An income-tax penalty is a legal sanction for an alleged failure or default; a tax demand is a formal notice stating that an amount has been determined payable. A demand can include a penalty, but the two terms do not mean the same thing. To understand what you owe—or how to challenge it—check the order behind the notice, the amount breakdown, the tax period, and the response deadline.

Penalty and demand perform different jobs

A penalty is imposed under a provision of tax law after the relevant proceedings. It is a sanction tied to an alleged failure or default. A demand communicates an amount that the tax authority has determined payable and tells you how or when to pay or respond.

The amount in a demand may include tax, interest, a penalty, or a combination. So a demand is not itself a penalty, and it is not safe to assume that a demand can never contain one. Read the accompanying order and computation to see what each amount represents.

What to check in the notice and underlying order

The demand notice points back to the order that determined the amount due. For example, the notified Form 103 under section 289 of the Income-tax Act, 2025 says that the sum has been determined payable and that its details are given in the order. Start with that order rather than relying on the word “demand” alone.

  • Period and law: Identify the Tax Year or Assessment Year and the Act cited. A notice issued in 2026 may still concern a period governed by the earlier law.
  • Amount breakdown: Check the calculation for tax, interest, penalty, and any other listed component.
  • Service date and deadline: Record when the notice was served and the payment or response date stated in it.
  • Review and appeal directions: Follow the procedure in the notice and check any stated appeal route.

How to respond to an outstanding demand online

The Income Tax Department’s FAQ says, “In order to confirm if the stated demand is correct, an opportunity is given to you to respond.” For a demand shown on the e-Filing portal, the FAQ directs taxpayers to log in and select Pending Actions > Response to Outstanding Demand. The portal displays the demand status and offers payment or response options.

If you agree and have not paid

Use the portal’s Pay Now route. Check the amount and period before proceeding, and keep the payment confirmation.

If you already paid

Report the payment through the response process and provide the challan details requested by the portal manual. Keep your challan and submission record.

If you disagree fully or partly

Select the applicable listed reason, or choose “Others” and provide details where appropriate. If you dispute only part of the demand, the Department says to pay the undisputed portion. Check the underlying order and the notice’s appeal directions as well; an online response is not a substitute for following any separate statutory appeal procedure.

Before submitting

The portal manual warns that once you submit “Demand is Correct,” you cannot later disagree through that response path. The Department also says that unanswered outstanding demands may be confirmed and adjusted against a refund or shown as payable against your PAN. Check your selection and supporting details carefully: the Department’s e-Proceedings guidance says submitted responses cannot be edited or withdrawn. Retain the submission record.

Which income-tax law applies to a notice issued in 2026?

India’s Income-tax Act, 2025 took effect on 1 April 2026. The Income Tax Department’s transition guidance says the 1961 Act continues to govern pending proceedings and proceedings concerning tax years that began before that date. The new Act uses “Tax Year”; for earlier periods, “Assessment Year” terminology and the 1961 Act remain relevant.

As a result, the notice date alone does not tell you which Act applies. Check the period and statutory provision named in the order and notice. A notice issued after 1 April 2026 can still concern an earlier period governed by the 1961 Act.

What Form 103 says about payment and non-payment

For a demand under section 289 of the 2025 Act, notified Form 103 states that payment is due within 30 days from service, unless a shorter date is specified in circumstances described by the form. It also describes simple interest at 1 percent for each month or part of a month after the stated payment period. These are terms of Form 103; do not assume they apply to every demand, especially one governed by the 1961 Act.

Form 103 also describes possible recovery proceedings and says a further penalty, up to the amount in arrear, may be imposed after a reasonable opportunity to be heard. That possible further penalty is distinct from any penalty already included in the original amount demanded. Use the deadline and directions in your actual notice, and check the law applicable to the tax period.
