Is Fliff Legal in Wisconsin? What the Current Rules Say

Short answer: Fliff’s current Fliff Cash Sweepstakes Rules do not list Wisconsin among excluded states, but that is not a legal ruling or blanket confirmation that every Fliff product is available there. Fliff Pick’Em is separate, and Wisconsin is not on its current eligible-state list. Fliff’s Sweepstakes Rules put responsibility for determining local legality on each participant.

What Fliff’s current state lists say

Fliff Cash Sweepstakes

Fliff’s Fliff Cash Sweepstakes Rules, last updated June 30, 2026, list Alabama, Arizona, California, Colorado, Connecticut, Hawaii, Idaho, Indiana, Kentucky, Louisiana, Maine, Michigan, Mississippi, Montana, Nevada, New Jersey, New York, Tennessee, Washington and West Virginia as excluded states. Wisconsin is not named in that list.

This means Wisconsin is not listed among the states excluded by those rules; it does not establish that Wisconsin regulators approved Fliff or definitively resolve whether participation is legal under every circumstance. The rules say participants are responsible for determining whether participation is legal where they are located.

Fliff Pick’Em

Pick’Em is a different product with its own availability information. Fliff describes it as peer-to-peer daily fantasy sports contests where users make lineups by selecting athlete performance outcomes against statistical projections. Its Pick’Em state-eligibility help page, updated March 23, 2026, names California, Kansas, Kentucky, Minnesota, New Mexico, North Dakota, Rhode Island, South Carolina, South Dakota, Utah and West Virginia. Wisconsin is not on that list.

Accordingly, the current published information does not list Wisconsin as an eligible state for Fliff Pick’Em. Do not infer Pick’Em access from the Sweepstakes Rules’ exclusion list: the products have different mechanics and eligibility terms.

Why the distinction matters

Under the Sweepstakes Rules, Fliff Cash is a promotional sweepstakes entry medium that may give participants a chance to accumulate eligible Fliff Cash redeemable for cash and prizes, subject to the rules. The rules state, “NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN.” They describe a free coin-claim bonus in specified wallet circumstances and no-cost giveaway contests; they also say bonuses may accompany some Fliff Coin purchases. Fliff says Fliff Cash itself is not purchased.

Those descriptions are not interchangeable with Pick’Em, where users enter fantasy contests by building athlete-outcome lineups. The product being used, how an entry is obtained, how winners are determined and what prizes are offered can all matter when assessing a promotion or contest.

Wisconsin’s general lottery framework

The Wisconsin Department of Administration’s Division of Gaming explains that a promotion is an illegal lottery when it combines three elements: prize, chance and consideration. Its guidance on contests, sweepstakes and sales promotions says: “Three elements – Prize, Chance and Consideration – must be present in any promotion conducted in the state of Wisconsin in order for the promotion to constitute an illegal lottery.” The guidance discusses chance in terms of a winner selected by luck of the draw and identifies factors relevant to whether skill is involved.

This is general agency guidance, not a determination about Fliff. Wisconsin Statute § 100.16 addresses selling or offering something through a representation that money or value may be won by chance because of a sale, and includes a limited exception for qualifying in-pack chance promotions. That statute alone does not decide Fliff’s status; the applicable framework and the specific product’s entry and prize mechanics matter. The cited 2025 text is reproduced by Justia, rather than being a Fliff-specific or agency ruling: Wis. Stat. § 100.16.

What to check before using Fliff in Wisconsin

  1. Identify the product. Check whether you mean Fliff Cash Sweepstakes or Fliff Pick’Em; do not rely on one product’s state list for the other.
  2. Read the live terms and availability notices. State access and promotion terms can change. Compare the current rules with the current in-app or website availability information before entering.
  3. Consider your location and the contest mechanics. Fliff’s Sweepstakes Rules assign participants responsibility for determining local legality. For a legal conclusion about your own circumstances, consult a qualified Wisconsin attorney rather than treating a published state list as legal advice.
