Input tax credit (ITC) and a GST refund are not the same thing. ITC is eligible GST recorded in a registered business’s electronic credit ledger and used against tax liabilities, subject to the law. A refund is a separate claim for repayment. An unused ledger balance does not, by itself, give a business a right to cash: refund of unutilised ITC is allowed only in specified circumstances and through the prescribed process.

This is a general explanation of India’s central GST framework, including relevant IGST provisions. Whether a particular claim is allowed depends on the taxpayer, supply, period, applicable notifications and current rules.

What is the difference between ITC and a GST refund?

Question Input tax credit Input tax refund
What is it? Eligible input tax credited to a registered person’s electronic credit ledger. A claim under GST refund provisions for repayment of a refundable amount, which may include unutilised ITC in specified cases.
What does it do? May be used as credit toward GST liabilities, subject to applicable rules. May result in repayment after the applicant meets the relevant legal conditions and completes the claim process.
Does an unused balance automatically become cash? No. A ledger balance alone does not establish a right to a refund. No. The claim must fall within a permitted refund category and satisfy its conditions.
Examples Credit claimed on eligible business inputs and recorded in the ledger. Qualifying zero-rated supply claims, inverted-duty accumulation, or other statutory refund grounds.

The distinction follows the CGST Act, the GST rules, the IGST Act and the payment rules. The cited CGST Act PDF is updated to 2021; check for later amendments and applicable notifications before relying on a provision for a live claim.

Can a business claim a refund of its GST ITC balance?

Not simply because the balance is unused. Section 54(3) of the CGST Act restricts refunds of unutilised ITC to defined cases, including qualifying zero-rated supplies and qualifying accumulation caused by an inverted duty structure. The provision also contains exclusions. A balance that cannot currently be used is not, for that reason alone, refundable.

Other GST refund claims may concern tax, interest or another amount paid. Those claims are distinct from a refund of unutilised ITC, and their eligibility and relevant-date rules can differ. Do not apply one deadline or evidence list to every type of claim; identify the category and period first.

When can a business get a refund of unutilised ITC?

Qualifying zero-rated supplies

Under the IGST Act, zero-rated supplies include exports and supplies to an SEZ developer or unit. Subject to conditions and safeguards, the Act describes two routes:

  1. Supply without payment of IGST under bond or letter of undertaking (LUT): the claim is for refund of unutilised ITC.
  2. Supply on payment of IGST: the claim is for refund of the IGST paid, subject to the applicable conditions and procedure.

These are distinct options, not routes to combine freely for the same supply. The first seeks repayment of eligible accumulated credit; the second seeks repayment of tax paid on the supply. Paying IGST upfront can affect cash flow differently from exporting under bond or LUT, but eligibility and documentation depend on the applicable rules. See section 16 of the IGST Act.

Qualifying inverted-duty accumulation

A business may be able to claim unutilised ITC where credit accumulates because the tax rate on inputs is higher than the rate on output supplies. This route is subject to statutory exclusions and notified exceptions; an apparent difference between input and output rates does not by itself settle eligibility.

The rules cap the maximum refund using this formula:

Maximum Refund Amount = (Turnover of inverted-rated supply of goods and services × Net ITC ÷ Adjusted Total Turnover) − tax payable on that inverted-rated supply of goods and services

“Net ITC,” the relevant period and the turnover measures have rule-defined meanings. The formula is a limit, not a promise that the entire ledger balance will be paid. A real calculation needs period-specific figures and the applicable rule definitions. See the refund formula in the CGST Rules.

How does a business apply for a GST refund?

CBIC’s refund rules generally provide for electronic filing of Form GST RFD-01 through the common portal. The supporting records and statements depend on the claim category; examples in the rules include shipping bill and invoice details for export goods, invoice and remittance details for export services, and invoice statements for inverted-duty claims. These are examples, not a universal checklist. Export-goods filing is tied in the rule text to delivery of the export manifest or report; SEZ and deemed-export claims have their own evidence and filing conditions.

  1. Identify the legal category. Establish whether the claim concerns unutilised ITC, IGST paid on a zero-rated supply, or another refundable amount.
  2. Check conditions and exclusions for the relevant period. Review the current Act, rules, notifications and any applicable safeguards for the taxpayer and supplies involved.
  3. Prepare category-specific records. Assemble the statements and supporting documents required for that route rather than relying on a generic document list.
  4. File through the prescribed portal process. Follow the current common-portal instructions for Form GST RFD-01 and the relevant claim type.

For unutilised ITC claims, the payment rules provide for debiting the amount claimed from the electronic credit ledger. If the refund is rejected, the rejected amount is re-credited under the stated procedure. The application therefore acts on a ledger claim through a formal process; it does not turn all credit into cash when the balance first appears.

Which exclusions should businesses check?

Section 54(3) does not generally permit refund of unutilised ITC outside its listed cases. It includes an exclusion for exported goods subject to export duty and a restriction involving a supplier’s drawback in respect of central tax or a claim for refund of IGST paid on the supplies. The precise effect depends on the facts and applicable law. CBIC’s sectoral FAQ also describes export-duty and certain export-refund or drawback restrictions, but the statute and rules control.

  • Do not treat every electronic credit ledger balance as refundable.
  • Do not confuse a refund of an amount paid in error or pursuant to an order with a refund of unutilised ITC.
  • Do not assume that export, SEZ or inverted-duty status automatically satisfies every condition.
  • Check the relevant claim period, current notifications and portal procedure; the general limitation and relevant-date rules vary by category.

What should a business verify before filing?

The CGST Act PDF cited here is updated to 2021, and rules, notifications and portal procedures can change. Before making a claim, verify the current statutory text and instructions for the specific taxpayer, supply and period. For a material export, SEZ or inverted-duty claim, a GST professional can help validate eligibility, calculations and supporting records.
