In the United States, downloading a copyrighted game ROM from an unauthorized source can infringe copyright—even if you own the cartridge. Making and keeping your own archival copy may be treated differently, but the Copyright Office describes only a limited rule for computer programs, not a blanket right to download, copy, share, or play any ROM. Emulator software, the ROM itself, and any copy-protection bypass raise separate questions.

What does copyright have to do with a ROM?
A ROM file may contain a game’s protected software or other copyrighted material. The U.S. Copyright Office says original works fixed in a computer file should generally be assumed protected unless there is clear information otherwise. Its Fair Use (FAQ) puts the basic rule this way: “Uploading or downloading works protected by copyright without the authority of the copyright owner is an infringement of the copyright owner’s exclusive rights of reproduction and/or distribution.”
Whether a particular ROM is authorized depends on facts such as who supplied it and whether the rights holder gave permission. A game’s age, lack of current sales, or a website’s “backup” label does not by itself establish authorization.

Is it legal to download ROMs if I own the game?
Owning a physical cartridge does not, by itself, authorize you to download a separate copy from an unrelated website. The Copyright Office’s guidance on archival copies is narrower: it addresses a computer program lawfully owned by the person making the copy, and a copy made solely for archival purposes. It does not say that ownership of a cartridge licenses a third-party download.
So the decisive distinction is not simply “I own the game.” It is whether the copy’s source is authorized and whether the particular copying activity fits a legal permission. A file offered online as a personal backup may still be unauthorized.

Can I make a ROM from my own cartridge?
The Copyright Office describes Section 117 of the Copyright Act as allowing a lawful owner of a computer-program copy to make an archival copy solely for archival purposes. If the original is sold, given away, or otherwise transferred, the archival copy must be destroyed or transferred along with it. The Office also advises checking the software’s terms of sale or license.
This guidance does not conclusively answer every question about dumping a particular game cartridge. In particular, it does not establish that every self-made ROM is lawful: whether the copy meets the archival conditions and whether making it involves bypassing technological protection are separate issues. The Office also says there is no comparable general statutory backup authorization for other kinds of works, such as music or films.

Does managing a ROM collection change the answer?
Keeping files organized on a device does not itself establish that the files were lawfully obtained or that making additional copies is permitted. Treat downloading a copy from someone else, creating an archival copy, and sharing a file as different activities; the limited archival-copy guidance is not a general license for all of them.
Is playing ROMs on an emulator legal?
An emulator application and a game ROM are not the same thing. The Copyright Office’s 2024 Register of Copyrights recommendation said “the record on the use of emulation technologies is inconsistent and incomplete and the technologies are not addressed in the exemption text.” The 2024 rule therefore should not be described as a blanket permission to use emulators or as a blanket ban on them.

The legal assessment can depend on the ROM’s source, how it was obtained, and how the game is accessed or run. The official materials cited here do not resolve the status of every emulator, game, or method.
Can I share a ROM with a friend?
Sharing can raise a separate copyright issue from keeping a personal copy. Uploading or distributing a protected ROM without the rights holder’s authority can implicate the owner’s distribution right. Owning the physical game does not, by itself, grant permission to send or upload a ROM to another person.

Does the DMCA let me bypass copy protection to preserve an old game?
Copyright permission and anti-circumvention rules are distinct questions. Section 1201 of the Digital Millennium Copyright Act generally prohibits circumventing technological measures that control access to copyrighted works. Congress provides for limited, temporary exemptions through a rulemaking process; an exemption from the circumvention prohibition is not a general authorization to download or distribute a copyrighted game.
The current video-game provisions in 37 C.F.R. § 201.40 define specific circumstances rather than a general public exception:

The U.S. Copyright Office initiated the tenth triennial Section 1201 proceeding for the 2027 cycle in 2026. Its proceeding page says renewed exemptions, if renewed, would run from October 2027 through October 2030. The 2024 text is the exemption text addressed here; a later rulemaking could change it.

What penalties does the Copyright Office describe?
The Copyright Office’s Fair Use (FAQ) lists possible statutory damages of up to $30,000 per work, or up to $150,000 per work for proven willful infringement. These are statutory ceilings, not automatic awards, predictions about a particular case, or a measure of how often ROM cases lead to damages.
What should I check in a specific case?
- Jurisdiction: The explanation above concerns U.S. federal law; another country may apply different rules.
- Source and authorization: Determine whether the rights holder or an authorized distributor supplied the file.
- Activity: Separate a third-party download from making a qualifying archival copy, running an emulator, or uploading a file.
- Copy protection: If the method bypasses an access control, assess Section 1201 separately and check whether a precise exemption applies.
- Terms and transfer: For a claimed archival copy, consider the software terms and the requirement to destroy or transfer the archival copy with the original.
For a decision involving a particular title, copying method, or legal dispute, consult a lawyer familiar with the applicable jurisdiction.
