Most employers should use automation as bounded support for defined, job-related tasks and keep consequential employment decisions subject to meaningful human review. A reviewer must have the information, competence, time and authority to test the output, identify errors or accommodation issues, and change the result. That is a practical risk-control approach, not a universal rule that a person must personally make every decision. The right choice depends on job validity, discrimination and accessibility risk, reviewer capability, transparency, records and the cost of delay.
What employers should use: bounded automation with accountable review
The useful choice is not simply “human or AI.” Employers should decide what the system is allowed to do, what evidence it may use, and where a trained person must intervene. A tool that schedules interviews or transcribes an interview is materially different from one that ranks applicants, recommends termination or measures worker productivity.

| Approach | Where it can fit | Main exposure | Controls to require |
|---|---|---|---|
| Human-led decision with administrative automation | Scheduling, document organization, transcription or translation of existing text | Errors or inaccessible outputs can still affect who is considered | Check accuracy, accessibility and the boundary between administration and evaluation |
| Automated recommendation with meaningful human review | Early screening, prioritizing a large applicant pool or flagging cases for further review | A reviewer may defer to an unexplained score or miss disparate exclusion | Show job-related evidence, limitations and an override path; monitor overrides and outcomes |
| Automated decision with little or no review | Only low-consequence tasks where errors do not determine employment opportunity and applicable law permits the use | Hidden errors, inaccessible testing, unlawful discrimination and no practical correction route | Document why the risk is low, test the process and provide a way to challenge errors |
| Human-only decision | Cases requiring contextual judgment, accommodation analysis or explanation that the system cannot provide | Inconsistent judgments, fatigue and undocumented discretion | Use structured criteria, train decision-makers and keep an auditable record |
Do not treat a vendor’s audit, a general accuracy claim or a nominal “human in the loop” label as proof that a process is lawful or fair. A person who can only click approve, lacks the underlying evidence or cannot change the result is not providing meaningful review.

Start with the essential job requirements
Write down the essential functions of the job and the particular competency the tool is meant to assess. A selection criterion should be specific, job-related and applied consistently. For example, a test intended to assess written accuracy should not quietly become a proxy for typing speed unless speed is genuinely an essential function and the measurement is validated for that job.

The U.S. Equal Employment Opportunity Commission (EEOC) advises employers to understand a test or selection procedure’s effectiveness and limitations, appropriateness for the job and administration and scoring before implementation. That obligation is practical as well as legal: a system can be technically consistent while measuring an irrelevant trait.
Check for disparate exclusion
Title VII, the Americans with Disabilities Act (ADA) and the Age Discrimination in Employment Act (ADEA) apply to employment tests and selection procedures. A procedure that disproportionately excludes a protected group can create legal risk unless the employer can satisfy the applicable legal standard. Discrimination can arise from the data, the design of the task, the way results are scored or the way managers use the output.
Make accessibility and accommodation operational
Algorithmic tools can disadvantage people with disabilities through inaccessible interfaces, inaccurate evaluation or failure to provide a reasonable accommodation. Employers need a working route for requesting and delivering accommodations before a candidate or employee is screened out. A system that elicits disability-related or medical information improperly creates a separate risk.
Give reviewers real authority
Meaningful review requires a competent person who can understand what the system did, inspect relevant evidence, recognize limitations, intervene and correct the result. The reviewer also needs enough time to do that work. If production targets make review impossible, the process is automated in substance even if a person signs the form.
Balance speed against explainability and consistency
Automation can process large volumes quickly and apply the same stated rule to every record. Human judgment can supply context and detect errors that a model cannot see, but it costs time and can vary between decision-makers. A hybrid design should reserve human attention for consequential or ambiguous cases rather than requiring a person to retype an automated result.
U.S. federal baseline: what EEOC guidance means for employers
EEOC employment-test guidance explains that Title VII, the ADA and the ADEA prohibit discriminatory selection procedures. The application of those laws depends on the facts, the statutes and current court decisions; the guidance is not a guarantee that any particular tool is lawful.
Before implementation
- Identify the job requirement the tool measures and why that requirement is necessary.
- Ask what inputs the system uses, what the output means and which population and job the validation evidence covers.
- Understand known limitations, error patterns, administration conditions and scoring rules.
- Decide how a person can challenge an output and who has authority to correct it.
A vendor’s claim that a model is accurate in general does not establish that it is valid for your job, applicant population or workplace. Keep the evidence supporting the particular use, not just a marketing description.

Disability-related risks
EEOC and Department of Justice materials warn that software can screen out a qualified person with a disability or improperly seek disability-related information. An employer should provide an accessible accommodation process, tell applicants how to request help and respond before the assessment produces an irreversible rejection.
Consider a blind employee whose productivity is measured through undisclosed keystrokes. A voice-recognition workflow could make the measure inaccurate even though the employee is meeting the job’s essential requirements. The answer is not to assume the tool is neutral; it is to examine whether the measure is job-related and provide an effective alternative or adjustment.
As EEOC Chair Charlotte A. Burrows said in a 2022 EEOC/Department of Justice announcement, “New technologies should not become new ways to discriminate.” The statement captures the governing principle: a digital process remains an employment practice subject to nondiscrimination rules.
New York City Local Law 144: when an automated tool is covered
New York City’s Local Law 144 regulates a covered automated employment decision tool (AEDT). City guidance describes an AEDT as a computational process using artificial intelligence, machine learning, statistical modeling or data analytics that issues a score, classification or recommendation substantially assisting or replacing discretionary decision-making.

NYC rules indicate that coverage can apply when a tool is used early in screening even if a person makes the final selection. Employers must examine the tool’s actual function and use, not just its name or the point at which a recruiter becomes involved. Tools limited to transcribing or translating existing text are among the functions the rules exclude, but expanding such a tool into ranking or recommendation can change the analysis.
Core obligations for covered use
- Obtain a qualifying bias audit within the applicable period.
- Publish the required audit information.
- Provide candidate or employee notices required by the law and rules.
- Make required data and retention information available.
The city code and rules should be checked for the current definitions, calculations, timing and exceptions. Local Law 144 does not replace federal, state or other local nondiscrimination obligations.
What the 2025 enforcement audit does and does not show
A New York State Office of the State Comptroller audit published December 2, 2025 examined Department of Consumer and Worker Protection (DCWP) enforcement from July 2023 through June 2025. In 12 test calls to 311, three calls (25%) were correctly transferred to DCWP, eight (67%) went to the New York State Department of Labor and one returned to the employer. Those figures describe the 12 audit calls; they are not a complaint-resolution rate for the entire system or a measure of overall employer compliance.

The European Union: high-risk employment uses and human oversight
The EU AI Act identifies specified AI uses in recruitment and selection, employment decisions, task allocation and worker monitoring or evaluation as high-risk. An employer must confirm the exact system category, whether it is acting as provider or deployer, which obligations apply and the phased dates in the current consolidated regulation. A tool’s label alone does not resolve those questions.
On December 17, 2025, the European Parliament adopted a resolution recommending meaningful human oversight and review. The resolution says that “human oversight must not be merely a formalistic exercise, but an accessible safeguard for verifying, explaining and correcting AI-decisions.” It is a policy resolution, not enacted legislation by itself, so it should not be presented as an independent binding requirement.
Operationally, the recommendation points to four capabilities: a competent human contact, an ability to understand and monitor the system, authority to intervene and a way to explain and correct the decision. Those capabilities are useful controls even where a particular employer is outside the resolution’s legal effect.
A step-by-step framework for deciding what to automate
1. Map the decision and its consequences
List each step from application intake to hiring, promotion, scheduling, performance management or termination. For every step, record who is affected, what happens if the output is wrong, whether the result can be reversed and which jurisdictions govern the employer and the worker.
2. Define the permitted task
State in writing whether the system will transcribe, translate, organize, search, score, rank, recommend or decide. Limit use to the function evaluated. Do not silently expand from administrative assistance into ranking or recommendation without reassessing validity, accessibility and legal coverage.
3. Establish job-related criteria
For each score or rule, connect the input to an essential function or legitimate competency. Remove features that are unrelated, difficult to explain or likely to act as proxies for protected characteristics. Document who approved the criteria and when they change.
4. Conduct vendor and system due diligence
Ask for a plain-language description of inputs, features, outputs, training and validation evidence, known limitations, version history, change notices, security controls and available records. Ask whether the evidence covers your job, location, language and applicant or employee population. Require a process for reporting defects and obtaining a corrected output.

5. Validate before production use
Test whether the tool measures the intended competency under real administration conditions. Examine error patterns and potential disparate exclusion. Test accessible formats and accommodation paths. Preserve the protocol, results and decision to proceed; a one-time test does not justify every later use.
6. Design the reviewer workflow
Give the reviewer the score, the job-related evidence behind it and a clear explanation of limitations. Define when review is mandatory, what questions must be answered, how to request more information and how to override or correct an output. Do not make the reviewer responsible for a result while denying authority to change it.

7. Provide notice and accommodation routes
Tell candidates or employees when an automated tool materially affects a decision where the applicable law requires notice or where transparency is necessary for a fair process. Publish a simple accommodation contact and response process. Ensure that requesting an accommodation does not itself trigger rejection or retaliation.
8. Monitor, document and reassess
Track error reports, complaints, accommodation requests and responses, reviewer overrides, unexplained differences and outcomes by relevant groups where lawful to analyze. Reassess after a material model or job change, evidence of adverse impact, a new jurisdictional requirement or an unexpected outcome. Pause or narrow use when the employer cannot explain or defend the tool’s role.
What a meaningful human review looks like in practice
A reviewer should receive an evidence packet rather than a bare pass/fail label. Depending on the task, it may include the applicant’s relevant response, the criterion being measured, the system’s confidence or limitations, accommodation information that the employer is permitted to use and any data-quality warning.
Reviewer checklist
- Is the criterion tied to an essential job function?
- Did the system receive complete and appropriate input?
- Could an accessibility issue, language difference or accommodation have affected the output?
- Does the evidence support the score, or is the result based on an unexplained proxy?
- Are there contradictory facts the system did not consider?
- Can I request another assessment or an accessible alternative?
- Do I have authority to override the result, and will the reason be recorded?
Reviewers should be trained on the tool’s purpose, limitations, prohibited uses, accommodation procedure and escalation route. They should not be evaluated solely on how rarely they override the system; a low override rate can mean the tool is reliable, or that reviewers are rubber-stamping it.
Matching automation to common employment tasks
| Task | Potentially suitable automation | Human-control point | Specific caution |
|---|---|---|---|
| Application administration | Organizing documents, scheduling and translating or transcribing existing text | Check that records are complete and accessible before screening | Do not let an administrative tool begin ranking applicants without a new assessment |
| Initial screening | Flagging applications for a recruiter’s structured review | Recruiter examines job-related evidence and can add or remove a flag | An early-stage tool may still be covered by NYC rules |
| Skills assessment | Scoring a defined competency under consistent conditions | Reviewer checks validity, accessibility and unusual results | Inaccessible testing or an irrelevant proxy can exclude qualified people |
| Interview analysis | Transcription or locating responses for a human interviewer | Human evaluates the response, not an unexplained behavioral score | Language, disability and recording-quality differences can distort outputs |
| Promotion or performance support | Aggregating documented, job-related evidence for review | Manager verifies context and can correct records | Undisclosed productivity measures can disadvantage workers using accommodations |
| Task allocation or worker monitoring | Administrative planning where the criteria are transparent and contestable | Manager checks effects and responds to complaints or accommodation needs | EU AI Act high-risk categories may apply; verify the current regulation |
Common failure modes and how to correct them
Rubber-stamp review
Symptom: every score is accepted, reviewers see no evidence and production quotas leave no time to investigate. Correction: require an evidence view, minimum review questions, a documented override route and workload sufficient for actual review.
Best Value
Using a tool beyond its validated purpose
Symptom: a transcription or translation product is later used to rank applicants, or a model validated for one job is applied to another. Correction: maintain a permitted-use statement and trigger a new validation and legal review for material changes.
Assuming a vendor audit proves compliance
Symptom: the employer relies on a generic fairness report without checking its population, job, date, metrics or version. Correction: obtain evidence applicable to the actual use, record limitations and perform employer-level monitoring.
No effective accommodation path
Symptom: a candidate learns only after rejection that an assessment could have been adapted. Correction: provide an accessible contact before testing, train staff to respond and offer an alternative that measures the same essential competency.
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Confusing consistency with fairness
Symptom: the same rule is applied to everyone even when the rule measures an irrelevant trait or produces disparate exclusion. Correction: test job relevance, accessibility and outcomes, then revise or stop the criterion if it cannot be justified.
Insufficient records
Symptom: the employer cannot identify the model version, criteria, notice, accommodation response or reason for an override. Correction: retain an audit trail covering the job criteria, tool version, validation and audit work, notices, accommodation requests and responses, reviewer decisions, overrides, complaints and monitoring. This is prudent operational practice; particular laws may impose different recordkeeping duties.
A practical governance record
For each automated employment use, keep a short decision file that answers:
- What job and decision are covered?
- What essential functions and competencies does the tool assess?
- What inputs, outputs and permitted uses are defined?
- What validation, accessibility testing and bias-audit evidence applies?
- Which notices and accommodation procedures are in place?
- Who reviews results, what training do they have and how can they override?
- What version was used and when will the use be reassessed?
Separate records for different jobs and jurisdictions. A single enterprise policy cannot substitute for documenting the actual system and decision path.

Jurisdiction and deployment checklist
For U.S. employers generally
- Apply Title VII, ADA and ADEA analysis to tests and selection procedures.
- Document effectiveness, limitations, job fit, administration and scoring.
- Operate an accommodation process that is accessible before and during assessment.
- Use current statutes, regulations, agency guidance and applicable case law for the specific facts.
For covered New York City use
- Determine whether the actual process is an AEDT, including early-stage screening.
- Check whether an exclusion for limited transcription or translation applies.
- Complete the required bias-audit, publication, notice, data and retention steps on the applicable schedule.
- Review the current city code and rules whenever the tool, job or use changes.
For European Union use
- Classify the system under the current consolidated EU AI Act.
- Confirm whether the employer is a provider, deployer or another regulated actor.
- Check the obligations and phased application dates that apply to the system category.
- Give human reviewers the competence, information, monitoring ability, intervention authority and correction route needed for meaningful oversight.
Bottom line for the employer’s decision
Use automation to assist a clearly defined, job-related task, not to outsource accountability. Keep consequential decisions reviewable by a competent person who can see the evidence, recognize accessibility or discrimination risks and change the result. Before launch, validate the particular job and population, publish or provide notices required in the relevant jurisdiction, make accommodation practical, preserve an audit trail and monitor what happens after deployment. If the employer cannot explain what the tool measures, cannot provide an effective challenge or accommodation route, or cannot give reviewers real authority, the process is not ready for consequential employment use.
