Sometimes—but there is no single U.S.-wide rule. Whether a poker night, social casino app or sweepstakes game is legal depends on the state and locality, the kind of game, where it is played, whether an operator profits, and how payments and prizes work. A game being called “social” or “sweepstakes” does not settle the question.
What details can change the legal answer?
“Social gambling” is not one uniform legal category across the United States. These are useful screening questions, not a complete legal test for every jurisdiction:

| What to check | Why it matters |
|---|---|
| Where play happens | State and local law can differ. The relevant location is generally where the activity takes place, not simply where an online operator is based. |
| Private game or public/commercial venue | Some laws distinguish a private home game from play in a public venue, and may set different conditions for each. |
| Who receives money | A game among players may be treated differently from one in which a host, house or operator takes income, sets house odds or banks the game. |
| What players can win | No prize, a prize of minimal value, cash and cash-equivalent or material prizes can raise different legal questions. |
| How virtual currency works | Check whether play is free, whether currency can be bought, and whether currency or prizes can be exchanged for cash or cash equivalents. |
| Game and venue category | A law may name specific games or authorize particular venues; a label such as “social casino” does not determine which rules apply. |
What does federal law say about a small game?
Federal law does not create a blanket permission for small or informal gambling. Under 18 U.S.C. § 1955, an “illegal gambling business” must, among other things, violate the law of the state or political subdivision where it is conducted. The statute also sets federal-offense requirements involving five or more people who conduct, finance, manage, supervise, direct or own the business, plus either substantially continuous operation for more than 30 days or gross revenue of $2,000 in a single day.
Those are elements of that federal prohibition—not a general legality test. Falling below a federal threshold does not make a game lawful under state or local law.

How do state rules differ?
Oregon: a defined social game in a private home
Oregon Revised Statutes, Chapter 167, defines a social game as a non-lottery game between players in a private home where there is no house player, house bank, house odds or house income. The statute also addresses games in specified other venues when authorized under Oregon law. The private-home definition is an Oregon rule, not a nationwide safe harbor; the surrounding statutory provisions matter for other venues.
Montana: limited public card-game exception
The Montana Department of Justice says that bridge, cribbage, hearts, pinochle, pitch, rummy, solo and whist, played in a public setting solely for prizes of minimal value, qualify as social card games outside gambling regulation under the conditions in its Gambling Control Division FAQ. The FAQ specifically says poker and panguingue are not social card games. It also states that no other form of internet gambling is legal in Montana. Do not extend this narrow rule to other games, prizes or states.

Louisiana: Attorney General warns about online casino-style games
The Louisiana Attorney General warns that online casino games for real money remain illegal in the state and that some sites marketed as “social casinos” or “sweepstakes” may offer real-money payouts, dual-currency systems or material prizes. Attorney General Liz Murrill stated: “I want to make it unequivocally clear that online casino, bingo, keno, iGaming, and alleged sweepstakes or social gaming sites offering such games are operating illegally in Louisiana.” This is the Louisiana Attorney General’s position for Louisiana, not a nationwide ruling. New Jersey: dated context, not a substitute for current law
A 2025 New Jersey Governor’s Task Force on Responsible Gaming report describes regulatory attention to sweepstakes casinos and their use of free or purchased virtual currency with potential cash or prizes. It provides context about the model, but it is not a substitute for checking current New Jersey statutes and regulator guidance.

How to check a particular game before playing
- Identify the location. Start with the state and locality where you will play. Do not assume the operator’s address or a product’s nationwide availability determines the rules.
- Work out who runs the game. Is it a private game among players, or does a host, house or company bank it, set odds or receive income? Note whether play is at home or in a public or commercial venue.
- Trace the money and prizes. Read the terms for entry fees, purchases of virtual currency, cash-outs, gift cards, other material prizes and any route to exchange currency or prizes for cash or cash equivalents.
- Check the actual game and current local rules. Look for statutes or regulator guidance covering that game type, venue and prize model. Use the official state gaming regulator and current statute, rather than relying on marketing terms or an old summary.
- Ask a local lawyer if the arrangement is unclear. A lawyer licensed in the relevant jurisdiction can assess the specific facts; a general explainer cannot determine whether an individual game is lawful.
