Indiana Social Sportsbooks: Is Social Betting Legal in Indiana?

Indiana does not treat a product as lawful because it calls itself a “social sportsbook.” Whether social betting is legal in Indiana depends on what the product does: whether users risk money or property, whether they can win money or property, how the outcome is decided, who operates the service, and whether that operator holds Indiana authorization. The label alone settles none of these questions.

What Indiana law treats as gambling

The starting point is Indiana Code 35-45-5. The Indiana Gaming Commission (IGC) summarizes unlawful gambling this way: “In Indiana, unlawful gambling is defined by Indiana Code 35-45-5 as risking money or property for gain contingent upon chance, excluding bona fide contests of skill, speed, strength, or endurance.” (Indiana Gaming Commission, Illegal Gambling)

The statutory text, as reproduced in the 2025 Indiana Code on Justia, adds detail. It defines gambling as risking money or other property for gain, contingent in whole or in part upon lot, chance, or the operation of a gambling device. It excludes bona fide contests of skill, speed, strength, or endurance in which awards go only to entrants or entry owners, and bona fide business transactions valid under contract law. It also defines “gain” as the direct realization of winnings. (Indiana Code §§ 35-45-5-1 and 35-45-5-2 (2025), Justia)

No court decision reviewed for this article settles the status of every product marketed as a social sportsbook. The statutory definition and the regulator’s guidance are the reliable baselines until a specific product is examined.

What the regulator says about unauthorized operations

The IGC’s guidance on illegal gambling is direct:

“Any gambling operation not explicitly authorized by the state, such as unlicensed betting pools and unauthorized lotteries, is deemed unlawful.” (Indiana Gaming Commission, Illegal Gambling guidance)

Informal pools that are not run under an authorized framework are named in that sentence. The sentence describes the agency’s position; it is not a court holding on any particular app.

How to test a specific social sportsbook

Because classification turns on mechanics, check a product against the questions below before deciding anything about it. Where a product uses virtual currency, purchase options, cash prizes, or redemption of points, read those terms closely and seek current regulator or legal guidance. Do not infer legality from words such as “social,” “free,” or “sweepstakes.”

Question What to look for Why it matters
What do users pay, buy, or risk? Entry fees, purchased coins or credits, or no payment at all Gambling requires risking money or other property
Can participants win money or property? Cash prizes, cash-out or redemption options, or nonredeemable points only Winning must be a direct realization of gain
How is the outcome determined? Chance, skill, athletic performance, or a mix Chance-based outcomes fall within the core definition; the contest exclusion is narrow
Who operates the service and accepts wagers? An Indiana certificate holder or its vendor, an informal group, or a company outside the state framework Only authorized operators work within the sports wagering channel
Which statutory category applies? IC 4-38 sports wagering, IC 4-33-24 paid fantasy sports, or a product needing separate analysis Each category has its own rules and regulator

Authorized sports wagering: the IC 4-38 channel

The IGC says sports wagering was established by House Enrolled Act 1015-2019 and is contained in IC 4-38. A person holding an IC 4-38 certificate of authority is authorized to conduct sports wagering. Only Indiana casinos, racinos, or off-track betting facilities can receive that certificate. A certificate holder may contract with a vendor to operate a retail or online sportsbook, and the IGC regulates sportsbook operations and approves sportsbook technology.

The IGC’s Sports Wagering and Paid Fantasy Sports page is the program overview. The companion Sports Wagering FAQs was last updated March 26, 2024, so confirm its details against the current IGC pages.

Paid fantasy and other adjacent products

Paid fantasy sports fall under a separate statute, IC 4-33-24, which the IGC administers alongside sports wagering under IC 4-38. These are distinct statutory categories, and approval under one does not carry over to the other.

Penalties

The 2025 Indiana Code, as reproduced by Justia, sets two penalty tiers:

  • A person who knowingly or intentionally engages in gambling commits unlawful gambling, generally a Class B misdemeanor.
  • An operator who knowingly or intentionally uses the Internet to engage in unlawful gambling in Indiana, or with a person located in Indiana, commits a Level 6 felony.

Confirm the current wording on the General Assembly’s official code site before relying on these penalties in legal work. The Justia reproduction itself directs readers to the official Indiana site, and the IGC’s Statutes & Rules index links to the governing sections.

Self-restriction and limit tools

The IGC’s Sports Wagering FAQs (last updated March 26, 2024) describe three options for players who want to limit their play:

MoneyLine Sports Betting Dice - Novelty Gift for Sports Bettors & Gamblers
  • FUN GIFT FOR SPORTS BETTORS - A niche novelty gift for the sports bettor who has everything. Great for birthdays, holidays, stocking stuffers, game day, trips and get-togethers.
  • LET THE DICE DECIDE - When you want some action on a game but do not have a strong pick, roll the dice and leave the decision to chance. A novelty decision-maker, not a betting system.
  • FIVE PURPOSE-BUILT DICE - Includes Home/Away, Moneyline/ATS, Over/Under, Units and a Gimme-All-the-Options combo die that can make the whole pick in one roll.
  • BLACK-AND-GOLD DESIGN - Five 19 mm translucent black dice with engraved gold betting symbols create a distinctive look that stands out from ordinary dice.
  • GIFT-READY SET - Includes all five MoneyLine dice, a black logo drawstring pouch, gold presentation wrap and an illustrated guide explaining what each die and symbol means.
  • Voluntary Exclusion Program: a patron can self-restrict from sports wagering through this program, which also restricts casino gambling.
  • Internet Self-Restriction Program (ISRP): a statewide option for online wagers, with one-year or five-year periods. A patron must request removal after the selected term ends.
  • Operator limits: operators must provide an easy and obvious method to set limits.

Check the current IGC program pages before relying on these terms, since the FAQ predates this article.

Verifying an operator

The IGC’s Sportsbook Contact Information directory, marked current as of July 29, 2026, lists both retail venues and mobile operators. Use it as your first check before trusting an app or site. An operator that does not appear there should be treated as unverified, not as authorized.

A directory listing is a verification route, not a legal opinion on every feature an operator offers. If a product uses a structure outside the categories above, get current regulator or legal guidance before using it.
