Utah law defines gambling broadly enough to raise a serious question about online games involving chance and something of value, while Stake’s terms defer to applicable local law. The primary sources reviewed do not establish a Utah court ruling that decides how the current Stake.us model applies.
Does Stake.us list Utah as a restricted state?
Stake.us’s Help Center article, “Restricted states on the platform,” dated July 10, 2026, names Arizona, California, Connecticut, Delaware, Idaho, Illinois, Indiana, Kentucky, Louisiana, Michigan, Maine, Maryland, Montana, Nevada, New York, New Jersey, Pennsylvania, Rhode Island, Tennessee, Vermont, Washington, and West Virginia. Utah does not appear in that named list (Stake.us Help Center).

That omission is not a legal determination that Utah residents may play. Section 2.1 of Stake’s Terms & Conditions also covers any other state or jurisdiction where applicable law legally precludes playing, and jurisdictions Stake excludes at its discretion. The terms say customers must not reside in or access the platform from an excluded territory, and place responsibility on customers to determine whether sweepstakes play is legal where they live.
Why Utah law raises a concern
Utah Code § 76-9-1401 defines gambling in terms of risking something of value for a return, or risking something of value on a chance-based contest, game, scheme, or device with an understanding that someone will receive something of value for a certain outcome. It also defines online gambling to include gambling, fringe gambling, or gaming conducted through the internet or a mobile device. The code’s definition of fringe gambling addresses forms of de facto gambling, lotteries, or specified gaming devices offered for value or incident to another purchase, subject to stated exceptions. See the Utah Code, Title 76, Chapter 9, Part 14.

The law also addresses online gambling promotion. Utah Code § 76-9-1404 states: “An actor commits online gambling promotion if the actor intentionally provides or offers to provide a form of online gambling to an individual in this state.” This statutory language is relevant to the legal framework, but it is not a court’s finding about Stake.us or a conclusion about every player or product feature.
How Stake.us describes its two play modes
Stake’s terms distinguish between two currencies and modes. These are the operator’s descriptions, not an independent ruling on whether Utah law permits participation.
Rank #2
| Mode | Stake’s description | What the description establishes |
|---|---|---|
| Standard Play | Uses Gold Coins, described as virtual social gameplay currency with no monetary value that cannot be redeemed for prizes. | Stake says Gold Coins are not redeemable; that description alone does not resolve how any particular play is classified under Utah law. |
| Promotional Play / Sweepstakes | Uses Stake Cash, described as sweepstakes entries. Games played with Stake Cash provide an opportunity to redeem prizes. | Stake says this mode can provide an opportunity to redeem prizes; Utah law’s application to the model remains unsettled in the sources reviewed. |
Stake’s terms also say no purchase or payment is necessary to participate and that purchasing does not increase a customer’s chances of winning. These operator statements do not settle the legal analysis under Utah law.
What Stake’s access rules require
Stake says customers must be over 21 or meet any higher minimum legal age of majority in their jurisdiction. Its terms prohibit use of a VPN, proxy, or similar service to mask or manipulate a real location, and prohibit participation from an excluded territory. Do not use a location-masking service or another person’s account to try to get around a restriction.
Stake’s terms say: “It is the sole responsibility of a Customer to determine whether the Sweepstakes is legal and compliant with all regulations in the jurisdiction in which the Customer resides.” That clause explains the operator’s position; it does not replace Utah law or give a definitive answer about legality.

The Utah statutes establish a meaningful legal concern for chance-based online play involving value and a possible return. Stake’s published named-state list omits Utah, but its broader terms condition participation on applicable law. The primary sources reviewed do not establish a Utah court decision specifically classifying Stake.us’s current model. A definitive answer for a particular person or feature may require legal advice from a Utah attorney.
