Income Tax Appellate Tribunal vs High Court: Which Forum Hears a Tax Dispute?

In India’s ordinary income-tax appeal route, the Income Tax Appellate Tribunal (ITAT) hears an appeal after the first appellate authority; the High Court is generally the next forum, and under section 260A of the Income-tax Act, 1961, an appeal must involve a substantial question of law. Which Act and section numbers apply depends on the tax year and procedural history, because the Income Tax Act, 2025 took effect on 1 April 2026 while specified matters remain governed by the 1961 Act.

How the ITAT and High Court fit into the appeal route

The ordinary sequence is Assessing Officer → Joint Commissioner (Appeals) or Commissioner (Appeals) → ITAT → High Court → Supreme Court. The ITAT is the specialist tribunal stage; the High Court is generally the further appellate forum after an ITAT order. The Income Tax Department describes this as the continuing appellate hierarchy under the 2025 Act, and the ITAT describes itself as a quasi-judicial institution specializing in direct-tax appeals.

The Supreme Court’s 18 August 2022 judgment in Pr. Commissioner of Income Tax 1 v. M/S ABC Papers Limited described the statutory route as a “lineal progression of judicial remedies.” The forums are successive stages, not interchangeable choices for the same appeal.

What is the difference between the ITAT and the High Court?

Where does it sit? After an appeal to JCIT(A) or CIT(A). Generally after an ITAT appellate order.

What opens the next appeal? An ITAT appellate order provides the point from which a qualifying High Court appeal may be brought. Under section 260A of the 1961 Act, the case must involve a substantial question of law.
Which Act governs? Depends on the tax year and procedural status of the matter. Depends on the tax year and procedural status of the matter.

Can you appeal an ITAT order to a High Court?

Under section 260A of the Income-tax Act, 1961, a High Court appeal lies from an ITAT order if the High Court is satisfied that the case involves a substantial question of law. A party’s dissatisfaction with the result, by itself, is not the statutory gateway described in that section.

The Income Tax Department’s official text of section 260A states a filing period of 120 days from receipt of the order being appealed. That is the stated period for this 1961 Act provision; the exact limitation calculation and any issue such as condonation must be checked against the governing law and case record rather than assumed from the general rule.

What happens to appeals under the Income Tax Act, 2025?

The Income Tax Act, 2025 took effect on 1 April 2026. The Income Tax Department says it retains the broad appellate hierarchy and maps Tribunal appeals to sections 361–364, with further High Court and Supreme Court appeals in sections 365–368. The Department’s FAQ puts it this way: “No, there is no structural change in the appellate hierarchy under Income Tax Act, 2025.”

That does not mean every filing made after 1 April 2026 uses the new Act. According to the Department’s transition FAQ, pending proceedings continue and are disposed of under the 1961 Act; proceedings initiated on or after that date concerning tax years beginning before 1 April 2026 are also handled under the repealed Act. Establish the relevant tax year and procedural history before relying on a section number.

How is the ITAT constituted?

Section 255 of the 1961 Act describes the Tribunal’s bench arrangements. A bench ordinarily consists of a judicial member and an accountant member. The section also allows a single member to dispose of specified allotted cases where assessed total income does not exceed ₹50 lakh, and provides for special benches of three or more members with the required member types. These statutory arrangements do not establish that every matter has an identical hearing format.

What to check before deciding which forum applies

  • The relevant tax year, including whether it began before 1 April 2026.
  • The order being challenged and the stage reached in the appeal route.
  • When the ITAT order was received, if considering a section 260A appeal under the 1961 Act.
  • The legal issue said to raise a substantial question of law, along with the jurisdiction and procedural status of the case.

This comparison explains the ordinary route, not whether a particular dispute qualifies for an appeal. For a case-specific answer, the applicable Act, order, jurisdiction, issue, and limitation position must be assessed together.
