Is Emulation Legal? Where U.S. Copyright Law Draws the Line

In the United States, emulator software is not automatically illegal—and owning a game does not automatically make every ROM download or copy lawful. The legal answer depends on what was copied, how it was obtained, whether copy protection was bypassed, and where the activity took place. A key Ninth Circuit case allowed specific intermediate copying during emulator development; it did not approve every emulator, game file, or method of use.

What does “emulation” mean legally?

An emulator is software that imitates another device’s behavior so software made for that device can run elsewhere. That description does not settle whether a particular emulator’s development, distribution, or use infringes copyright. Nintendo describes emulators in similar terms, while arguing that unauthorized emulators can encourage piracy or circumvent security measures; that is the company’s position, not a court ruling. It helps to separate four things that are often bundled together in casual discussions: the emulator program, console firmware or BIOS, a copy of a game, and any act of bypassing a technological protection. Different rules and facts can apply to each.

Does U.S. law allow developers to make emulators?

One important U.S. decision is Sony Computer Entertainment, Inc. v. Connectix Corp., 203 F.3d 596 (9th Cir. 2000). Connectix made intermediate copies of Sony’s BIOS while reverse engineering the PlayStation to develop its Virtual Game Station emulator. The Ninth Circuit held that the intermediate copying at issue was fair use in those circumstances. Read the Ninth Circuit opinion.

The holding supports a limited point: making an emulator is not automatically copyright infringement. It is not blanket permission to copy protected code into an emulator, distribute a BIOS or firmware image, or make game copies available. Nor does the opinion make all reverse engineering lawful. Fair use is fact-specific, and this is a Ninth Circuit appellate decision—not a Supreme Court ruling or a worldwide rule.

If I own the game, can I download or make a ROM?

Owning a physical cartridge and having authorization for a particular digital file are separate questions. A ROM is a copy of game software; owning the cartridge alone does not establish that an online download was authorized or that the file’s copying and distribution are lawful. The Connectix decision concerned intermediate BIOS copying during emulator development, not game-ROM downloads or a general right to obtain a copy from any source.

Personal backup and format-shifting situations can turn on their facts. The cited authorities do not establish a universal rule that making or downloading a ROM is always lawful—or always unlawful—when the user owns the original. Consider the source of the file, who made the copy, whether it was shared or distributed, and whether a technological protection was bypassed.

How does the DMCA affect emulation and game backups?

Copyright infringement and circumvention are distinct legal questions. Section 1201 of the DMCA generally addresses bypassing technological measures that control access to copyrighted works. The U.S. Copyright Office says it “generally makes it unlawful to circumvent technological measures used to prevent unauthorized access to copyrighted works,” including video games and computer software. Section 1201 contains specific exceptions, and the Copyright Office publishes exemptions whose wording and conditions matter. They are not a general license for emulation or personal backups. Whether a particular act falls within an exemption depends on the activity and applicable terms; consult the current text of 37 CFR § 201.40 and 17 U.S.C. Chapter 12. A claim that a copy would be fair use does not, by itself, answer the separate anti-circumvention question.

What does the Yuzu case establish?

Nintendo sued Tropic Haze, the company behind the Yuzu emulator. In March 2024, the case ended in a consent judgment and permanent injunction. The order includes provisions concerning Yuzu and circumvention materials. Read the March 4, 2024 judgment and injunction.

That outcome applies to the parties and covered persons as specified in the order. Because it was a consent judgment, it was not a full trial or appellate ruling that every emulator is unlawful. It does show the substantial legal risk that can arise from the particular conduct and materials addressed in that dispute; it does not replace a fact-specific analysis of other emulator designs or uses.

  • What material is involved? Emulator code, BIOS or firmware, game software, and console keys are not interchangeable categories.
  • What act occurred? Temporary copying for reverse engineering differs from distributing a playable copy.
  • Was a technological measure bypassed? Consider Section 1201 separately from copyright infringement, and check whether a specific exemption applies.
  • Where did it happen? Connectix is Ninth Circuit authority. Other U.S. jurisdictions may not treat every issue identically, and other countries can have different copyright and anti-circumvention laws.
