Seeding is not automatically unlawful: the work’s status, your permission or other legal basis for sharing it, and the law where you are matter. A torrent client’s automatic uploading does not by itself make unauthorized sharing lawful.
What seeding does in a BitTorrent client
BitTorrent users exchange pieces of a file with one another rather than receiving the entire file from a single server. A client can upload pieces while downloading; continuing to share after the download is complete is commonly called seeding. UK government guidance notes that peer-to-peer software usually shares portions during downloading and that default settings often offer files to other users (GOV.UK guidance).

That technical behavior matters, but it does not settle whether sharing is lawful or who is responsible. In Case C-597/19, the Court of Justice of the European Union (CJEU) considered uploading pieces of a protected media file through BitTorrent. It held that making pieces available could count as making the work available to the public even where the pieces became usable only after a certain download rate. The court also said automatic uploading did not change its conclusion where a user had consented to the software after being duly informed about its characteristics (CJEU, Case C-597/19). This is an interpretation of EU law in a particular case, not a universal ruling for every country or set of facts.

When sharing a torrent is authorized
The key starting question is whether the file is protected and whether you have permission or another legal basis to share it. A work that is in the public domain, or one whose rights holder has authorized the relevant sharing, is materially different from an unauthorized copy. The U.S. Copyright Office says whether sharing a particular work is authorized is a question of fact, and advises assuming most original works fixed in a tangible medium—including computer files—are protected unless there is clear information otherwise (U.S. Copyright Office, Copyright and Digital Files FAQ).

Do not infer permission merely because a file is easy to find on a peer-to-peer network, or because a client began uploading automatically. The legal status of the specific work and the rights attached to it still matter.
What U.S. law says about unauthorized seeding
The U.S. Copyright Office states that uploading or downloading a copyrighted work without the owner’s authority can infringe the owner’s exclusive reproduction and/or distribution rights (U.S. Copyright Office FAQ). Whether a particular file is authorized for sharing is a factual question; the general explanation does not determine the status of an individual torrent.

Civil damages are not automatic maximum bills
According to the U.S. Copyright Office FAQ, reviewed October 7, 2026, statutory damages may be up to $30,000 for each work infringed, or up to $150,000 for each work if willful infringement is proven. These are U.S. figures and potential statutory limits, not an automatic amount owed by everyone accused of seeding. A rights holder does not automatically collect the maximum; liability, proof, and the appropriate remedy are separate questions.

A September 2026 article in the U.S. Department of Justice’s Journal of Federal Law and Practice describes a felony provision involving at least 10 copies and total retail value over $2,500 during a 180-day period, for purposes of commercial advantage or private financial gain (U.S. Department of Justice, September 2026). The article explains that private financial gain can include trading something of value, not just receiving cash, and gives seeding infringing material in return for the ability to download other infringing material as an example.

That description does not mean every instance of reciprocal sharing satisfies the statutory elements or leads to prosecution. Civil infringement and criminal offenses involve different standards and elements. Questions about what happened, who operated the connection, applicable exceptions, and potential remedies cannot be answered by a threshold figure alone.
What a UK copyright allegation letter means
GOV.UK guidance says a rights holder may send a letter if it believes someone using an internet connection shared protected material. An internet service provider may identify the account holder, but that does not necessarily establish that the account holder personally infringed. The rights holder remains responsible for proving who committed the infringement. If granted, a Norwich Pharmacal Order can require an ISP to disclose the name and address associated with an IP address (GOV.UK: Letters alleging online copyright infringement).

If you receive a letter in the UK, the guidance recommends checking that it is genuine, considering who else had access to the connection, responding, and seeking legal advice if you are unsure. It also warns that compensation letters can be scams. These steps do not guarantee that a claim will end; they are practical guidance for handling an allegation.
How to assess a specific situation
There is no single worldwide answer to whether seeding is illegal. The relevant questions are:

- What is the work’s status? Is it protected, public domain, or otherwise available for sharing?
- What authorization applies? Did the rights holder permit this kind of copying or distribution, or is another legal basis relevant?
- What did the client do? Did it upload pieces while downloading, or continue seeding afterward? Automatic behavior can be relevant, but does not itself establish authorization.
- Which jurisdiction governs? Civil remedies, criminal rules, and procedures differ by country; the U.S., EU, and UK points above are not interchangeable.
- What does the evidence identify? An IP address or subscription may point to a connection or account, but that is not necessarily proof of which person used it.
For media you want to access, the U.S. Copyright Office points readers to authorized services that sell protected music, ebooks, and motion pictures. For a particular file, notice, or possible defense, the applicable country and case facts are essential; this general explanation is not individualized legal advice.
