A package that includes a Nintendo game file raises different concerns from an independently written program that does not. Either may still raise copyright questions if it uses Nintendo code or other protected material, and software that bypasses a technical protection measure can raise separate legal issues.
Is it legal to download a Nintendo game on PC?
There is no blanket answer for every unofficial PC port. The key distinction is between the port software and the Nintendo game itself: a download may include a ROM or other game file, may reproduce Nintendo material in the port, or may require a tool or action that bypasses a technical protection measure. The law that applies also depends on your country.

If the download includes a ROM or other Nintendo game file
Nintendo’s Intellectual Property & Piracy FAQ identifies downloads from third-party links and peer-to-peer networks as unauthorized copies and states: “The uploading and downloading of pirate copies of Nintendo games is illegal.” That is Nintendo’s stated position. Separately, the World Intellectual Property Organization’s 2022 analysis explains that creating a ROM duplicates the whole game and that unauthorized copying would infringe reproduction rights in most jurisdictions. WIPO’s broad analysis is not a ruling on every country or every individual case.

Owning a cartridge or digital copy does not, by itself, establish that you may download a separate PC copy or use a particular port. The sources cited here do not settle every personal-backup or game-dumping scenario; those questions depend on local law and the specific circumstances.

If the port does not include a ROM
Leaving the game file out does not automatically resolve the copyright question. Nintendo identifies source and executable code, visuals, music, characters, manuals, artwork and publications among the material it protects. A port that incorporates Nintendo code or other protected expression may raise concerns even if users must supply a game file separately. Whether a specific project does so depends on what it actually contains and the law that applies.
If the port or a required tool bypasses a protection measure
This is a separate issue from whether an emulator exists or whether the package contains a ROM. Nintendo says some unauthorized emulators circumvent security measures and are unlawful; that is Nintendo’s position, not a universal court ruling about every emulator. In the United States, the Copyright Office explains that section 1201 of the Digital Millennium Copyright Act prohibits circumventing technological protection measures and trafficking in certain circumvention technologies. That U.S. rule should not be treated as a description of every country’s law.

Does Nintendo’s game-content policy permit fan ports?
No general permission for PC ports follows from Nintendo’s Game Content Guidelines for Online Video & Image Sharing Platforms. Updated September 2, 2024, those guidelines address specified uses of gameplay footage and screenshots on video- and image-sharing platforms. Nintendo says other uses of its intellectual property are governed by applicable law, and that it cannot provide legal advice. A policy covering certain gameplay videos is not a general license to reproduce game code or make a port.

No source cited here tested a named port, installer or executable for malware, so there is no basis to call a particular download safe. A file’s legal status and its cybersecurity risk are also different questions: legality does not prove a file is clean, and a malware scan does not determine whether a copy is authorized.

CISA’s 2020 Emotet advisory recommends scanning software downloaded from the internet before running it. Scanning is a precaution, not a guarantee that malware will be detected. Avoid running an unknown executable or installer, or opening a password-protected archive, from a source you cannot verify. Prefer official distribution channels and keep reputable security protections enabled.

Before deciding what to do, check the download against these questions. They help identify the issues, but cannot determine the legal status of an unnamed port without examining it and applying the relevant local law.

- Does it bundle a ROM or another Nintendo game file? A separate download link or peer-to-peer copy raises the copying issue even if the port itself is distributed separately.
- Does it reproduce Nintendo code or other protected material? Check for included game assets such as graphics, music, characters or story content as well as code.
- Does it require bypassing a protection measure? Distinguish ordinary emulator software from tools or conduct that circumvent technical protections.
- Can you verify the source and file integrity? An unfamiliar download cannot be treated as safe merely because it is described as a port; scanning downloaded software before execution is a prudent precaution, not certification.
- Which country’s law applies? Nintendo’s statements, WIPO’s broad analysis and the U.S. Copyright Office’s explanation address different kinds of authority and do not settle every jurisdiction.
What is the lower-risk way to play?
If you want to play a Nintendo game rather than assess an unofficial port, Nintendo identifies the Nintendo eShop and its own website as legitimate channels for downloading console games. Those official channels avoid relying on a third-party game-file download; they do not turn an unofficial PC port into an authorized product.
For a specific port, backup or personal-copying question, the sources do not establish a universal answer. The relevant details are the port’s actual code and contents, whether protections are bypassed, and the law where you live. If you need a definitive answer about a particular project, consult a lawyer qualified in that jurisdiction.
