Verify the proposal against the applicable military-objective test: would the object, by its nature, location, purpose, or use, make an effective contribution to military action, and would its destruction, capture, or neutralization offer a definite military advantage in the circumstances at the time? Then check cultural-property protections, treaty coverage, domestic law, and reliable evidence about the actual site and planned activities.
What the verification question actually asks
“Could serve a military purpose” is not a legal conclusion by itself. A monument may be politically important, symbolically associated with a conflict, or located in a sensitive area without being a military objective. Conversely, a building designed as a memorial could acquire a military-relevant function if its actual use changes.

The answer is therefore fact-specific and time-specific. You need the design, site, planned functions, surrounding infrastructure, jurisdiction, applicable treaties, domestic implementing law, and evidence of actual or intended use. Without those facts, the responsible result is a verification method, not a verdict about an unnamed project.
Start with the applicable legal framework
Before assessing the monument, identify which rules govern the decision. A planning approval in peacetime is not the same legal question as the conduct of an attack during an armed conflict. Treaty participation, national legislation, military manuals, heritage designations, and the authority making the decision can all change the analysis.

Additional Protocol I, Article 52
For objects, Article 52(2) of Additional Protocol I limits military objectives to objects that meet both parts of a two-part test. They must, by their nature, location, purpose, or use, make an effective contribution to military action; and their total or partial destruction, capture, or neutralization, in the circumstances ruling at the time, must offer a definite military advantage.
“In so far as objects are concerned, military objectives are limited to those objects which by their nature, location, purpose or use make an effective contribution to military action and whose total or partial destruction, capture or neutralization, in the circumstances ruling at the time, offers a definite military advantage.”

Article 52(3) adds an important evidentiary rule: when there is doubt whether an object normally dedicated to civilian purposes is being used to make an effective contribution to military action, it is presumed not to be so used. That presumption does not eliminate investigation; it prevents uncertainty from being treated automatically as proof of military use.
Cultural-property rules
If the proposed monument qualifies as cultural property, apply the cultural-property instruments separately rather than treating them as a footnote to the general test. The 1999 Second Protocol uses the same nature, location, purpose, or use categories and the same two-part military-objective structure, but it imposes additional conditions for a waiver of protection in a direct attack.
Under the Second Protocol’s direct-hostility rule, the cultural property must, by its function, have become a military objective, and there must be no feasible alternative available to obtain a similar military advantage. A finding under the general military-objective definition does not by itself resolve that additional cultural-property question.
The 1954 Convention’s monument-centre provision
The 1954 Hague Convention contains a specific rule for a “centre containing monuments.” In that defined context, Article 8 treats the centre as used for military purposes when it is used for movement of military personnel or material, even in transit, or when activities directly connected with military operations, stationing of military personnel, or production of war material occur there.
The same provision says that specially empowered armed custodians guarding cultural property and nearby police who are normally responsible for maintaining public order are not, for that purpose, deemed to constitute military use. Do not generalize this into a rule that any guard, police officer, or security presence turns a monument into a military objective. Confirm whether the site actually falls within the Convention’s defined centre and whether the listed activities are substantiated.

Special and enhanced protection
Check whether the site has special protection under the 1954 Convention or enhanced protection under the Second Protocol. These regimes have distinct eligibility, registration, and conduct conditions. Enhanced protection, in particular, requires that the property not be used for military purposes and not be used to shield military sites. Ordinary cultural-property protection and enhanced protection are not interchangeable labels, and a designation cannot be assumed from a monument’s public reputation.
A step-by-step verification workflow
1. Define the object and the decision
- Obtain the project name, legal owner, design drawings, planning documents, coordinates, parcel boundaries, and descriptions of every connected structure.
- Separate the monument itself from visitor centres, parking areas, communications equipment, storage, roads, utilities, and any larger historic or protected centre.
- State the decision being examined: ordinary planning permission, heritage registration, security assessment, a prospective military operation, or an attack-related decision.
- Record the relevant date or period. The military advantage must be assessed in the circumstances ruling at the time, not against an indefinite future scenario.
- Identify the state, treaty participation, domestic implementation, competent heritage authority, and any military or emergency rules that apply.
If any of these facts is missing, mark the conclusion as provisional rather than filling the gap with assumptions.
2. Describe intended function and design
Read the plans, operating concept, lease documents, procurement records, and public statements. List what the site is designed to do and what it is not designed to do. Relevant details include meeting rooms, galleries, archives, observation decks, underground spaces, loading bays, generators, radio equipment, data facilities, staff accommodation, restricted areas, and access-control systems.
Test the word “purpose” against evidence. A statement that a monument will “honour the armed forces” describes symbolism, not necessarily military purpose. A separate plan showing that its basement will host an operational command post is evidence of a different kind. Keep the proposed purpose, actual use, and speculation in separate columns in your records.
3. Map the location and surroundings
Use a current site plan and reliable geospatial information to map the monument, nearby military objectives, transport corridors, airfields, weapons systems, command facilities, fuel or ammunition storage, and communications nodes. Note physical separation, lines of sight, shared entrances, access roads, power connections, and whether the monument would sit inside or adjacent to a military installation.
Location can matter even when the structure itself has no military equipment. The question is whether the location makes an effective contribution to military action and whether neutralizing the object would provide a definite military advantage. Proximity alone is not enough; explain the operational connection and the evidence supporting it.
The Second Protocol calls on parties, to the maximum extent feasible, to avoid locating military objectives near cultural property. That planning duty is distinct from deciding whether the monument itself is a military objective.

- Source claim: an allegation that has not yet been independently verified.
- Inference: a conclusion drawn from circumstances, such as unusual security or restricted access, without direct proof of military function.
Record the date, provenance, reliability, and contradictions for each item. A single guard, ceremonial event, flag, memorial inscription, or police patrol does not automatically satisfy the full two-part military-objective test.
5. Apply both parts of the military-objective test
Work through the four qualifying categories, then test the two required outcomes. The following table keeps the questions separate:
| Element | Verification question | Evidence to collect |
|---|---|---|
| Nature | Does the object’s inherent character make an effective contribution to military action? | Design, equipment, installed systems, structural role, and documented capabilities. |
| Location | Does the site’s position make an effective contribution to military action? | Maps, sightlines, access routes, proximity, terrain, and operational plans. |
| Purpose | Is there a substantiated intended future military function? | Approved plans, contracts, orders, budgets, and authoritative statements. |
| Use | Is the object actually being used for a military function? | Dated observations, records, imagery, logs, and corroborated testimony. |
| Effective contribution | How, specifically, would the object support military action? | A causal explanation linking the feature or activity to an operation. |
| Definite military advantage | What concrete advantage would destruction, capture, or neutralization provide in the circumstances at the time? | Operational analysis tied to the current situation, not a hypothetical benefit. |
If either the effective-contribution element or the definite-advantage element is unsupported, the military-objective finding is incomplete. Do not convert a general security concern into a definite advantage without identifying the operation, capability, and expected result.

6. Check cultural-property status and registration
Determine whether the monument, its contents, or the wider site qualifies as cultural property under the applicable convention and national law. Check heritage registers, protection orders, buffer zones, management plans, and any record of special or enhanced protection.
For special protection, verify the regime’s own eligibility and registration conditions. For enhanced protection, verify the additional requirements, including non-use for military purposes and the absence of a function that shields military sites. Confirm the status with the competent authority; do not infer it from a plaque, tourism listing, or political declaration.
7. Assess alternatives and precautions when an attack is contemplated
If the question concerns direct hostility against cultural property, document whether a feasible alternative could obtain a similar military advantage. “Alternative” should be concrete: another route, timing, method, target, or means that is realistically available in the circumstances. An abstract possibility that cannot achieve a comparable result is not a meaningful alternative.
The Second Protocol also requires feasible verification and precautions in attack, including efforts to verify that a target is not protected cultural property and to choose means and methods that avoid or minimize damage. The duty to take precautions does not replace the prior question of which legal regime applies, and attack-related rules do not decide an ordinary peacetime planning application.
8. Preserve a dated, auditable record
Write the conclusion so another reviewer can reproduce it. Identify each source, the date obtained, what it proves, what it does not prove, and which assumptions remain unresolved. Note what new evidence would change the assessment, such as a revised site plan, a confirmed change of use, a protection designation, or reliable evidence that a proposed military function was cancelled.

How to handle uncertain or conflicting evidence
Use a fact matrix rather than a single narrative. For each material assertion, record the proposition, source, date, confidence level, contrary evidence, and legal element affected. Keep “the monument is near a barracks” separate from “the monument supports military action”; the first may be documented while the second still requires an operational explanation.
When sources conflict, compare their proximity to the fact, independence, timing, technical competence, and access to records. Do not average incompatible claims into a false middle position. State the conflict and explain which conclusion, if any, can safely be drawn while it remains unresolved.
Use the Article 52(3) presumption where it applies to an object normally dedicated to civilian purposes and doubt remains about military use. The presumption is not a shortcut for ignoring evidence; it is a rule against treating unresolved doubt as established use.

A planned monument may be one building inside a historic district or a designated centre containing monuments. Analyze the legal object at issue: the monument, the centre, a connected facility, or a military installation that overlaps the site. The 1954 Convention’s examples concerning movement, stationing, operational activity, and war-material production apply in the defined centre context. They should not be used to label every nearby monument a military objective.
Draw the boundaries on a map and describe shared functions explicitly. If a visitor centre contains a military communications room, assess that room and the wider structure separately where the law permits. If a road crosses the site, document whether it is an ordinary public route or a military supply route and how that fact bears on the two-part test.
Compare competing assessments on the same axes
When experts, authorities, or parties reach different conclusions, compare their work using the same questions:
- Are they applying the same treaty, domestic law, and time period?
- Are they assessing the same object and boundaries?
- Do they identify nature, location, purpose, or use, rather than relying on symbolism?
- Do they explain an effective contribution to military action?
- Do they identify a definite military advantage in the circumstances ruling at the time?
- Have they checked ordinary, special, and enhanced cultural-property protection separately?
- If a cultural-property exception is invoked, do they analyze feasible alternatives and precautions?
An assessment that skips one of these axes may be addressing a different question rather than directly contradicting another assessment.

Common mistakes and how to correct them
Inferring military status from the name or symbolism
A memorial to soldiers, a national emblem, or a battlefield theme does not establish military function. Replace symbolic interpretation with plans, site evidence, and an analysis of contribution and advantage.
Best Value
Treating any security presence as military use
Police responsible for public order and specially empowered custodians guarding cultural property are treated distinctly in the 1954 Convention’s centre provision. Identify the personnel, mandate, equipment, and activity before drawing a conclusion.
Using proximity as a standalone rule
Being near a base, road, or communications mast may be relevant to location, but proximity alone does not prove an effective contribution or definite advantage. Explain the operational link.
Collapsing legal tests
Do not merge the general military-objective definition, the cultural-property waiver, special protection, enhanced protection, and attack precautions into one checklist. They answer related but different questions and have different conditions.
Relying on old or undated information
Military use, protection status, and site plans can change. Date every observation and reassess the conclusion when the circumstances change.
Confusing an allegation with proof
Label allegations and inferences honestly. A conclusion should identify what is established, what is probable, and what remains unknown instead of presenting every source claim as fact.
A practical reporting template
A decision memo can follow this order:
- Question and scope: identify the object, site, decision, jurisdiction, and relevant date.
- Applicable rules: list treaty provisions, domestic law, protection designations, and the authority responsible.
- Object description: describe nature, location, purpose, use, boundaries, and connected facilities.
- Evidence register: provide dated sources, provenance, reliability, contradictions, and confidence.
- Military-objective analysis: address effective contribution and definite advantage separately.
- Cultural-property analysis: address status, special or enhanced protection, alternatives, and precautions where relevant.
- Uncertainty and triggers: identify missing facts and the events that would require reassessment.
- Conclusion: state whether the evidence supports, fails to support, or cannot yet resolve the legal finding.
Use restrained wording. “The available records do not establish military use as of 17 October 2026” is materially different from “the monument can never serve a military purpose.” The first is a dated evidentiary conclusion; the second is an unsupported prediction.
What can be concluded without project-specific facts
No unnamed monument can be classified from its title alone. A defensible verification requires the project’s jurisdiction, design, location, intended and actual activities, treaty and domestic-law context, cultural-property status, and reliable evidence of military use. Apply the legal tests in sequence, keep ordinary and enhanced protections distinct, document uncertainty, and update the assessment when the circumstances change.
