Emulator software, copying game or firmware code, bypassing security, and using PS5 system software are separate issues. A 2000 court ruling about an original PlayStation emulator does not decide the legality of PS5 emulation, and owning a game does not by itself establish a right to download or make another copy of it.
This guide explains the U.S. law and Sony agreement cited below. The law and agreement discussed here are U.S.-specific; other countries may take a different approach.

Is a PS5 emulator itself illegal?
Writing or using independently created emulator code is not the same act as copying a game, copying Sony firmware, or bypassing a security measure. Those acts can raise different legal questions. The authorities discussed here do not establish a blanket rule that every emulator is legal, nor do they establish that every emulator is illegal.

The closest court precedent in the cited material is the Ninth Circuit’s 2000 decision in Sony Computer Entertainment, Inc. v. Connectix Corp. Connectix reverse engineered the BIOS for the original PlayStation while developing its Virtual Game Station emulator. The court concluded that intermediate copying needed to access functional elements was necessary in the circumstances and assessed that copying as fair use. It wrote: “We conclude that intermediate copying in this manner was ‘necessary’ within the meaning of Sega.” Read the Ninth Circuit opinion.

That fact-specific decision is evidence that necessary intermediate copying during emulator development is not automatically infringement. It is not a ruling about PS5 hardware or software, current PS5 security, a particular emulator’s distribution, or how users obtain game files.
Is downloading PS5 ROMs legal if I own the game?
The cited U.S. sources do not establish a general “own the disc, download the ROM” rule. Buying a game is relevant context, but ownership alone does not establish permission to reproduce or download a separate copy. Whether a particular copy is lawful depends on the applicable facts and law; bypassing an access control can raise a separate issue from copyright copying.
Under 17 U.S.C. § 1201 in the 2024 U.S. Code, circumventing a technological measure that effectively controls access to a copyrighted work is generally prohibited, subject to specified exceptions. The statute includes a limited interoperability provision: a person who lawfully obtained the right to use a computer program may, under stated conditions, circumvent a measure to identify and analyze elements needed for interoperability with an independently created program when those elements are not readily available and the acts do not infringe copyright. The provision also limits related tools and disclosure. It is not a general permission for consumers to defeat console security or obtain game copies.

Having the disc does not by itself answer whether you may extract, copy, or download the game data, or whether any steps used to make it work would circumvent a technical measure. The cited authorities do not establish a blanket right to use a PS5 disc to create an emulator-ready copy. The legality turns on the specific acts involved, including how the copy is made and whether access controls are bypassed.
Does Sony allow PS5 firmware to be used in an emulator?
Sony’s U.S. PS5 System Software License Agreement grants a non-exclusive, non-commercial right to use system software solely on a PS5 system. The search result for the agreement identified version 1.12; Sony states that the most current version supersedes earlier versions. The agreement says: “Subject to this Agreement’s terms, SIE Inc grants you a non-exclusive, non-commercial right to use System Software solely on your PS5 system.”
Among its restrictions, the agreement addresses unauthorized or pirated software, obtaining system software outside Sony-authorized distribution methods, and using tools to bypass, disable, or circumvent PS5 encryption, security, or authentication mechanisms. Those are contract terms, not a court ruling on every situation or a complete account of copyright law. The agreement also refers to applicable intellectual-property law, so the license question and copyright or anti-circumvention questions should not be collapsed into one.

U.S. law has narrow, conditional exceptions—not a general personal emulation exemption. The Copyright Office explains that the DMCA’s anti-circumvention rule is general, while the Librarian of Congress may adopt limited exemptions through the triennial process. An exemption for a defined class of users or conduct does not remove the general rule for other works or circumstances. See the Copyright Office’s 2024 Section 1201 proceeding.
The current 37 C.F.R. § 201.40 includes a route for certain lawfully acquired complete games when external authentication-server support has ended, for the specified purpose of restoring personal local gameplay. It also has separate conditions for eligible libraries, archives, and museums, including limits related to commercial advantage and making games available outside an institution’s physical premises. These provisions are limited by their eligibility, purpose, and other conditions; they do not amount to general permission to download PS5 game files or emulate ordinary supported games.

What should a PS5 owner take away?
- Do not treat “emulator,” “game copy,” “firmware,” and “security bypass” as interchangeable. Each describes different conduct.
- Do not assume buying a console or disc automatically authorizes downloading, extracting, or making another copy.
- Do not extend the Connectix ruling from original PlayStation development to PS5 projects or end-user copying.
- For a legal assessment, identify the jurisdiction and the precise acts involved; the cited sources do not settle every possible PS5 emulator scenario.
