In the United States, owning a GoldenEye 007 cartridge does not by itself make it lawful to download an unauthorized copy of the game from a ROM site. A cartridge is a particular physical copy; it does not transfer the game’s copyright. The U.S. Copyright Office says unauthorized downloads can infringe copyright, while its limited archival-copy guidance is not a general permission to download someone else’s ROM. Nintendo says it does not authorize its game files for PC play or download. The sources reviewed do not establish an authorized PC download of GoldenEye 007.
What “legal to download” means here
This answer is focused on U.S. federal law and the official platform information described below. Copyright rules and exceptions differ by country, so it is not a worldwide legal conclusion or advice for a particular case.

Four separate things are easy to conflate:
- An emulator is software that imitates a console’s operation.
- A ROM is a copy of the game software.
- A cartridge is a material copy of the game that you own.
- Copyright is a separate set of rights in the game, which does not automatically pass to you when you buy that cartridge.
So the existence of an emulator, or ownership of a cartridge, does not by itself establish a right to obtain a ROM from a third-party website.
Does owning the cartridge let you download a ROM?
Buying a copy does not transfer the copyright
Under 17 U.S.C. § 202, “Transfer of ownership of any material object, including the copy or phonorecord in which the work is first fixed, does not of itself convey any rights in the copyrighted work embodied in the object.” In practical terms, owning a GoldenEye 007 cartridge is not the same as owning the copyright or receiving permission to download another copy.

The archival-copy rule is limited
The U.S. Copyright Office describes a narrow rule under 17 U.S.C. § 117: a lawful owner of a computer program may make or authorize an archival copy, subject to conditions. The Office says the archival copy must be destroyed or transferred with the original when the original is sold, given away, or otherwise transferred. It also notes that license or sale terms may affect the analysis, and that this rule concerns computer programs rather than other material such as music or films downloaded to a hard drive.
That guidance does not say that a cartridge owner may download a ROM made and uploaded by someone else. Whether a particular method of making a personal copy is allowed can depend on details not resolved by the general guidance, including license terms and possible anti-circumvention issues. Cartridge ownership alone is not a blanket authorization for a third-party download.

Is the emulator itself illegal?
Emulator software and a game ROM are different things. The sources reviewed do not support the claim that every emulator is illegal. Nintendo’s official FAQ states the company’s position against piracy and says Nintendo does not authorize downloading its game files for PC play; that is Nintendo’s corporate position, not a court ruling that decides the legality of every emulator or every use.

Preservation exceptions are narrow
U.S. regulations provide specific video-game preservation exemptions for certain activities by eligible libraries, archives, and museums. The listed cases have conditions, including requirements relating to lawfully acquired complete games and limits on access. They do not create a general public license to download ROMs from an archive or website.
What can happen if someone downloads or shares an unauthorized ROM?
The U.S. Copyright Office says that downloading or uploading copyrighted works without the copyright owner’s authority infringes reproduction and/or distribution rights. Its FAQ says statutory damages may reach $30,000 per work, or up to $150,000 per work if willful infringement is proven. Those are statutory ceilings described by the Office, not automatic fines or predictions of what would happen in an individual case.

What are the official ways to play GoldenEye 007?
Official listings and announcements describe console or cloud routes, not a Windows PC download. Their current availability, terms, and regional catalog status can change.

Xbox Wire’s January 26, 2023 launch announcement also said that people with a digital Rare Replay copy on their Xbox account could download GoldenEye 007 without Game Pass; physical Rare Replay copies did not qualify for that offer. What to do if you want to play on a PC
- Check the current official Xbox and Nintendo listings for the console or cloud options available in your region.
- Do not treat a ROM site’s claim that a download is “legal” or that ownership of a cartridge is enough as proof of permission.
- If you are considering making a personal archival copy from a cartridge, do not assume that the general § 117 explanation settles your specific method, license terms, or any anti-circumvention question.
Based on the official sources reviewed, no authorized GoldenEye 007 PC download is established. The listed official routes are for Xbox consoles or cloud play and Nintendo Switch in the announced regional context.
