Is TikTok about to get banned in the US? The Supreme Court upheld the federal law on January 17, 2025, so the Court is no longer considering the case. TikTok announced on January 23, 2026, that a U.S. joint venture had been established under a later executive order; the announcement describes safeguards and ownership arrangements, but the reviewed sources do not independently verify them or establish the current enforcement position.

What did the Supreme Court decide?

In TikTok Inc. v. Garland, No. 24-656, the Supreme Court heard arguments on January 10, 2025, and issued its decision on January 17. It upheld the Protecting Americans from Foreign Adversary Controlled Applications Act against TikTok’s First Amendment challenge.

The Court said the law addressed national-security concerns about data collection and TikTok’s relationship with a foreign adversary. That holding does not mean every factual allegation about TikTok was independently proven by the Court.

The Court wrote: “There is no doubt that, for more than 170 million Americans, TikTok offers a distinctive and expansive outlet for expression, means of engagement, and source of community.” The figure and quotation are from the Supreme Court’s January 17, 2025 opinion.

How does the law work?

The law covers applications operated by TikTok and subsidiaries of its China-based parent, ByteDance. It prohibits app stores and marketplaces from distributing, maintaining, or updating covered applications, and prohibits internet hosting that enables those activities. The statute provides a route through a “qualified divestiture” as defined by the law.

The legal mechanism and TikTok’s later arrangement are different kinds of evidence: the former is a statute upheld by the Court, while the latter is a company announcement. The Court wrote that “Congress has determined that divestiture is necessary to address its well-supported national security concerns regarding TikTok’s data collection practices and relationship with a foreign adversary.”

What did TikTok announce in 2026?

On January 23, 2026, TikTok said TikTok USDS Joint Venture LLC had been established in compliance with President Trump’s September 25, 2025 executive order. TikTok describes the venture as majority-American-owned and says it is responsible for U.S. user data, the U.S. app and algorithm, cybersecurity, software assurance, and U.S. trust-and-safety policies.

Announcement detail What TikTok says
Managing investors Silver Lake, Oracle, and MGX each hold 15%.
ByteDance stake ByteDance retains 19.9%.
U.S. data and technology Oracle’s U.S. cloud environment will host U.S. user data and the algorithm; the venture will retrain, test, and update the recommendation algorithm on U.S. user data.
Platform continuity TikTok says the venture is designed to preserve interoperability with the global TikTok experience, while global U.S. entities manage certain commercial activities.

These are claims in TikTok’s announcement, not independently verified technical outcomes. TikTok also said more than 200 million Americans and 7.5 million businesses could continue using the service; those figures are company-provided.

Does that mean TikTok cannot be banned?

The Supreme Court decision resolved TikTok’s challenge to the law; it did not decide the legal effect of the later joint-venture announcement. The reviewed sources do not establish whether subsequent court or executive action changed enforcement after January 2026, and they do not independently certify the venture’s safeguards. Avoid treating TikTok’s announcement alone as proof of the present enforcement position.
