High 5 lists New York as a restricted state and says it uses geolocation to block access to Sweeps Play there. New York law also prohibits online sweepstakes games that meet its definition of casino-style play using dual currency and offering a chance to win cash or cash equivalents. High 5’s state restrictions and New York Racing, Pari-Mutuel Wagering and Breeding Law § 912 support that answer.
What is restricted in New York?
High 5’s restriction applies to Sweeps Play while you are physically in New York. The operator’s current state-restrictions page names New York and says geolocation blocks access from restricted states. That means a New York resident traveling elsewhere should check the rules where they are physically located, and someone visiting New York should expect Sweeps Play to be unavailable while there.

High 5 also describes a separate Classic free-to-play mode in its help information. Classic and Sweeps Play are not interchangeable: the restriction cited here is specifically about Sweeps Play. Check High 5’s current terms and availability for the particular mode before using it.
What New York law prohibits
New York Racing, Pari-Mutuel Wagering and Breeding Law § 912 defines an “online sweepstakes game” as an internet or mobile game that simulates casino-style gaming, uses a dual-currency system, and allows exchange for or a chance to win cash or cash equivalents. The law makes it unlawful to operate, conduct, or promote such games in New York. It also prohibits specified entities, including platform providers and media affiliates, from supporting those activities.

The law does not say that every free-to-play casino-style game is prohibited. Its definition includes the dual-currency and cash-or-cash-equivalent prize elements. The statute leaves the State Gaming Commission to determine what constitutes a dual-currency system; the New York Senate’s announcement says games without cash-redeemable rewards are unaffected. Read § 912 and the Senate announcement on the law.
Penalties and enforcement
Section 912 provides for fines of $10,000 to $100,000 per violation and authorizes enforcement by the New York State Gaming Commission, State Police, or Attorney General’s office. Those penalties concern violations of the statute; they are not a statement that a player faces those fines simply for attempting to open an app.

Why High 5 stopped offering Sweeps Play in New York
On June 6, 2025, New York Attorney General Letitia James announced that, after cease-and-desist letters, 26 sweepstakes casino platforms were ending sales of sweepstakes coins in the state. High 5 Casino was named among them. The Attorney General’s office described New York’s position that wagering cash-redeemable virtual coins on games of chance constitutes gambling, regardless of how an operator characterizes how the coins are obtained. The Attorney General’s announcement provides the enforcement context.

Does High 5’s “not real money gambling” wording change the answer?
No. High 5’s terms describe its service as not offering “real money gambling.” That is the operator’s characterization, not a legal ruling that overrides New York’s statute or makes Sweeps Play available in the state. For the practical question of access, High 5’s current restricted-state list is direct: New York is restricted for Sweeps Play. High 5’s Terms of Use were updated June 26, 2026.
