In the United States, torrenting itself is not illegal; sharing or downloading copyrighted material without authorization may infringe copyright. The BitTorrent protocol transfers pieces of files between users and can involve uploading as well as downloading. Whether a particular use is lawful depends on the content, permission to copy or distribute it, and the law that applies. Separately, there is no reliable promise that you can torrent “without your ISP knowing.”
What makes torrenting legal or illegal?
“Torrenting” describes a way to transfer files between connected users. It does not, by itself, determine whether a transfer is lawful. The key question is whether you have authorization to copy or distribute the material, or another applicable legal basis for doing so. Copyright owners control certain uses of protected works, and unauthorized copying or distribution may infringe those rights, according to the U.S. Copyright Office.

BitTorrent is not limited to receiving a file. The U.S. Department of Justice describes users downloading and uploading pieces of a work to and from other users simultaneously. - A transfer of copyrighted material without authorization may infringe copyright, even if no money changes hands.
- The protocol alone does not establish permission, infringement, or criminal conduct.
Is copyright infringement always a crime?
No. Civil copyright infringement and criminal copyright infringement are distinct. Under 17 U.S.C. § 506, criminal infringement requires willfulness plus at least one specified statutory condition. These include infringement for commercial advantage or private financial gain; certain reproduction or distribution thresholds within a 180-day period; or distribution of a work prepared for commercial release when the person knew or should have known of that status.

One statutory threshold includes works with a total retail value of more than $1,000 distributed during any 180-day period. These are provisions about criminal liability, not a complete description of civil copyright claims, and they do not mean every unauthorized torrent is a crime.
Can your ISP know you are torrenting?
The available evidence does not support a universal answer about what every ISP monitors or retains. A U.S. federal court filing in Case 2:25-cv-12311 describes allegations that a plaintiff’s system connected to an IP address participating in BitTorrent activity and that the plaintiff sought ISP records to identify the account holder.

That filing illustrates how an IP address and a legal request for ISP records may figure in a particular copyright case. It is an account of allegations, not proof that every allegation is correct, that an IP address always identifies the person who used a connection, or that ISPs inspect every torrent. It also does not establish a detection rate.
Does a VPN make torrenting legal or guarantee privacy?
No. A privacy tool does not give you permission to copy or distribute copyrighted works. The sources here do not establish how effective any VPN is, what it logs, or how it handles requests for information. They therefore cannot support claims that a VPN guarantees anonymity or that your ISP can never know about torrent activity.

What about copyright notices?
The Copyright Office describes the DMCA notice-and-takedown framework, under which a notice is a claim submitted to an online service provider. Receiving a notice is not, by itself, a court judgment that the recipient infringed. How to respond depends on the notice and circumstances; do not treat the notice alone as a judicial finding.
