A vehicle advertised as a 4000W e-bike with a 45 mph top speed is outside the federal low-speed electric bicycle definition and the PeopleForBikes model three-class definition. That does not, by itself, establish its exact legal category everywhere: check the rules where you intend to ride before taking it on a public road, path, or trail. The power and speed figures here are advertised specifications, not independently verified performance.
Does a 4000W, 45 mph vehicle fit the usual e-bike definitions?
No, not under the two definitions discussed here. Federal law defines a specific “low-speed electric bicycle” category for a consumer-product purpose. It requires fully operable pedals, a motor below 750 watts, and a motor-only maximum speed below 20 mph on a paved, level surface with a 170-pound operator. A vehicle advertised at 4000W and 45 mph falls outside those stated limits.

PeopleForBikes’ model three-class definition also describes motors of 750 watts or less. Its classes have assistance cutoffs of 20 mph for Class 1 and Class 2, and 28 mph for Class 3. A vehicle advertised at 4000W and 45 mph does not fit that model definition. The model is not a nationwide determination of law: states and localities can adopt different rules.
| Definition or claim | Power condition | Speed condition | What it means for the advertised vehicle |
|---|---|---|---|
| Federal low-speed electric bicycle definition (15 U.S.C. § 2085) | Motor below 750W | Motor-only speed below 20 mph on a paved, level surface with a 170-pound operator | The advertised 4000W and 45 mph figures are outside these limits. |
| PeopleForBikes model three-class definition | Motor of 750W or less | Class 1 and 2 assistance cuts off at 20 mph; Class 3 pedal assistance cuts off at 28 mph | The advertised figures do not fit this model definition; its use in law depends on jurisdiction. |
| Vehicle advertisement | 4000W claimed; whether peak or continuous is not established | 45 mph claimed; measurement method is not established | These claims alone do not establish the vehicle’s legal category or verified performance. |
The federal provision is not a rule that every e-bike everywhere must stay below 750W, nor does it settle every public-road question. It defines a particular low-speed category for the purpose stated in the statute. Likewise, do not call a high-power vehicle Class 1, 2, or 3 based only on its marketing or the seller’s use of “e-bike.”

Is a 4000W e-bike street legal?
There is no single nationwide answer based on the specifications alone. The cited definitions show that the advertised vehicle is outside those e-bike frameworks, but they do not establish whether a particular make and model is legally classified as a motorcycle, moped, another motor vehicle, or something else in a given place. The rider’s location, the vehicle’s actual configuration, and local law matter.
Before buying or riding, contact the motor-vehicle agency responsible for the place where the vehicle will be used and check the current state and local code. Confirm:

- How that jurisdiction classifies the exact vehicle and whether its pedals, motor, power rating, and maximum speed affect the classification.
- Whether a driver’s license, registration, title, insurance, or a particular plate is required.
- Which equipment rules apply, such as lights, brakes, mirrors, or other required safety equipment.
- Whether the vehicle may be used on the intended roads, bike lanes, shared paths, or trails.
Ask about the exact make, model, and configuration rather than relying on a generic “e-bike” label. If the seller cannot establish whether the 4000W figure is peak or continuous power, or how the 45 mph figure was measured, those details remain unresolved and may matter to a regulator’s classification.
What does the “safety review” establish—and what does it not?
No product-specific testing or certification is established for the advertised vehicle. There is no verified make or model, independent speed measurement, stopping-distance test, crash test, or vehicle-specific safety certification in the information available here. The 45 mph claim should not be treated as evidence that the vehicle can stop, turn, or protect its rider safely at that speed.

The U.S. Consumer Product Safety Commission (CPSC) provides general micromobility guidance, not a safety assessment of this vehicle or an endorsement of riding it at 45 mph. CPSC says, “Always wear a bicycle helmet when riding to protect your head.” That general recommendation does not establish that a bicycle helmet is adequate for this vehicle category or speed; check the applicable equipment requirements and seek guidance appropriate to the vehicle’s actual classification.
CPSC’s general riding guidance also advises riders to follow local traffic laws, keep both hands on the handlebars and items off them, slow down and lean back when approaching bumps, and never ride under the influence of alcohol or drugs. Those precautions do not turn a high-speed vehicle into a legal or safe bicycle.

How should you handle the battery and charger?
CPSC advises following the manufacturer’s charging instructions, staying present while charging, unplugging the device when charging is finished, and using only the charger supplied with the device or one the manufacturer recommends. Do not substitute a charger because its connector fits: the charger must be approved for that particular device.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsFor a replacement or secondary battery, CPSC advises using only one tested and approved to work safely with the device and confirmed as suitable by its manufacturer. Avoid modified or reworked battery packs and repurposed or used cells.
In a September 5, 2024 release, CPSC said it had received 156 reports of fire and thermal incidents involving “universal” micromobility chargers from January 1, 2023 through May 16, 2024. These are reports received during that period, not an estimate of the chance that a particular charger or ride will cause a fire.
In a December 20, 2022 release, CPSC reported receiving at least 208 micromobility fire or overheating incident reports from 39 states from January 1, 2021 through November 28, 2022, with at least 19 associated fatalities, including three associated with e-bikes. These agency-received reports describe incidents in that period; they are not a per-ride risk estimate.
Quick Recap
What should you verify before riding?
- Get the vehicle’s specifications. Ask the manufacturer or seller to document the motor’s continuous and peak ratings, the speed measurement conditions, whether the vehicle has fully operable pedals, and its intended legal category.
- Check the law where you will ride. Confirm classification, licensing, registration, insurance, equipment, and access rules with the relevant motor-vehicle agency and local authority. Do this for each jurisdiction in which you plan to use it.
- Confirm the safety equipment and operating limits. Follow the manufacturer’s instructions and the requirements for the vehicle’s actual classification; do not infer that ordinary bicycle equipment or rules cover a 45 mph machine.
- Verify charger and battery compatibility. Use the manufacturer-supplied or recommended charger and only batteries approved by the device manufacturer.
- Do not rely on the advertised top speed as a safety measure. The available information does not establish tested stopping distance, handling, or crash protection for this vehicle.
