No. As of October 3, 2026, fixed-odds bets on esports offered to people in Brazil are prohibited under Provisional Measure 1,394/2026. The ban covers online and in-person offers and applies even when the operator is based abroad. A former Brazilian authorization or a .bet.br address does not override the newer rule.
What Brazil’s current ban covers
Provisional Measure 1,394/2026 prohibits the exploitation, offer, intermediation and advertising of fixed-odds betting throughout Brazil. The measure expressly includes bets on real sports-themed events and events in online games. It also reaches an operator based abroad when it offers a bet to someone located in Brazil. The Ministry of Finance’s fixed-odds overview repeats the prohibition.

This answer is about fixed-odds betting lotteries—the category addressed by the measure—not a ruling on every kind of gaming or gambling. The measure’s territorial test is the bettor’s location: a foreign site being accessible in Brazil does not make its fixed-odds offer lawful there.
How the rule changed from the former licensing system
Before the 2026 measure, Law 14,790/2023, building on Law 13,756/2018, established a fixed-odds framework. The Ministry of Finance said that from January 1, 2025, operators needed authorization from its Secretariat of Prizes and Betting (SPA) to operate nationally, and authorized sites used the .bet.br domain. That was the prior system, not current permission.

Under the former law, an eligible real sports event had to follow rules set by the national sports administration organization, its affiliates, or a foreign sports administration organization. Events involving youth categories or exclusively under-18 competitors were excluded. Those conditions describe the earlier framework; they do not create an exception to the present ban.
Law 14,852/2024 defines electronic games for its own purposes and excludes lotteries and games involving bets from that definition. That distinction is not a determination that every esports tournament was—or was not—a qualifying sports event under the former betting law.

What the transition rules mean for existing accounts and bets
Provisional Measure 1,394/2026 sets out a wind-down for operators and balances. Its deadlines run from the measure’s publication date; the key rules are:

- From publication: no new fixed-odds concessions, permissions or authorizations may be granted, and operators may not accept new funds into bettors’ transaction accounts. The measure provides a limited exception for specified financial assets already held and used only to meet transition obligations.
- Ten days after publication: operators must make their betting websites and apps unavailable. An open bet whose result has not been determined by this cutoff is void, and the full stake must be returned. Prizes for bets settled by the cutoff remain payable.
- Thirty days after publication: existing permissions and authorizations under Law 14,790/2023 are set to end. Operators must make sufficient funds available for refunds, voided stakes and winnings.
These are relative deadlines in the measure; do not assume that a particular account’s status or payment timing can be determined without checking the operator’s notices and the applicable transition date.

Practical steps if you have a balance or unsettled wager
- Check the operator’s official communication channel for its transition and payment notices.
- Save account and transaction records, including balance details, deposits, wager status, settlement information and relevant messages.
- Compare the wager status with the cutoff: the measure provides for payment of prizes on bets settled by the ten-day cutoff and return of the full stake for bets still unresolved at that point.
These steps help preserve information about an account; they are not a statement about the outcome of any particular dispute.

- A legacy license is not current permission. The Ministry’s former operator register and past authorizations must be read in light of the later prohibition notice. Neither a historical authorization nor a .bet.br address makes a current fixed-odds offer lawful.
- A foreign operator is not outside the stated reach. The measure expressly includes offers by an agent based abroad to a person located in Brazil.
- The measure’s text does not establish a separate penalty for a fan merely for placing a bet. It prohibits operation, offering, intermediation and advertising and sets out operator transition duties. This does not resolve whether another law could have consequences in a particular individual case.
- Older responsible-gambling rules do not mean betting remains available. The Ministry identifies Portaria SPA/MF 1,231/2024, as amended, as the former regime’s responsible-gambling and marketing regulation; it should not be read as permission to place fixed-odds bets under the later measure.
The legal position here is the one reflected in the official materials checked on October 3, 2026. Because the change is a provisional measure, it may be amended, reviewed or expire; fans should check current official Ministry of Finance information before relying on this status.
