method can change the analysis.

Emulator software is not the same thing as a ROM
An independently written emulator
An emulator can be an original program that reproduces hardware behaviour without containing the original console’s game code. In that situation, the central copyright question is about the emulator’s own code and any material bundled with it. If developers copied protected source code, included proprietary firmware, or distributed copyrighted keys or assets, ordinary infringement rules can become relevant.
Reverse engineering and interoperability add uncertainty. A specialist WIPO study describes emulator development and possible decompilation separately from copying ROMs. It notes that the particular reverse-engineering issue discussed had not been tested in court and that potential contributory liability for emulator providers had likewise not been litigated in that analysis. That is useful technical background, not a UK judgment.
What an emulator distribution may contain
Two downloads can carry very different legal characteristics even if both are labelled “emulators.” One may contain only newly written executable code and documentation. Another may bundle BIOS files, encryption keys, console firmware or copyrighted interface assets. Check the contents and licence rather than assuming that the word “emulator” makes the package safe.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsDistribution also matters. Giving the software to another person, hosting it publicly or making it available online can engage rights that are not engaged by merely writing code for yourself. Commercial conduct can create additional exposure, but non-commercial use is not an automatic exemption.
ROMs, disc images and downloaded game files
Why creating a ROM is legally different
A ROM or disc image normally contains a reproduction of game data. The WIPO study characterises creating a ROM as wholesale duplication of a game and explains why reproduction rights are relevant. Under the CDPA, copying a protected game can require the copyright owner’s permission unless a specific statutory rule applies.
Uploading a ROM introduces further acts. Making the file available through a website, file-sharing service or direct transfer can raise distribution and communication-to-the-public issues in addition to the initial copy. A person who did not make the original dump can still face questions about possession, downloading, uploading or facilitating access.

Does owning the cartridge or disc let you download a ROM?
Not automatically. Ownership of a physical copy proves that you bought that copy; it does not by itself prove permission to obtain an identical file from an unrelated source. A download from an unauthorized archive is still a copy supplied by that archive, and the source may have no authority to distribute it.

The same distinction applies when a file is described as a “backup.” The CDPA contains conditional rules for lawful users of computer programs, including copying or adapting a program where necessary for lawful use, subject to statutory conditions. It also contains specified backup-copying and decompilation provisions. Those rules concern computer programs and their stated conditions; they are not a universal personal ROM-ripping licence for every console game.
The statutory page also distinguishes the personal-copy exception for works other than computer programs. A 2014 private-copying provision was quashed in 2015. That history is why a general statement such as “UK law allows one personal backup of anything you own” is unreliable.
BIOS and firmware files
BIOS and firmware are often required by an emulator but can be separate copyrighted computer programs. Copying, extracting or distributing them raises the same program-copying questions as other software. A BIOS obtained from the console you own is not automatically authorised for public sharing, and downloading one from an unlicensed repository does not become lawful merely because you possess the hardware.
What the CDPA’s computer-program rules do—and do not—do
The CDPA’s lawful-user provisions are conditional. In broad terms, a lawful user may copy or adapt a computer program when that act is necessary for the user’s lawful use and the statutory requirements are met. Separate provisions address backup copies and decompilation in specified circumstances, including conditions concerning lawful possession and the purpose of the act.
Recommended Free Tools
- The provisions do not convert an unauthorized download into an authorized copy.
- They do not grant a general right to obtain a ROM from someone else.
- They do not automatically cover artwork, music, film sequences or other non-program elements of a game.
- They do not remove restrictions created by a licence, contract or technological protection measure.
For any proposed copy, identify the exact work and the exact statutory condition rather than relying on a “backup” label. The consolidated legislation pages identified for this subject carry a version dated 1 April 2023; legislation can change, so the live CDPA text should be checked before relying on a precise section or exception.

TPMs and circumvention
A technological protection measure can control access to or copying of a game. The Intellectual Property Office (IPO) guidance, last updated 4 January 2021, states: “EU and UK law protects the right of copyright owners to use TPMs (Technological protection measures) to protect their works, and circumvention of such technology is illegal.” The statement is official guidance, and its application still depends on the facts and the relevant statutory provisions.
Circumvention is a separate issue from writing emulator code. An emulator that does not bypass a TPM is not the same as a tool designed to defeat one. Conversely, a lawful purpose claimed by the user does not automatically make a circumvention method lawful.
IPO offence guidance summarises CDPA provisions covering specified commercial conduct involving infringing copies and devices or services primarily designed to enable or facilitate circumvention of effective TPMs. The offence rules depend on the conduct and statutory conditions. They should not be reduced to “owning any modchip is a crime.” Supplying, advertising, importing or operating a circumvention device can raise different questions from possessing a general-purpose computer.
Fair dealing is narrow and fact-specific
UK copyright exceptions are limited. IPO guidance says: “There is no statutory definition of fair dealing – it will always be a matter of fact, degree and impression in each case.” The guidance identifies factors such as the effect on the market and whether the amount taken was reasonable and appropriate.
That does not create a broad fair-use defence for running games in an emulator. A non-commercial project, a preservation goal or a small user community may be relevant facts, but none automatically authorises copying or distribution. Do not import conclusions from US fair-use cases into UK law; the UK framework and statutory wording differ.
How to assess a proposed emulation activity
| Activity | What is being copied or done | Key UK question |
|---|---|---|
| Writing an emulator from scratch | New emulator code that imitates another platform | Does the code or any bundled material reproduce protected code, firmware, keys or assets, and did development involve a permitted reverse-engineering act? |
| Installing an emulator with no game files | Use of the emulator program | What does the licence permit, and does the package contain third-party protected material? |
| Dumping your own cartridge or disc | A reproduction of game data | Does a specific CDPA computer-program rule apply to this copy, and are non-program elements also reproduced? |
| Downloading a ROM from an archive | A copy supplied by another person or service | Did the supplier have permission, and is your copy authorised under a specific exception? |
| Uploading or sharing a ROM | Distribution and possible online communication | Have you engaged the owner’s distribution or making-available rights? |
| Extracting or sharing BIOS firmware | Copying a separate computer program | Is the extraction or sharing necessary and permitted for a lawful user, or is it an unauthorised distribution? |
| Using a tool to defeat a TPM | Bypassing access or copy controls | Was an effective TPM circumvented, and does the conduct fall within the statutory device or service offences? |
Common scenarios and the safer interpretation
“I own the original game, so any download is fine.”
That conclusion is too broad. Physical ownership and permission to download are separate. Obtain files only from a source authorised by the rights holder or rely on a clearly applicable statutory rule after checking its conditions.

“The emulator is free and open source, so it cannot infringe.”
Price and source-availability do not decide copyright. Open-source licensing may explain permissions for the emulator’s own code, but it does not license a bundled BIOS, game ROM, key or copied proprietary component.

Non-commercial use can affect facts such as market impact, but copyright rights are not limited to sales. Downloading, uploading and making a work available can matter without a payment.
“It is for preservation.”
Preservation is an important policy objective, but the purpose alone does not create a blanket exception. Institutions and individuals must identify the specific exception, licence or permission that covers the copying and access method they plan to use.
“The emulator needs a BIOS, so sharing mine with friends is harmless.”
A BIOS may be protected software. Sharing it can be a separate distribution from sharing the emulator and may not be covered by the rule that allowed you to use your own copy.
Practical steps before you emulate
- Inventory the files. List the emulator executable, plug-ins, BIOS or firmware, game images, keys and any patches. Treat each item as a potentially separate work.
- Check provenance. Record where each file came from and whether the provider had permission to distribute it. A mirror or forum repost is not evidence of authorisation.
- Read the licences. Separate the emulator’s licence from the game publisher’s licence and from any console-firmware terms.
- Identify the copying act. Ask whether you are downloading, dumping, adapting, uploading or merely running a file already lawfully supplied to you.
- Check for TPM circumvention. Determine whether the method defeats an access or copy control and whether a device or service is being supplied for that purpose.
- Keep distribution private only where authorised. Do not upload ROMs, BIOS files or keys to a public host unless the rights holder’s permission clearly covers that act.
- Escalate unusual cases. Commercial distribution, a preservation project, a reverse-engineering effort or a proposed circumvention device warrants advice from a UK intellectual-property solicitor before launch.
What is established, and what remains unsettled
It is established that software can receive automatic copyright protection, that owners control copying and distribution, that the CDPA contains conditional computer-program rules, and that IPO guidance treats TPM circumvention as illegal. It is not established by the sources considered here that every emulator infringes, that every emulator is lawful, or that a particular reverse-engineering technique will succeed as a defence in a UK court.
The WIPO analysis and a 2018 scholarly discussion of preservation and emulation provide useful context. The latter describes the CJEU’s Nintendo Co Ltd v PC Box Srl judgment as treating video games as complex works containing program, graphic and sound elements, and discusses TPM protection in the EU framework. That background does not replace UK statutory text or decide the legality of a specific British emulator or ROM.
Because the cited exceptions guidance dates from 4 January 2021 and the consolidated statute reference is dated 1 April 2023, check current legislation and any later UK cases before acting on a borderline question. The legal answer can change with the edition of a game, the licence, the source of a file and the precise technical method used.
Bottom line
In the UK, “emulation” is a technical category, not a legal permission. An emulator may be independently created, while a ROM or BIOS may be an unauthorised reproduction; bypassing a TPM adds another layer of risk. Separate the code, the game data and the protection measure, then identify the permission or narrowly worded CDPA exception that covers each act. If you cannot identify an authorised source or a specific statutory condition, do not assume that ownership, preservation, free distribution or non-commercial use makes the activity lawful.
