Insurance Claim Denials Explained: Common Reasons, Deadlines, and Consumer Rights

A denied insurance claim means the insurer has decided not to pay all or part of what you submitted. Do not treat the denial as the end of the matter. Treat it as a checklist: identify the stated reason, compare it with your policy or health-plan documents, correct factual or coding errors, and use the appeal or review route printed in the notice.

Health-plan appeals often have federal timing floors, while auto and homeowners deadlines depend mainly on state law and the policy. The controlling date may be when you received the denial, when the insurer received a complete claim, or another event specified in the policy or law. Preserve proof of every submission and never assume that filing a regulator complaint extends an appeal deadline.

What a denial notice tells you

Read the entire denial letter and any explanation of benefits (EOB), not just the first paragraph. A useful notice should identify the claim, the amount at issue, the reason for the decision, the policy or plan provision used, and the procedure and deadline for challenging it. Health-plan notices should also explain internal appeal rights, external-review rights when available, and whether a Consumer Assistance Program can help.

Record the claim number, date you received the notice, date of service or loss, amount denied, exact wording of the reason, cited policy section, appeal address, required form, submission method, and deadline. Keep the envelope, portal timestamp, email header, or other evidence showing when the notice arrived. Those details can determine whether an appeal is timely.

NAIC consumer guidance puts the first reaction plainly: “If a claim is denied, don’t panic.” A denial is a decision to challenge or correct, not proof that the insurer’s interpretation is automatically right.

Why insurance claims are denied

Administrative or coding errors

Simple data problems can cause a claim to be rejected even when the underlying service or loss is covered. Examples include a wrong member or policy number, an incorrect diagnosis or procedure code, a misspelled name, duplicate billing, a coordination-of-benefits mismatch, or sending the claim to the wrong insurer. NAIC says some coding and routing errors can be fixed with a phone call or a corrected submission.

Ask the provider, repairer, agent, or billing office to verify every identifier against the insurance card and policy. Request a corrected claim or resubmission in writing, and ask for the confirmation number. A corrected claim is not the same as an appeal; if the notice gives an appeal deadline, protect that deadline while the correction is being processed.

Missing or incomplete information

An insurer may suspend or deny a claim because it lacks records, invoices, photographs, proof of ownership, medical notes, an accident report, or a required form. The NAIC model notice explains that a claimant or provider may resubmit information needed to complete a claim.

Make a document list from the denial. Send each item in one organized package, identify the claim number on every page, and keep a complete copy. If a provider or contractor must supply a record, ask the insurer to note that the material is pending rather than closing the claim while you obtain it.

Coverage, exclusion, limit, or deductible disputes

A denial may rest on a coverage exclusion, a waiting period, a benefit limit, a deductible, a policy condition, or the insurer’s interpretation of what the contract covers. Compare the denial with the full policy, certificate, evidence of coverage, endorsements, declarations page, Summary of Benefits and Coverage when applicable, and the definitions section. A short denial phrase such as “not covered” is not enough to evaluate the decision; locate the exact provision and how the insurer applied it to your facts.

Check whether the amount at issue is actually below a deductible or subject to a sublimit rather than completely excluded. Ask the insurer to explain the calculation in writing, including the covered amount, deductible, depreciation, coinsurance, and any remaining limit.

Medical-necessity and other clinical judgments

Health plans can deny care as not medically necessary, inappropriate, ineffective, experimental, investigational, or delivered in the wrong setting or level of care. Centers for Medicare & Medicaid Services (CMS) identifies these as decisions that may qualify for external review in eligible plans. The appeal should address the clinical rationale with records and a treating clinician’s explanation of why the requested service meets the plan’s criteria.

Late notice, late filing, or another policy condition

Policies may require prompt notice of a loss, proof of loss by a stated date, cooperation with an investigation, or submission of a claim within a specified period. Whether a late notice defeats coverage depends on the exact policy, state law, prejudice to the insurer, and the facts. Do not assume a generic “30-day” or “one-year” rule applies. Explain the reason for any delay, provide proof that notice was given, and ask what cure or appeal procedure remains available.

Deadlines: health plans versus auto and homeowners insurance

Claim type Typical or example timing What controls
Health, urgent-care internal appeal 72 hours for an eligible urgent-care appeal Applicable federal rule, state rule, and plan document; eligibility varies
Health, care not yet received 30 days for a typical internal-appeal decision CMS/NAIC guidance figures for covered plan contexts; plan terms and state rules control
Health, care already received 60 days for a typical internal-appeal decision CMS/NAIC guidance figures for covered plan contexts; plan terms and state rules control
Health, filing an internal appeal Commonly 180 days (six months) after receiving the denial Notice, plan document, applicable state or federal rule
Health, external review Generally 60 days after a final internal denial; some states or plans allow longer Plan type, state law, eligibility, and the notice
Auto or homeowners No single nationwide deadline State law, policy wording, claim type, and facts
Texas example for auto/property Generally acknowledge within 15 days; after needed information, generally approve, deny with reasons, or explain delay within 15 business days; approved claims generally paid within five days after approval Texas rules, with exceptions and disaster-related extensions; these figures are not a national rule

Deadlines are not interchangeable. A plan’s internal-appeal deadline is different from the time to request external review, and a property policy’s suit-limitation clause may be different from the time to report a loss. Follow the shortest applicable deadline while you verify the controlling rule.

Urgent health-care cases

Ask the insurer and your doctor for expedited internal or external review when delay could seriously jeopardize life, health, or the ability to regain maximum function. State the medical risk, the treatment date, and why a standard review would be unsafe. Ask the plan which documents and phone number it requires for expedited handling.

The NAIC model-notice framework

The NAIC model notice provides a comparison framework rather than a universal rule: 180 days to appeal, 60 days for the carrier’s written decision, four months to request external review, and 45 days for a standard external-review decision. State law and plan terms can provide different periods, so use the actual notice and governing documents for your case.

How to appeal a denied health-insurance claim

  1. Identify the decision. Determine whether it is a claim denial, a prior-authorization denial, a reduction in requested care, or a rescission. The category can determine which review route applies.
  2. Verify eligibility and the clock. Confirm coverage on the date of service, note when you received the notice, and calendar the internal-appeal deadline and any separate external-review deadline.
  3. Correct administrative errors first. Check member numbers, provider identity, diagnosis and service codes, dates, duplicate billing, coordination of benefits, and whether the claim went to the correct insurer. Request a corrected claim, but submit a protective appeal if the deadline could pass.
  4. Build the clinical and contractual record. Include the denial and EOB, policy or evidence of coverage, Summary of Benefits and Coverage when applicable, medical records, test results, treatment history, invoices, and a detailed letter from the treating clinician. Ask the clinician to address the plan’s specific medical-necessity criteria rather than merely stating that treatment is needed.
  5. Follow the notice’s filing instructions. Use the required form, address, portal, fax number, or email. Explain exactly why the decision conflicts with the plan language or facts, identify each attachment, and request a written decision.
  6. Preserve delivery proof. Save a portal receipt, fax confirmation, certified-mail receipt, or email delivery record. Keep the submitted packet in the same order as the attachment list.
  7. Request external review when eligible. External review commonly applies to denials based on medical judgment or experimental or investigational determinations, subject to plan and state eligibility rules. The notice should explain how to apply and whether the reviewer is independent.

CMS describes the Affordable Care Act as ensuring a right to appeal health-plan decisions, but federal appeal rules do not automatically govern every health plan or every insurance product. Employer plans, government plans, grandfathered arrangements, and state-regulated coverage can have different procedures.

What to do after an auto or homeowners denial

  1. Read the policy and denial together. Locate the insuring agreement, exclusions, endorsements, conditions, deductibles, limits, depreciation provisions, and any appraisal or mediation clause.
  2. Separate coverage from valuation. A coverage denial says the loss is not insured; a valuation dispute concerns the amount owed. The evidence and remedy differ. Ask the adjuster to state which issue is being decided.
  3. Document cause and damage. Gather photographs and video, repair estimates, invoices, receipts, inventories, maintenance records, weather or police reports, expert opinions, and proof of ownership. Preserve damaged property when safe, or photograph it before emergency disposal.
  4. Answer every stated reason. If the insurer alleges late notice, explain when and how notice was given. If it cites an exclusion, address the exact wording and any exception or ensuing-loss provision. If it disputes causation, provide dated photographs, contractor or engineer findings, and a timeline.
  5. Use the policy’s dispute process. Submit a written reconsideration or appeal if offered. For valuation disputes, determine whether appraisal, mediation, or an umpire process is available and what notice starts that procedure.
  6. Check state deadlines immediately. Ask your state Department of Insurance about claim-handling and suit-limitation rules, but continue complying with the policy while seeking help.

Texas timing as a concrete example

Texas generally requires an insurer to acknowledge a property or auto claim within 15 days. After receiving the information needed to decide it, the insurer generally has 15 business days to send an approval, a denial with reasons, or a notice explaining delay. An approved claim is generally paid within five days after the approval notice, subject to exceptions and disaster-related extensions. These are Texas figures, not a nationwide standard; other states may use different periods and definitions.

Evidence that makes an appeal stronger

Organize the file chronologically and create an index. Include the policy or plan document, denial notice, EOB, invoices, receipts, medical records, photographs, repair estimates, correspondence, and notes of every call. For each conversation, record the date, representative’s name or identification number, promises made, and any reference number.

An optional insurance-claim organizer binder can keep originals, copies, a deadline calendar, and a submission log together. It is only a filing aid; it cannot change coverage, extend a deadline, or guarantee an overturned denial. Send copies unless the insurer specifically requires an original.

Use a short appeal structure: identify the claim; quote the denial reason; state the decision you want; explain the policy or plan language; connect each fact to that language; list attachments; and request a written response. Avoid unsupported accusations and keep the focus on evidence and the contract.

When and how to involve regulators or a lawyer

Every state, the District of Columbia, and five U.S. territories have an insurance department. NAIC consumer resources can direct you to the appropriate department. A regulator may explain procedures and investigate regulated conduct, but it cannot rewrite a policy or guarantee payment. A complaint is a separate track from an appeal and does not automatically pause or extend an appeal deadline.

File the insurer’s appeal first when possible, then provide the regulator with the denial, policy, appeal, response, and delivery proof. For a large loss, a threatened cancellation, a short suit deadline, a serious medical risk, or a dispute involving complex exclusions, consult a licensed insurance attorney or an authorized consumer-assistance service promptly. Ask about fees, conflicts, jurisdiction, and whether representation will affect settlement or appraisal options.

California consumer-rights example

California Department of Insurance consumer guidance states: “You have the right: To receive an explanation of your insurer’s grievance and appeal procedures.” Other states describe similar rights differently, so request the written procedure that applies where your policy is regulated.

What complaint statistics can—and cannot—show

NAIC’s confirmed-complaint report for 2019 recorded 3,487 claim-handling-denial complaints, 14.05% of all listed reasons as of May 30, 2019; 4,314 unsatisfactory-settlement-or-offer complaints, 17.39%; and 4,074 claim-delay complaints, 16.42%. NAIC cautions that states submit data voluntarily and that not all states provide every category. These historical counts are not a current national denial rate and cannot predict the result of an individual claim.

Common mistakes that weaken a claim challenge

  • Waiting for a phone promise instead of filing the written appeal by the stated deadline.
  • Sending documents without the claim number or without keeping a complete copy.
  • Arguing that a loss is “unfair” without identifying the policy provision or factual error.
  • Confusing a deductible or limit with a total exclusion.
  • Assuming a regulator complaint replaces an appeal or lawsuit.
  • Using health-plan deadlines for auto or homeowners claims, or using a state example as if it were national law.
  • Failing to request expedited review when a medical delay creates a serious risk.

The practical sequence is consistent across claim types: read the notice, find the controlling language, correct fixable errors, assemble proof, file through the stated route, and escalate before the applicable deadline expires.
