Short answer: In the United States, merely encountering a report or watching a stream is generally less legally exposed than downloading, saving, hosting, reposting, embedding or linking to the leaked file. None of those activities has a universal safe harbor, however. Rockstar Games says that any pre-release posting of in-game footage from leaked copies will be taken down, regardless of how the footage was obtained. Your country, the way you accessed the material, what you did with it and how much you shared all matter.
Sharing the footage is the clearest high-risk conduct. Downloading can create an unauthorized reproduction; public redistribution can trigger copyright complaints and account penalties; and a DMCA takedown can remove material without a court first deciding the merits. Commentary about the leak may be more defensible than supplying the video, but fair use is a fact-specific test, not a blanket permission to publish a complete unreleased gameplay recording.

Why the GTA 6 footage is treated as an unauthorized leak
On September 19, 2022, Rockstar Games said it had suffered a network intrusion in which an unauthorized third party illegally accessed and downloaded confidential information, including early development footage for the next Grand Theft Auto. TechCrunch reported the statement and the copyright removals that followed. That history is important: the material was not presented as an authorized trailer, press preview or public beta.
Copyright generally arises automatically in original audiovisual and game content. Rockstar’s legal terms reserve rights in its game content and prohibit copying, distributing or otherwise exploiting that content without express written permission, subject to applicable legal exceptions. Those terms are a rights-holder position, not a worldwide court ruling, and local law can provide exceptions. They do establish why a platform or rights holder is likely to treat a leaked gameplay file as unauthorized.

Viewing a leak is different from making and distributing a copy
The practical legal line is not simply “watched” versus “did not watch.” It is whether your device or account made a copy, whether you redistributed that copy, and whether the source or access method violated another rule.
| Conduct | Relative exposure | Why it matters |
|---|---|---|
| Reading a news report that describes the leak | Lower | You are receiving information, not the game footage itself. A report can still contain infringing screenshots or clips, so the page’s contents matter. |
| Watching a clip or stream in a browser | Lower than downloading, but not risk-free | Playback normally involves temporary buffering or caching. A website can also prohibit access, and the source may be unauthorized. |
| Downloading, screen-recording or saving the file | High | You have made or retained a reproduction. Depending on the jurisdiction and access method, anti-circumvention, computer-access or contract rules may also be relevant. |
| Posting the complete clip on your account | Very high | This is a new public distribution of an unreleased work and is the conduct Rockstar expressly says it will request platforms to remove. |
| Mirroring, embedding or hot-linking a leak | High to very high | You may facilitate public access even when the file is hosted elsewhere. An embed can still display the infringing work on your page, and a link can direct users to it. |
| Using a short excerpt in genuine criticism or reporting | Fact-dependent | Purpose, transformation, amount, market effect and the character of the source all matter. There is no guaranteed lawful percentage or duration. |
“Lower” does not mean “automatically legal.” It means that passive exposure is ordinarily less likely to create the same reproduction and distribution evidence as saving or uploading a file. A person facing a dispute should obtain advice for the law of the relevant country rather than rely on a risk label.
What happens when you download or save the footage
Downloading creates a copy on a device, server or cloud account. A screen recording, conversion to another format, thumbnail archive or backup can create additional copies. In the United States, copyright owners generally control reproduction and distribution of protected works, subject to statutory exceptions. Whether a particular temporary technical copy is actionable can depend on how it was made and used; the available facts do not support promising that ordinary browser caching is always exempt.

The route used to obtain the file can add separate issues. Circumventing a digital access control, using stolen credentials or accessing a system without authorization may implicate laws or contracts beyond copyright. Those rules vary substantially by country and by the facts of the intrusion. Do not treat “I only downloaded it” as a complete answer if the file came from a compromised account, a password-protected archive or a bypassed security measure.
Why reposting, mirroring, embedding and linking carry the most practical risk
Rockstar’s published support policy states: “Any posting of in-game footage from leaked copies of the game prior to its official release date will be taken down, regardless of how the game was obtained.” The wording covers the result, not just the original hacker. A repost can therefore be removed even if you received the file from someone else and did not participate in the intrusion.
Public redistribution also creates a straightforward notice target. The U.S. Copyright Office explains that a rights holder can ask an online service provider to remove material through a Section 512 notice-and-takedown request. A platform may disable a video, hide a post, suspend an account or remove a link before any judge rules on infringement. A takedown is an enforcement and hosting process; it is not, by itself, a final court judgment that every legal issue has been decided.

Embedding is not a reliable workaround. The embedded player can make the leaked work available to your audience, and the platform may treat the page as a posting under its rules. A plain hyperlink can also be risky when it is deliberately directing users to an unauthorized copy, especially if your page promotes the link, supplies context that encourages downloading or replaces the need to find legitimate coverage. Linking to a reputable article that discusses the incident is a different activity from linking directly to a leaked file or mirror.

Fair use can permit some unauthorized uses for purposes such as criticism, comment, news reporting, teaching or research. The analysis is fact-specific and generally weighs four considerations:
- Purpose and character: A genuinely analytical or newsworthy post is different from an upload designed to attract views with the unreleased gameplay itself. Commercial motivation can matter, but a noncommercial label does not automatically make a use fair.
- Nature of the work: Gameplay footage is a creative audiovisual work. Unreleased status and the fact that the rights holder has not chosen the public release context can weigh against copying, although they do not decide the case alone.
- Amount and substantiality: Reproducing an entire mission, long sequence or complete video is harder to defend than using only what is needed to make a specific point. There is no safe “under X seconds” rule.
- Market effect: A full leak can substitute for an authorized trailer, preview or eventual release and can interfere with the owner’s control over launch publicity. A short excerpt that does not function as a substitute may present a different market analysis.
A complete leaked gameplay video is therefore materially harder to justify than a short, tightly edited excerpt accompanied by original criticism. Even a seemingly strong fair-use argument does not stop an automated claim or an initial takedown. The person using the material may need to explain the legal basis through the platform’s counter-notice process and, ultimately, in court.

How DMCA takedown and counter-notice processes work
Section 512 provides a safe harbor that can limit an eligible service provider’s monetary liability for user-posted infringement when the provider meets statutory conditions. The U.S. Copyright Office describes a safe harbor as “a limitation on monetary legal liability that could otherwise result from the infringement or unauthorized use of copyright-protected works by an OSP’s users.” It is protection for qualifying providers, not a license for users to upload whatever they want.
- Notice: A rights holder or authorized agent identifies the material, supplies required statements and asks the provider to disable access.
- Removal or disabling: The provider may take down the video, image, post, account content or link. This can happen quickly and without a prior court hearing.
- Notification: The provider generally tells the uploader about the action and explains any available counter-notice route.
- Counter-notice (only if appropriate): An uploader who has a good-faith legal basis, such as a genuine fair-use position or misidentification, can submit the information the provider requires. A counter-notice involves legal attestations and can expose the uploader to litigation.
- Possible restoration or escalation: If the claimant does not file a court action within the applicable process window, the provider may restore the material; policies and timelines differ. A claimant can instead pursue a court case.
Do not file a counter-notice simply because a clip is popular or because you did not hack the source. The relevant question is whether your particular use was authorized or legally protected.

Country, platform and access method can change the result
There is no single worldwide rule called “the GTA 6 leak law.” U.S. copyright and DMCA concepts are useful for a U.S.-oriented explanation, but another country may apply different exceptions, notice systems, privacy rules, intermediary obligations or criminal provisions concerning unauthorized access. Even within one country, the answer can change with the platform’s terms, the account holder’s permissions, the audience size and whether the file was obtained through circumvention.

Platform enforcement can be stricter than the minimum legal rule. Rockstar’s policy promises takedown of pre-release leaked-footage postings regardless of how obtained, so a post can disappear even if the uploader believes an exception might ultimately apply. Account strikes, loss of monetization and termination are contractual or platform consequences, separate from a damages claim.
A safer decision framework before you click, save or post
Use these questions to classify a proposed action:
- What exactly is the source? A licensed trailer or authorized press preview is not the same as a file identified as coming from a hacked system or leaked copy.
- Will your device make a copy? Downloading, screen capture, clipping, transcoding and storing in the cloud all increase reproduction exposure.
- Are you redistributing the work? Uploading, mirroring, embedding or directly linking to the file creates more risk than describing what happened.
- Is your use transformative and limited? Identify the precise criticism or reporting purpose, use only what is needed and add substantial original analysis. Do not publish the complete sequence as the attraction.
- Could a reader substitute your post for the authorized release? If the answer is yes, the market-effect problem is stronger.
- Which law and contract apply? Consider your country, the platform’s terms, any access controls and whether you are acting for a business or publication.
If you encounter leaked footage
- Stop autoplay and do not download, screen-record or save the file.
- Do not repost it, quote-post it with the clip attached, embed the player or link directly to a mirror.
- If you need to report the incident, cite a credible article describing it rather than distributing the underlying footage.
- Keep only the minimum information needed to document a report, and avoid retaining copies of the video or screenshots that reproduce substantial portions of it.
- If you receive a platform notice, read the stated claim and deadline. Remove the material if you have no clear legal basis; seek advice before filing a counter-notice.
Guidance for writers, streamers and video creators
A responsible report can explain that a breach occurred, summarize what the footage appears to show and discuss the security or industry implications without supplying a substitute for the unreleased game. Use original narration, avoid lengthy playback and consider whether still images are necessary at all. Blur or omit material that reveals personal data, credentials or exploit instructions. Label unverified descriptions as unverified rather than presenting them as confirmed game features.
Creators should also preserve evidence of authorization for any footage supplied by a publisher, event organizer or press contact. “I found it online” is not proof of a license. If your business depends on the post, obtain advice from a lawyer familiar with copyright and media law in the country where you operate.

- “If it is already online, it is public domain.” Online availability does not transfer copyright or prove authorization.
- “I did not hack Rockstar, so I cannot infringe.” A later uploader can still reproduce or distribute an unauthorized copy.
- “A link is never infringement.” A direct link can facilitate access and can violate platform rules even when the file sits on another server.
- “Fair use means any short clip is safe.” Duration alone does not decide purpose, transformation, amount or market effect.
- “A DMCA notice proves I broke the law.” A notice triggers a removal process; it is not a judicial determination. It should nevertheless be taken seriously.
The practical conclusion is narrow but clear: passively encountering a report or stream is generally less exposed than copying or distributing the footage, while saving, reposting, mirroring, embedding or directly linking to the leak creates substantial copyright and platform risk. Rockstar has expressly said pre-release leaked-footage postings will be taken down, and fair use cannot be promised for a complete unreleased video. For a decision involving your country, employer, publication or a takedown dispute, consult a qualified local attorney.
