IRCTC ordered to deposit ₹50.4 crore over Rail Neer GST benefit dispute

The Delhi principal bench of the Goods and Services Tax Appellate Tribunal (GSTAT) has directed Indian Railway Catering and Tourism Corporation (IRCTC) to deposit ₹50,41,44,461—about ₹50.4 crore—for allegedly not passing a GST-related price benefit on Rail Neer packaged drinking water to consumers. The order covers supplies made from 1 July 2017 to 31 May 2020.

What the GSTAT order concerns

The case is an anti-profiteering dispute, not a finding that Rail Neer water was unsafe or defective. The Directorate General of Anti-Profiteering (DGAP) examined whether IRCTC retained a tax benefit that should have reduced the price charged through its supply chain after GST took effect.

GSTAT accepted the DGAP calculation and ordered the amount to be deposited in consumer-welfare funds. IRCTC’s exchange disclosure says the sum carries 18% interest. It is to be divided equally between the Central Consumer Welfare Fund and state consumer-welfare funds according to the state-wise calculation.

Why Rail Neer’s ₹15 MRP became central

Rail Neer’s printed maximum retail price was ₹15. IRCTC says that price was fixed by Railway Board Commercial Circular 72 of 2012, before GST, and describes the product as being in a “controlled price segment.”

The complaint alleged that GST reduced the relevant tax incidence but that the ₹15 MRP stayed unchanged, so the benefit was not passed to buyers. IRCTC argued that it could not alter a Railway Ministry-controlled printed MRP and that it supplied Rail Neer mainly to railway departments and licensees rather than selling directly to passengers.

The tribunal drew a distinction between the printed MRP and IRCTC’s transfer price. As reported in the decision, IRCTC “could not alter the MRP” but “was required to reduce the transfer price to pass on the tax benefits to consumers.” In other words, the tribunal treated the price charged between IRCTC and its institutional or licensed buyers as the point at which the benefit could have been passed through, even if the bottle label remained ₹15.

What changed under GST

IRCTC’s filing cited a pre-GST combined excise-duty and VAT incidence of 24% and an 18% GST rate for the post-GST comparison. The anti-profiteering analysis considered whether the lower tax burden should have reduced the company’s net price or transfer price.

The order does not say that every ₹15 bottle should automatically have carried a new printed MRP. Instead, it applies the statutory anti-profiteering principle to the amount retained within the supply chain during the investigated period.

IRCTC’s “25% cheaper” defence

IRCTC maintained that Rail Neer was priced about 25% below competing packaged-water brands. It also said its base price reflected higher raw-material, electricity, labour and freight costs, and that the product’s subsidised public-service role should be considered.

That 25% figure is IRCTC’s comparative-price assertion reported in the proceedings, not an independently verified market survey. GSTAT rejected the argument that a lower overall market price or public-service pricing created an exemption from passing on a tax benefit. The tribunal’s approach focused on the GST effect and the transfer price rather than only on Rail Neer’s position against rival bottles.

Rail Neer and rival bottled water: what can—and cannot—be compared

Comparison point Rail Neer case What the record establishes about rivals
Printed MRP ₹15, fixed through Railway Board Commercial Circular 72 of 2012 Not stated in the case record
Tax figures used 24% pre-GST combined excise/VAT incidence cited by IRCTC; 18% GST cited for the post-GST comparison Not stated
Relative price IRCTC claimed about 25% below competing packaged-water brands No independent market survey is established by the reported order
Distribution Railway departments, licensees and railway-linked channels Rivals generally use open retail channels, but a like-for-like price including onboard or service components is not established here
Disputed calculation Whether the GST benefit was passed through the transfer price Not part of this proceeding

Where the ₹50.4 crore is supposed to go

The ordered deposit is earmarked for consumer-welfare funds rather than a payment to individual passengers. IRCTC’s disclosure specifies an equal split between the Central Consumer Welfare Fund and relevant state funds, using the state-wise calculation in the case. The precise principal is ₹50,41,44,461; “₹50.4 crore” is the rounded figure.

IRCTC says an additional 10% penalty applies if the amount is not deposited within 30 days. The disclosure also says the company is preferring an appeal, so the eventual outcome can depend on further proceedings and any orders that affect enforcement.

Does this mean passengers paid ₹15 after GST?

It means the printed bottle price remained ₹15 during the period examined. The tribunal did not require a claim that every passenger personally overpaid by a fixed amount. Its finding was that IRCTC should have passed the tax benefit through the transfer price even though the Railway Ministry controlled the label price.

Actual prices could also vary by channel, contract and service arrangement. The reported order addresses the anti-profiteering calculation for IRCTC’s supplies from 1 July 2017 to 31 May 2020, not a universal price rule for every Rail Neer transaction today.

What happens next

  1. IRCTC is required to comply with the deposit direction, including the specified 18% interest.
  2. If payment is not made within 30 days, the disclosure says a further 10% penalty applies.
  3. IRCTC is pursuing an appeal, which may challenge the calculation, the treatment of the transfer price or the remedy.
  4. Any later court or appellate order could change the amount payable or the timing of recovery.
