In the United States, emulation is not governed by one blanket yes-or-no rule. The emulator program, the act of copying or obtaining game software, and any circumvention of an access control are separate legal questions. Owning a cartridge, disc, or digital purchase does not automatically make every ROM download, self-made dump, or protection-bypass lawful. A cautious approach is to use the emulator project’s current documentation, create files from media you lawfully acquired when permitted, obtain required system files from your own hardware where the instructions call for it, and avoid unauthorized downloads.
This explanation covers U.S. federal law. Other countries, state laws, contracts, account terms, and the particular protection used by a game can change the analysis.

What exactly is being evaluated?
People often ask whether “emulation” is legal as if it were one activity. In practice, at least three different acts may be involved, and each has a different rule set.
The emulator program
An emulator is software that imitates a console or computer platform. Emulator documentation treats that program as separate from the game content you supply. Dolphin, for example, explains how its software uses user-provided GameCube and Wii games, while Libretro’s documentation separately discusses game content and BIOS files. Installing an emulator is therefore not the same legal event as obtaining a copy of a game.

The game copy or image
A ROM, ISO, or other image is a copy of software and, often, copyrighted audiovisual content. The fact that you own a physical copy does not automatically authorize every way of obtaining another copy. Section 117 of the U.S. Copyright Act contains limited rules for additional copies and adaptations of computer programs, including copies that are an essential step in using the program with a machine and certain archival copies. The conditions matter: an archival copy must be for archival purposes, and it must be destroyed if your continued possession of the program is no longer rightful. Read the statute at 17 U.S.C. § 117 rather than treating it as an unrestricted backup right for every game format.
Bypassing an access control
Copying and circumvention are separate issues. Section 1201 generally prohibits bypassing a technological measure that controls access to a copyrighted work. The U.S. Copyright Office reproduces the rule this way: “No person shall circumvent a technological measure that effectively controls access to a work protected under this title.” The Copyright Office’s Section 1201 FAQ explains that exemptions are limited and created through recurring rulemaking. A use that might otherwise be noninfringing does not, by itself, answer whether the act of circumvention is exempt.
Does owning the game make a ROM legal?
Ownership helps establish that you lawfully acquired a copy, but it does not settle the copying method or the source of the file. Downloading a commercial ROM or ISO from an unknown site is still obtaining a copy from a third party; your ownership of a disc or cartridge does not turn that site into an authorized source. Dolphin’s FAQ expressly advises against downloading commercial game images, including images of games you already purchased: Dolphin FAQ.
A self-created dump raises a different set of facts: what media you own, what hardware and software are used, whether the process bypasses an access control, and what you do with the resulting file. Section 117 is written for computer programs and includes specific conditions, so it should not be paraphrased as “you can always make a ROM for personal use.” A game may also include separately protected artwork, music, movies, or online services that are not resolved merely by pointing to the computer-program provision.

Digital purchases can be especially fact-specific. A downloaded title may be tied to an account, a platform license, encryption, or an online service. The federal materials cited here do not create a general right to convert every authorized download into an emulator-ready file.
What video-game circumvention exemptions exist?
The current rule in 37 C.F.R. § 201.40 is narrow and conditional. One covered class concerns certain lawfully acquired complete games whose necessary external-server support has ended, for specified local-gameplay or preservation purposes. Another concerns certain complete games that are no longer reasonably available commercially, when preservation is performed by eligible libraries, archives, or museums.
Abandoned-server situations
The regulation does not say that any old online game can be freely bypassed. It defines the covered circumstances and the allowed purpose. A game must fit the rule’s requirements, and the exemption does not automatically authorize redistribution of the game image.

Why the date matters
Section 1201 exemptions are time-sensitive. The Copyright Office describes the 2024 proceeding as the ninth triennial cycle and now lists a tenth proceeding in its overview at the 2024 proceeding page and the current Section 1201 overview. Check the current text before relying on an exemption, particularly after a new rulemaking.
How to use game files you lawfully acquired
There is no universal “load my files” recipe. A disc, cartridge, authorized download, and server-dependent title can require different equipment and raise different legal questions. Use this workflow as a decision path, then follow the exact instructions for your console and emulator.
- Install the emulator from its official project source. Read the current setup guide and compatibility notes for the release you are using. Documentation changes, and a guide for one console cannot be assumed to apply to another.
- Identify the media and your rights to it. Write down whether the game is on an optical disc, cartridge, or an authorized digital account. Note whether you still possess the physical media or have continued rightful access to the digital license. A server-dependent game may not function locally even after a file is created.
- Determine the required dump method. Use the emulator’s documented process for creating or loading a compatible image. Do not substitute a random download because its filename matches your game. Keep the original media and record where the resulting file came from.
- Check for BIOS or other system files. Some emulators and cores require a console BIOS; others make it optional or do not use one. The project may require you to dump that file from your own hardware. Never assume a BIOS found in a download package is authorized merely because the game itself is yours.
- Place files exactly where the project specifies. Follow the documented folder name, filename, region preference, and checksum guidance. Incorrect placement often looks like a legal or compatibility problem but is simply a configuration error.
- Test with the original media available. Keep the physical copy and your dump together in your records. If a title fails, first compare the format, region, revision, and required system files against the emulator’s compatibility notes.
- Avoid sharing the image. Do not upload, seed, email, or sell a game dump unless you have independent legal authority to distribute it. A personal-use rationale does not automatically cover redistribution.
Platform-specific examples
GameCube and Wii with Dolphin
Dolphin’s FAQ documents dumping games from discs and lists supported formats including GCM/ISO, GCZ, CISO, WBFS, WIA, NFS, and RVZ. Those formats and procedures are specific to GameCube and Wii use; they are not a universal list for every emulator. Use the project’s instructions at dolphin-emu.org/docs/faq/, and do not infer that a file downloaded in one of those formats came from a lawful source.

Libretro’s BIOS guide explains that requirements vary by core. Some cores require a BIOS, some treat it as optional, and some do not use one. The user is expected to supply the BIOS and game content and to comply with applicable local law. Check the page for the exact core, filename, directory, and region details instead of copying a BIOS package from an unverified site.

PlayStation 2 with PCSX2
PCSX2’s BIOS setup guide says the BIOS is proprietary and must be dumped from the user’s own PlayStation 2. Its disc guide explains how to create a disc backup with an optical drive. The two official guides are PCSX2 BIOS setup and PCSX2 disc setup. An external USB optical drive can be useful when your computer lacks an internal drive, but that does not make every external drive compatible with every console or media type.
Compare the available file paths before you start
| Path | What you need | Main questions to resolve | What the documentation establishes |
|---|---|---|---|
| Dump an optical disc | Your lawful disc, a compatible drive, and the emulator’s dump procedure | Does the drive read this disc type? Does the process bypass an access control? | PCSX2 documents a PS2 disc-backup workflow; Dolphin documents disc dumping for GameCube/Wii. |
| Dump a cartridge | Your cartridge, compatible console or reader, and a system-specific tool | Is the reader compatible with this cartridge and revision? What protections are involved? | No single cartridge method is established by the sources cited here; follow the relevant project’s instructions. |
| Use an authorized digital title | A valid account or license and an emulator that supports the platform | Can the title be accessed without bypassing platform controls? Does the license permit this use? | The cited federal sources do not provide a universal conversion right for all digital purchases. |
| Download from a third party | An internet connection and a file offered by someone else | Was the file authorized? Does ownership of a separate copy change the source’s status? | Dolphin discourages downloading commercial game images, including games already purchased. |
| Use a BIOS or system dump | The required console hardware and the emulator’s exact BIOS instructions | Is the file dumped from your hardware, and is the filename and region correct? | Libretro and PCSX2 describe system-specific BIOS requirements and user-supplied files. |
Common failure points and safer fixes
“The emulator says BIOS missing”
Read the core or emulator’s BIOS page first. Confirm the required filename, folder, region, and checksum. If the instructions require a dump from your console, create that dump from your own hardware rather than downloading a replacement.
“The image loads but the game crashes”
Check whether the format is supported for that platform, whether the dump is complete, and whether the game revision or region matches the emulator’s compatibility notes. Dolphin’s format list, for example, applies to its supported GameCube and Wii workflows, not to unrelated systems.
Recommended Free Tools
“I own the disc, so can I use a download?”
Ownership of the disc does not establish that an unauthorized download is lawful. Use the project’s documented dump path or obtain the title through an authorized channel when available.

“The game’s servers are gone”
Server shutdown may be relevant to a narrowly defined exemption, but it is not a blanket permission to bypass protections. Compare the facts of your title and purpose with the current text of 37 C.F.R. § 201.40; institutional preservation provisions cannot be claimed by an ordinary personal user.
“Can I share my dump with a friend?”
Creating a file for your own setup and distributing a copy are different acts. Do not upload or transfer the image unless a separate license or legal authority permits distribution.
What is not settled by these federal sources
The statutes and regulations cited here are U.S. federal materials. They do not answer every state-law or contract issue, every platform’s terms of service, or the legality of a particular protection-bypass technique. They also do not establish the rules in Canada, the United Kingdom, the European Union, or any other country. If you are outside the United States, consult the law where you live and the terms attached to the game and platform.
Quick wins for a faster PC:
Clear out junk files and repair common Windows errorsFree Scan →Fix the driver behind crashes, sound loss and screen glitchesFind Drivers →Repair Windows errors before they cause bigger problemsFix Now →For preservation work, the Library of Congress maintains a Recommended Formats Statement for software and video games. That resource can help with preservation-oriented format choices, but it is not a personal license to copy or circumvent a game.
A practical rule of thumb
Keep three records: proof of lawful acquisition, the emulator’s current file and BIOS instructions, and the provenance of every image or system file. If any step depends on an unauthorized download or on bypassing an access control that does not clearly fit a current exemption, stop and obtain specific legal advice. Emulation software, a personally created game file, and a circumvention act should never be treated as interchangeable questions.
