U.S. tech companies can hire international employees, but “international” is not an immigration category. A candidate may already be authorized to work, may have authorization limited to a particular employer or role, or may need an employer-sponsored petition before starting. The safe sequence is to verify the person’s actual work authorization, match the job and employer to an eligible category, complete any required government filing, and finish Form I-9 on schedule without demanding a particular document.
This guide covers temporary employment routes, L-1 transfers, F-1 student work, remote I-9 examination, and the federal onboarding steps. State and local payroll, tax, privacy, employment, and new-hire reporting rules depend on the employee’s work location and require separate review.
Start with the employee’s current work authorization
Before agreeing to a start date, ask what authorization permits the candidate to perform the proposed U.S. job and whether that authorization is tied to an employer, position, worksite, or expiration date. Do not infer work eligibility from citizenship, accent, country of birth, degree, or a job title. A foreign national might already hold an employment authorization document, have a status that permits work only for a particular employer, or need a new petition.

Use the same neutral process for every candidate. You can ask whether the person is legally authorized to work in the United States and whether sponsorship will be needed now or later, but avoid asking for a preferred immigration document. For Form I-9, the employee chooses which acceptable documents to present. USCIS states on its anti-discrimination notice: “All employees can choose which acceptable documentation to present for Form I-9.” Requiring an EAD, passport, or another specific document because someone is foreign-born can create discrimination risk.
- Confirm the authorization category and its expiration or other end date.
- Check whether the proposed employer, role, duties, and work location fit the authorization.
- Identify whether a filing, transfer, or student-work condition must be completed before work begins.
- Set the start date only after the required authorization is in place.
Choose the immigration route based on the job and the person
USCIS lists multiple temporary employment classifications. Eligibility depends on the worker’s qualifications, the actual position, the employer’s facts, and sometimes a qualifying corporate relationship. A title such as “software engineer” or “product manager” does not establish eligibility by itself.

| Route | Core fit described by USCIS | Employer planning point |
|---|---|---|
| H-1B | Specialty occupation employment | Many cases involve a Department of Labor labor condition application before the USCIS petition; verify the current sequence for the specific case. |
| L-1A | Intracompany transfer for a qualifying executive or manager | Requires a qualifying relationship between the U.S. and foreign entities and qualifying prior employment abroad. |
| L-1B | Intracompany transfer for an employee with qualifying specialized knowledge | Requires the same type of corporate relationship and prior qualifying employment evidence. |
| O-1 | Worker with extraordinary ability | Evidence must match the category’s criteria; do not assume eligibility from seniority alone. |
| TN | Qualifying professionals who are citizens of Canada or Mexico | The profession, credentials, citizenship, and proposed duties must satisfy the applicable requirements. |
This table is an orientation, not a complete list of temporary classifications. In many employer-sponsored cases, the employer files Form I-129. Depending on the category, a Department of Labor labor condition application, temporary labor certification, or another prescribed step may come first. Approval of a labor certification does not itself issue a visa or grant work authorization. Check current USCIS and Department of Labor instructions and obtain case-specific immigration advice before making a binding start-date promise.
Compare plausible routes before selecting one
When two or more classifications might fit, compare the following questions in order:
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitches- Worker and role: Does the person meet the category’s criteria, and do the actual duties and minimum requirements fit?
- Employer qualifications: Does the company have the required relationship, operations, or other evidence?
- Agency sequence: Is a Department of Labor filing or another prerequisite required before USCIS submission?
- Start-date limits: Can the person lawfully begin on the desired date, or must the company wait for approval or an employment document?
- Continuing duties: Will the employer need to maintain records, use E-Verify, complete a training plan, or report changes?
- Change risk: What happens if the employee changes employer, job duties, worksite, or work hours?
Available official guidance does not establish a reliable, current category-by-category processing-time comparison. Treat any estimate supplied by a third party as case-specific and verify it against live agency information.
Handle L-1 intracompany transfers as a separate workflow
An L-1 transfer is not a shortcut for hiring any overseas candidate. The U.S. company and the foreign company must have a qualifying relationship, and the employee must have qualifying prior employment abroad. The proposed U.S. position must fit either the executive or managerial standard for L-1A or the specialized-knowledge standard for L-1B.

Evidence to assemble
- Documents showing the ownership, control, or other qualifying relationship between the foreign and U.S. entities.
- Evidence of the employee’s qualifying employment abroad and the dates and nature of that work.
- A detailed description of the U.S. duties, reporting structure, worksite, and compensation.
- Organizational charts and business records that support the claimed executive, managerial, or specialized-knowledge role.
New U.S. office petitions
A company opening its first U.S. office faces additional evidence requirements. The petition must support the existence of suitable premises, the ability to begin U.S. operations, and the ability to remunerate the employee. A lease, operating plan, funding evidence, hiring plan, and role description may be relevant, but the exact evidence depends on the facts. Do not treat a newly formed U.S. entity or a planned office as proof that an L-1 qualifies.
Hire F-1 students through the correct student-work program
F-1 students may have employment authorization through Optional Practical Training (OPT), but the job must relate to the student’s field of study. The student should wait for the Employment Authorization Document (EAD) before starting work. A company should review the authorization dates and conditions rather than relying on a verbal statement that an application has been filed.

Regular OPT
- Confirm that the proposed duties relate to the student’s field of study.
- Verify that the student has the required authorization and that the requested start date falls within the authorized period.
- Keep the ordinary I-9 process separate from any school or immigration reporting the student must complete.
STEM OPT extension
STEM OPT adds employer-specific conditions. The employer must participate in E-Verify, and the employer and student must complete Form I-983, the training plan. The student also has reporting responsibilities to the designated school official. Review current ICE and Student and Exchange Visitor Program instructions for supervision, evaluation, material-change, and reporting requirements in the particular case. E-Verify participation and a signed training plan do not replace the need to confirm the student’s underlying work authorization.

Complete Form I-9 on the federal deadlines
Form I-9 is required for each new hire, including an international employee who already has unrestricted or temporary work authorization. The employee completes Section 1 after accepting the offer and no later than the first day of work. The employer completes Section 2 within three business days after the employee’s first day. If the job lasts fewer than three days, Section 2 is due at the time of hire.
| Task | Who completes it | Deadline |
|---|---|---|
| Section 1 | Employee | After accepting the offer and no later than the first day of work |
| Section 2 | Employer or authorized representative | Within three business days after the first day; at hire when employment lasts fewer than three days |
| Document choice | Employee | Employee presents either one List A document or a List B and List C combination |
The USCIS form identified in the official material is edition 08/01/23, with an expiration date of 05/31/2027. Form editions can change, so download the current form and instructions from USCIS at the time of onboarding rather than relying on a saved copy.
Let the employee choose acceptable documents
The employee may present one acceptable List A document, or one List B document together with one List C document. The employer’s role is to examine the documents under the applicable procedure and record the required information—not to steer the employee toward a passport, EAD, or immigration document. If an employee presents an acceptable combination, do not reject it because another document would be more familiar.

Use remote document examination only when eligible
USCIS permits an optional alternative procedure for qualifying employers to examine I-9 documents remotely. It is not an automatic right for every remote or hybrid workplace. Confirm that the employer is eligible under the current procedure before using it.
The procedure requires all of the following:
- Examine clear copies of the documents presented by the employee.
- Conduct a live video interaction in which the employee presents the same documents.
- Retain clear copies as required by the procedure and complete the I-9 records consistently.
Do not treat a video call alone as sufficient. The copies, live interaction, retention, and any employer eligibility conditions must all be satisfied. If the company cannot meet the optional procedure’s requirements, use an authorized representative or an in-person examination method permitted by the current rules.
Build an onboarding checklist that prevents avoidable errors
Before the offer
- Define the position’s duties, minimum qualifications, worksite, reporting line, and expected start date.
- Ask every candidate the same work-authorization and future-sponsorship questions.
- Identify whether the candidate has current authorization, needs a transfer, or may fit a sponsored category.
- For a transfer or sponsorship case, have qualified immigration counsel assess eligibility and evidence before the company promises a start date.
After acceptance and before day one
- Give the employee the current Form I-9 instructions and allow the employee to select acceptable documents.
- Confirm any EAD or other authorization dates that control when work may begin.
- For OPT, confirm field-of-study relevance; for STEM OPT, confirm E-Verify participation and the Form I-983 process.
- For an L-1, verify the corporate-relationship and overseas-employment evidence.
By the statutory deadlines
- Have the employee complete Section 1 after offer acceptance and by the first workday.
- Complete Section 2 within three business days of the first workday, or at hire for employment lasting fewer than three days.
- If using remote examination, document the copy review, live video interaction, and retained copies under the authorized procedure.
- Store I-9 records securely and separately from ordinary personnel files where your retention and privacy practices require separation.
Troubleshoot common hiring problems
The candidate has an EAD application pending
A pending application is not the same as current permission to work. Confirm the authorization that is valid on the proposed start date. If the required document or status is not yet effective, delay employment or obtain advice on a lawful alternative rather than allowing work to begin on an assumption.
Best Value
The manager wants a passport from every foreign-born hire
Stop the practice. Employees choose acceptable I-9 documents. Apply one process to all hires and provide the official acceptable-document lists. A request for a particular document based on citizenship, immigration status, or national origin may be unlawful.
The job changed after filing
A material change in duties, worksite, employer, or reporting structure can affect an immigration classification or a student training plan. Pause the change and obtain category-specific advice before implementing it. Do not assume that an approved filing covers a substantially different role.
The company is fully remote
Remote work does not eliminate I-9 duties. Determine whether the company qualifies for the optional remote procedure. If not, appoint an authorized representative or arrange an examination method allowed by the current rules, and retain the required records.
Know what this federal checklist does not decide
Federal immigration and I-9 compliance are only part of onboarding. The employee’s work location can trigger state and local payroll withholding, tax registration, paid-leave, wage-and-hour, privacy, workers’ compensation, and new-hire reporting requirements. Those obligations vary and are not resolved by choosing an immigration category. Coordinate the immigration review with payroll and employment counsel for each work location.
For a complex sponsorship, L-1 new-office case, STEM OPT arrangement, or any situation involving a status or job change, qualified U.S. business-immigration counsel can evaluate the facts and evidence. HR or payroll software may help organize ordinary onboarding records, but it does not decide work authorization or remove the employer’s Form I-9 responsibilities.

A practical decision rule
Do not ask first, “Which visa should we use?” Ask, “What authorization does this person have today, what work will they perform, and what must be true before they start?” Then document the answer, select the route that fits both the employee and the employer, complete prerequisites in the required agency order, and finish I-9 verification without restricting the employee’s document choice. That sequence keeps the hiring decision grounded in the actual authorization and the job rather than in nationality or assumptions.
