Not definitively. The Banjo-Tooie: Recompiled project says its code does not include the game’s assets and requires users to provide a USA ROM, but that does not establish that every copy—or a third-party repack—is safe or legal. Nintendo says downloading unauthorized copies of its games is illegal. The project’s reported gameplay checks are not an independent security audit, and the repository page reviewed has no listed release entries.
What the Banjo-Tooie project distributes
Banjo-Tooie: Recompiled describes itself as a native PC port made by statically recompiling the original Nintendo 64 ROM with N64Recomp and rendering through RT64. Its README says the repository contains code, not game content: it “does not contain game assets, and never will.” It also says users must supply a copy of the USA game ROM at runtime and that the project neither downloads nor bundles that ROM.

Those are the project’s statements about its own repository. They do not verify what is inside a file hosted by someone else, or prove that a downloaded executable corresponds to the documented source. The distinction matters: project code, the commercial game ROM, and a particular executable are separate things to assess.
Is downloading it legal?
There is no universal legal answer established by the available sources. The key questions are whether copyrighted game assets are included, whether the ROM you use is authorized under the applicable law and circumstances, and whether the specific executable is an authentic project build.

Nintendo of America’s Intellectual Property & Piracy FAQ says game downloads offered through peer-to-peer networks or third-party-hosted file links are unauthorized copies. Nintendo states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” That is Nintendo’s stated position on unauthorized game copies; it should not be stretched into a ruling on every independently made port or every person’s circumstances.
Nintendo of Europe’s emulator guidance warns that unauthorized emulators can encourage use of pirate copies and that some circumvent game security measures. The Banjo-Tooie project describes its method as static recompilation and says an emulator is not used at runtime. Nintendo’s general emulator page does not specifically classify or adjudicate this project.

The project says its code is licensed under GPL-3.0, lists licenses for several dependencies, and flags a font with an “All rights reserved” notice that it says should be replaced before redistributing the project. These README notes describe the project’s licensing information; they are not a court determination that every part of the port or every use is lawful.

Is the download safe?
Safety depends on the exact file and where it came from. The project reports Windows x64 checks for booting, gameplay, repeated scene transitions, audio, controller input, overlay loading, and saving and loading. It describes its Linux x64 build as newer and less exercised, and says it has not been played through. Those are developer-reported functionality checks—not malware analysis, independent code review, or a guarantee about an executable from a mirror.

The repository page reviewed lists no entries under Releases. That does not establish that there is no official way to build or obtain the project, but it does mean the reviewed information does not verify a prebuilt release binary there. A file on an unrelated download site should not be treated as an official release simply because it uses the project’s name or logo.
- Start with the maintainers’ current repository and check that the project identity and download source match.
- Be wary of a copy that bundles a commercial game ROM or claims to provide Banjo-Tooie itself for free. The project says its repository does not include the game assets; that statement does not vouch for a repack elsewhere.
- Do not treat GitHub hosting, source availability, or reported gameplay testing as proof that a binary is malware-free. The reviewed material provides no independent malware audit, reproducible-build verification, or hash comparison for a named release binary.
- Do not download a ROM from a third-party site. Nintendo says such third-party-hosted game files are unauthorized copies and describes downloading pirate copies as illegal.
What the recent reporting adds
In an October 2, 2026 GamesRadar+ report, the creator said AI tools generated substantial portions of the project’s code and assisted with engineering and review. The report also quotes Dario, a developer associated with the original N64: Recompiled project, saying: “The Banjo-Tooie Recompilation is NOT associated with us.” This is relevant to project provenance and community context; it does not show that the code contains malware or determine its legal status.

How to make a cautious decision
Consider the three questions separately: what the project source says it contains, whether your ROM use is authorized where you live, and whether the exact executable is authentic and unmodified. The project’s README addresses the first, Nintendo’s guidance addresses unauthorized game-file downloads, and the project reports functionality checks. None of those sources certifies a particular binary or settles every jurisdiction’s law.
