Is Cryptocurrency Legal in South Korea? Common Questions Answered (2026)

Yes. Cryptocurrency is not generally prohibited in South Korea. South Korea permits people to own and trade virtual assets under a statutory framework, but businesses serving Korean users must meet reporting and anti-money-laundering obligations. The country’s user-protection law does not guarantee a token’s value or reimburse every loss, and tax and transfer rules require separate checks.

What “legal” means for cryptocurrency in South Korea

South Korean law treats cryptocurrency as a regulated virtual-asset activity rather than a blanket-ban subject. The central distinction is between using virtual assets and operating a service for users. An individual can generally hold or trade cryptocurrency, while an exchange, custodian, broker, or other covered virtual-asset service provider (VASP) must comply with reporting, user-protection, and anti-money-laundering requirements.

The Act on the Protection of Virtual Asset Users took effect on July 19, 2024. It establishes rules for virtual-asset users, service providers, market conduct, and unfair trading. It is a conduct and protection framework—not a promise that cryptocurrency is a safe investment, that deposits are insured in every situation, or that losses will automatically be repaid.

Can South Korean residents legally buy Bitcoin or other cryptocurrency?

Generally, yes. The law does not make owning or trading Bitcoin and other covered virtual assets a criminal activity simply because the asset is digital. A resident still needs to follow the account, identity, payment, and transaction rules of the service used. Those practical rules can differ by provider and can change when regulators update reporting or transfer requirements.

Legality of the asset itself also does not validate every promotion, token sale, investment scheme, or trading practice. Fraud, market manipulation, misleading disclosures, and other conduct can fall under separate laws. The virtual-asset statute specifically adds market-conduct obligations and restrictions on unfair trading.

Does the user-protection law guarantee my crypto investment?

No. The Act requires covered providers to meet user-protection and market-conduct duties, but it does not guarantee that a token will retain value. Cryptocurrency prices can fall to zero, a project can fail, and a user can lose money through an unauthorized transfer, fraud, theft, or an error outside a provider’s reimbursement obligations.

Read the law as a framework for how providers must operate and how abusive trading can be addressed. Do not treat a provider’s reported status as an endorsement of a particular coin or as insurance against market losses.

Can a foreign exchange serve people in South Korea?

A provider cannot assume that Korean requirements disappear because it is incorporated outside the country. The Financial Services Commission (FSC) says foreign providers conducting domestic-facing business for Korean users are subject to the applicable reporting regime. A Korean-language website, a downloadable app, or the ability to create an account does not by itself prove that a provider is properly reported.

For a Korean resident or foreign national in Korea, eligibility is a separate operational question. A provider may require a particular residence, identity document, phone number, bank relationship, or source-of-funds information. Those requirements are contractual and compliance controls; they do not change the underlying rule that a foreign provider serving Korean users may have Korean reporting duties.

How to check whether a crypto provider is properly reported

Check the provider’s current status through official Financial Intelligence Unit (KoFIU) channels before depositing money. The FSC reported 28 properly reported virtual-asset service providers in its notice dated June 24, 2026. That is a dated count, not a permanent total. New registrations, cancellations, suspensions, and enforcement actions can change the status after that notice.

  1. Identify the legal entity. Record the exact company name that operates the exchange, custody service, or brokerage—not only its trading brand or web address.
  2. Check KoFIU’s current reported-provider information. Match the legal entity, not merely a similar name or a local-language translation.
  3. Confirm the service covered by the report. A company may report one activity while a related affiliate, wallet product, or derivatives service is outside that scope.
  4. Read the provider’s Korean-user terms. Look for identity verification, withdrawal controls, supported bank arrangements, and transfer restrictions.
  5. Save the result and the date. A provider’s status can change, so retain the official record you relied on when opening or funding the account.

The FSC has warned that unreported providers may not have required user-asset and anti-money-laundering safeguards. It also warns that losses involving such operators may be difficult to recover. Published investigation lists are not necessarily exhaustive, so absence from a particular warning list is not proof of compliance.

What happens if an exchange is not reported?

An unreported operator may still appear accessible, accept deposits, or market to Korean users. Those facts do not establish lawful operation. The practical risks include weaker segregation or custody controls, inadequate customer identification, limited transaction monitoring, and fewer realistic recovery avenues if withdrawals stop.

Do not send additional funds merely because an operator promises to complete registration later. Preserve account records, transaction hashes, messages, and payment evidence if you believe an operator is unreported or has blocked withdrawals. Contact the relevant Korean authorities or a qualified legal adviser about a specific loss; the general framework does not guarantee recovery.

What are the South Korean tax rules for crypto?

Tax treatment is separate from whether cryptocurrency is legal. National Tax Service (NTS) guidance reviewed in 2026 schedules taxation of covered income from transferring or lending virtual assets beginning January 1, 2027. Because that start date is in the future as of October 2026, check the current NTS guidance and any enacted amendments before filing or restructuring transactions.

Item Scheduled rule in the NTS guidance reviewed in 2026
Effective date January 1, 2027
Annual basic deduction 2.5 million won
Rate described in the guidance 20%
Calculation concept Transfer or lending proceeds minus acquisition cost and related expenses, subject to special cost-basis rules
Reporting timing Annual reporting during the May period following the relevant year
Netting Annual netting is described in the guidance

The deduction and rate apply to the scheduled regime described by the NTS; they should not be applied automatically to every type of token-related receipt. Lending, transfers, staking-like arrangements, mining, employment compensation, business income, and cross-border activity can raise different classification questions. Keep acquisition records, fees, wallet transfers, lending statements, and exchange reports so the cost basis and proceeds can be reconstructed.

If you have multiple wallets, overseas accounts, corporate activity, or incomplete historical records, a South Korean tax professional familiar with virtual assets may help. Professional advice is not required for every trader, but complex or cross-border records can make the filing position difficult to determine from a trading app alone.

What changed for crypto transfers and anti-money-laundering controls in 2026?

On August 11, 2026, the FSC announced changes affecting VASP registration and virtual-asset transfer monitoring. The announcement distinguishes the commencement dates: registration-rule changes took effect on August 20, 2026, while other measures take effect six months after promulgation.

Transfers between registered VASPs

The travel-rule coverage between registered VASPs expands from transfers of KRW 1 million or more to transfers of all amounts. A transfer below the former threshold therefore cannot be assumed to avoid identity or information-sharing checks.

Transfers involving overseas providers or wallets

Transfers involving overseas providers or wallet services are handled under risk-based conditions. The FSC announcement says high-risk transfers are prohibited, and transfers of KRW 10 million or more to overseas providers or wallet service providers are to be reported to KoFIU under the announced changes.

The exact operational result can depend on the sending provider, receiving service, destination, risk rating, and whether the destination can supply required information. Before initiating a transfer, read the provider’s current notice and confirm whether the destination wallet is accepted. Do not assume that a self-hosted wallet, foreign exchange, or small test payment is automatically exempt.

What information will an exchange ask for?

Expect customer-identification and transaction-monitoring controls. Depending on the provider and transaction, these can include legal name, identity document, residence information, phone verification, bank details, source-of-funds questions, beneficiary information, and wallet ownership or destination details.

  • Use the same legal identity across the account and supporting documents.
  • Keep records explaining large deposits, withdrawals, and transfers between your own wallets.
  • Check whether the provider pauses withdrawals while reviewing a destination or source of funds.
  • Do not split a transfer solely to evade a threshold; that pattern can trigger additional scrutiny.

Can foreigners use cryptocurrency exchanges in Korea?

There is no blanket rule in the supplied framework that makes every foreign national ineligible. In practice, a foreigner’s access depends on the provider’s customer-identification policy, residence and banking requirements, and the service’s ability to comply with Korean reporting rules. A person temporarily visiting Korea may face different onboarding requirements from a resident with a Korean address and qualifying bank account.

Before depositing, ask the provider whether it accepts your nationality and residence, which identity documents it requires, how withdrawals are paid, and whether transfers to your intended overseas service are supported. Availability in an app store is not a legal determination.

Practical compliance checklist before buying or transferring crypto

  • Confirm that the provider’s legal entity is currently reported through KoFIU information.
  • Read the provider’s Korean-user terms and withdrawal policy.
  • Complete identity verification truthfully and retain submitted records.
  • Record the acquisition date, quantity, price, fees, wallet address, and transaction hash for every purchase or transfer.
  • Check the destination wallet or overseas provider against the sending provider’s current risk and travel-rule requirements.
  • Review the NTS timetable before January 1, 2027, and retain records needed to calculate proceeds, cost, and expenses.
  • Use a qualified adviser for corporate, lending, inheritance, or cross-border situations that do not fit a simple personal trade.

Common mistakes to avoid

Confusing access with compliance

A functioning website or successful deposit does not prove that the operator is reported or that a particular product is permitted for Korean users.

Treating regulation as a price guarantee

User-protection obligations address provider conduct and unfair trading; they do not remove market, technology, custody, or project risk.

Waiting until filing season to reconstruct records

Exchange exports can disappear, wallet histories can span multiple networks, and cost-basis rules can require information from an earlier purchase. Capture records as transactions occur.

Assuming old transfer thresholds still apply

The FSC’s 2026 announcement expands the travel rule to all amounts between registered VASPs and adds conditions for overseas transfers. Provider instructions should be checked at the time of each transfer.

Bottom line for South Korea in 2026

Cryptocurrency is legal to own and trade in South Korea in the general sense that it is not prohibited. The risk lies in assuming that every exchange, wallet service, token activity, or transfer is automatically compliant. Use a provider whose current reported status can be verified with KoFIU, understand that the July 2024 user-protection law is not investment insurance, follow the provider’s identity and transfer controls, and prepare for the scheduled virtual-asset tax regime beginning January 1, 2027.
