The main routes are H-1B specialty-occupation status, L-1 intracompany transfer status and employment-based permanent residence. Each has different eligibility tests, employer duties, family rules and timing risks. The October 2026 Visa Bulletin illustrates why an Indian-born worker can face a much longer residence queue than a colleague born elsewhere, while nationality alone does not determine chargeability.
What the rules mean for an Indian IT worker
Visa status is not simply a travel document. It determines which U.S. employer may employ you, what job and location were disclosed to the government, whether a spouse may work, and how you preserve a path to permanent residence. Employers must select a category that fits the actual duties, corporate structure and work arrangement; workers must monitor status, pay and filing records rather than treating approval as permanent protection.

For most technology roles, the decision begins with whether the job is a specialty occupation, whether a qualifying foreign-company relationship exists, or whether the employer is sponsoring an immigrant category. A person can move from temporary status to a green card, but the transition is a separate legal process with its own petition, priority date and visa-number limits.
H-1B: the central route for specialty-occupation technology jobs
Eligibility and the employer’s filing duties
H-1B classification is for temporary employment in a specialty occupation. The U.S. Department of Labor describes that work as requiring specialized knowledge and at least a bachelor’s degree or equivalent in a directly related field. A software engineer, systems analyst, data specialist or similar role must therefore be supported by evidence about the position’s duties and the worker’s qualifications, not merely a generic technology job title.

The employer files the petition and first submits a Labor Condition Application (LCA). The LCA identifies the occupation and work location and includes attestations about wages, working conditions and notice. The required wage is at least the higher of the actual wage paid to similarly qualified employees or the prevailing wage for the occupation and area. Details are available from the Department of Labor H-1B program and its H-1B LCA requirements.
Worksite changes, remote arrangements and third-party assignments can require amended filings or other compliance steps. The employer should identify the legal employing entity, every intended worksite and the practical reporting arrangement before filing. A petition approved for one role and location is not a blank authorization to work for any company or from any location.
Cap numbers, registration and approval are different events
The statutory figures commonly associated with cap-subject H-1B cases are 65,000 regular places plus 20,000 additional places for beneficiaries with a qualifying U.S. advanced degree. Those figures do not describe every H-1B case: some employers and circumstances are exempt from the cap. A registration selection is only an opportunity to file; it is not a finding that the job qualifies or that USCIS will approve the petition.

| Stage | What it establishes | What it does not establish |
|---|---|---|
| Registration selection | The selected employer may generally submit a cap petition during the designated filing period. | Eligibility, wage compliance or approval. |
| LCA certification | The employer has made the required wage and working-condition attestations for the listed job and location. | Permission to work for a different employer or in an undisclosed arrangement. |
| USCIS petition approval | Approval of the described H-1B employment petition. | A guarantee of visa issuance, admission, future extensions or a green card. |
Worker protections on wages and costs
An H-1B worker must receive the higher applicable wage. Department of Labor guidance also identifies deductions that employers may not shift to the worker, including certain petition filing costs, financial penalties for leaving and employer business expenses such as LCA-related legal fees. Read the DOL H-1B worker guidance and keep pay statements, offer letters and notices. If the paid wage appears below the required rate, obtain advice promptly; waiting until a job change or visa expiry can make evidence harder to assemble.
The September 2025 payment condition
A September 19, 2025 presidential proclamation and a September 20 USCIS memorandum describe a $100,000 payment condition for certain H-1B employment petitions. The USCIS memorandum says the condition applies prospectively to petitions filed after 12:01 a.m. Eastern Time on September 21, 2025, and describes exceptions for certain earlier-filed petitions, already approved petitions and people holding valid H-1B visas. It is not an unconditional fee for every current H-1B worker.
Because implementation can be affected by later agency guidance or court action, employers and workers should check the current USCIS memorandum and subsequent official notices before filing, traveling or changing employment. The memorandum states: “The proclamation does not impact the ability of any current visa holder to travel to or from the United States.” That statement must be read in the context of the memo’s prospective petition scope, not as a promise that every future application will be unaffected.

L-1: when an Indian IT professional transfers within a multinational group
Corporate relationship and prior employment
L-1 is not a second H-1B lottery. It is available when a qualifying organization transfers an executive, manager or specialized-knowledge professional from an affiliated foreign office to a U.S. office. The entities must have the required relationship, such as parent, subsidiary, branch or affiliate, and the worker generally must have been employed abroad for at least one year during the three years before the relevant filing or admission. The offered U.S. duties and the prior foreign duties must fit the L-1 category.
Recommended Free Tools
For an Indian IT worker, evidence may include organizational charts, ownership records, payroll and employment dates, project descriptions, and documentation showing specialized knowledge or managerial authority. A staffing assignment to an unrelated customer, a short foreign placement or a company with no qualifying ownership relationship can undermine eligibility. Review the USCIS L-1 Policy Manual guidance for documentation standards.
L-2 spouses and employment
USCIS’s employer handbook states that an L-2 dependent spouse with an L-2S admission record is employment-authorized incident to status. The spouse does not need an EAD to establish that status for Form I-9 purposes, although applying for an EAD remains an option. Employers should inspect the admission record and current identity and work-authorization documents rather than relying on the label “dependent visa.” The relevant handbook section is USCIS’s L-2 employment-authorization guidance.

Can an Indian IT worker move from H-1B or L-1 to a green card?
Yes, but temporary status and permanent residence are separate tracks. Employment-based residence commonly involves an employer job offer, a labor certification from the Department of Labor for categories that require it, and an I-140 immigrant petition. Some categories have different requirements. After the petition and priority-date steps, an immigrant visa number must be available before an immigrant visa can be issued or an adjustment application can be approved. The State Department explains the overall process on its employment-based immigrant visa page.
Priority date, final-action date and filing chart
The priority date is the place in the queue assigned under the applicable petition or labor-certification rules. The Visa Bulletin’s final-action date is a monthly allocation marker: a visa number may be allocated only when the case’s priority date is earlier than the listed date (subject to the bulletin’s rules). It is not an individualized prediction of when USCIS or a consulate will finish a case.

What happens to the green-card wait if you are Indian-born?
Chargeability generally follows country of birth, not citizenship. An Indian citizen born in another country may not automatically use the India column, while a person who is no longer an Indian citizen can still be chargeable to India if born there. Limited cross-chargeability rules can sometimes use a spouse’s country of birth or a child’s country, so the individual facts matter.
The October 2026 Visa Bulletin lists these India final-action dates:
| Employment category | India final-action date |
|---|---|
| EB-1 | July 1, 2024 |
| EB-2 | January 15, 2015 |
| EB-3 | January 15, 2015 |
| Other workers | January 15, 2015 |
For EB-2 and EB-3, a priority date must be earlier than January 15, 2015 for a number to be available under that October 2026 final-action snapshot. Bulletin dates can advance, retrogress or remain unchanged in a later month. Always check the newest Visa Bulletin and USCIS filing-chart instructions before taking action.

|---|---|---|---|---|
| H-1B | Specialty occupation and required qualifications | U.S. employer petition, LCA wage and work-condition duties | Dependents have separate status and work-authorization rules | Cap and selection may apply; exemptions and current policy must be checked |
| L-1A/L-1B | Qualifying foreign employment and executive, managerial or specialized-knowledge transfer | Qualifying relationship between foreign and U.S. entities | L-2S spouses may work incident to status under USCIS guidance | Requires the right corporate structure, prior employment and duties evidence |

Employer and worker checklists
Before choosing a category
- Identify the actual job duties, required degree or experience, legal employer, worksite and remote or client arrangement.
- Confirm whether the employer is cap-subject, cap-exempt or part of a qualifying multinational group.
- Map dependent status and work plans separately; never assume a dependent may work automatically.
For an H-1B filing or transfer
- Compare the actual and prevailing wages and retain the LCA notice and supporting records.
- Check that the petition describes every material work location and assignment.
- Do not deduct prohibited petition costs, LCA legal expenses or unlawful departure penalties from the worker’s pay.
- Check the latest USCIS position on the $100,000 payment condition before filing.
For an L-1 filing
- Document ownership or control linking the Indian and U.S. entities.
- Prove at least one qualifying year abroad during the preceding three years.
- Match the proposed duties to executive, managerial or specialized-knowledge criteria.
- Preserve organizational charts, payroll evidence, project records and specialized-knowledge explanations.
For permanent-residence planning
- Record the priority date and category and determine the worker’s chargeability country by place of birth.
- Track labor certification, I-140 approval and any adjustment or consular-processing filing separately.
- Review both the monthly Visa Bulletin and USCIS’s chart-selection announcement.
- Keep valid nonimmigrant status and employment authorization while waiting, unless a qualified adviser confirms another strategy.
Common mistakes that create avoidable risk
- Treating citizenship as chargeability: the India column ordinarily follows birth country, not passport.
- Calling registration an approval: selection only opens the cap-petition filing opportunity.
- Using L-1 as a generic alternative: the corporate relationship, foreign employment and duties must all qualify.
- Reading a cutoff as a completion date: a final-action date only controls visa-number availability under that month’s allocation.
- Ignoring the worksite: remote or client-site changes can affect LCA and petition compliance.
- Assuming family work rights: H-4 and L-2 rules differ; L-2S incident work authorization does not establish automatic H-4 permission.
- Relying on an old policy memo: the September 2025 proclamation’s scope and implementation should be rechecked against current agency and court materials.
Frequently Asked Questions
How does the H-1B visa affect Indian IT workers?
It ties employment to a specialty-occupation petition, LCA wage and worksite requirements, and possibly the annual cap. Workers receive wage protections, but a registration selection is not approval and a petition does not authorize work for an unrelated employer.
Can an Indian IT worker move from H-1B to a green card?
Yes. The employer-sponsored process may involve labor certification, an I-140 petition, a priority date and later visa-number availability. The temporary H-1B case and permanent-residence case remain separate.
What happens to my green-card wait if I’m Indian-born?
You are generally chargeable to India, regardless of current citizenship, unless an applicable cross-chargeability exception changes the result. In the October 2026 bulletin, India EB-2 and EB-3 final-action dates were January 15, 2015.
Can my spouse work if I move to the U.S. on an L-1 visa?
An L-2 dependent spouse with an L-2S admission record is employment-authorized incident to status under USCIS guidance and does not need an EAD to establish that status for Form I-9 purposes.
