How to Verify the End User of a High-Performance Semiconductor Shipment

To verify the end user of a high-performance semiconductor shipment, identify every party and role, confirm who will actually use the item and where it will be delivered or installed, establish the customer’s ownership and headquarters, and test the stated use against the chip’s classification, the customer’s business and technical capability, and current U.S. export-control rules. Screen all relevant parties, but do not treat a clean screening result as proof that the declared end user is genuine or that a license is unnecessary.

The workflow below is framed around the U.S. Export Administration Regulations (EAR). It is compliance guidance, not a determination that a particular chip, destination, or transaction is authorized. EAR provisions, restricted-party lists, classifications and destination controls change, so verify the rules and facts immediately before shipment.

What “end user” means in a semiconductor shipment

The buyer named on a purchase order is not necessarily the end user. A compliant review distinguishes the commercial parties, the party receiving the goods, and the organization that will operate, consume, integrate or deploy them.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Role What it means Why it matters
Exporter The party sending the item from the United States or otherwise making the export. Responsible for classification, authorization and due diligence under the applicable rules.
Buyer or purchaser The contracting or paying customer. May be a distributor, procurement company or parent rather than the user.
Ultimate consignee The party receiving the shipment at the final commercial destination. Can differ from both the buyer and the end user.
Intermediate consignee A party handling the shipment before it reaches the ultimate consignee. Freight forwarders, logistics companies and consolidators need a legitimate role and address.
End user The organization or person that will actually use the semiconductor, system or equipment. End-use and end-user controls can apply even when the buyer and destination appear acceptable.
Installer or deployment site The physical location where the item will be installed, operated or integrated. An undisclosed or implausible site is a significant diversion warning.

For a high-performance chip, system or semiconductor-manufacturing item, record the legal name, trading name, address and role of every party. If the customer is not the end user, obtain the known end user’s legal name and address rather than accepting a vague statement such as “internal use” or “customer project.”

How to verify the end user: a practical workflow

1. Define the item and the transaction before evaluating the customer

Start with an item description precise enough to support an Export Control Classification Number (ECCN) or another applicable classification. Record the chip or system model, performance characteristics, quantity, accompanying software or technology, and whether the shipment includes semiconductor-manufacturing equipment or a system containing advanced-computing integrated circuits.

Map the transaction from the exporter to the final user. Capture the exporter, purchaser, buyer, ultimate consignee, intermediate consignee, freight forwarder, reseller, service provider and intended end user, including complete addresses. An order that does not identify the ultimate owner or user is a problem to resolve, particularly in advanced-computing and semiconductor-manufacturing-equipment transactions.

  • Match the product description on the quotation, purchase order, commercial invoice and shipping documents.
  • Identify whether the item will be resold, leased, incorporated into a system or used to provide computing services.
  • List every known transfer, including an expected onward shipment or installation by a contractor.
  • Note the country of export, transit countries, final delivery country and installation location separately.

2. Ask who will use it, what they will do, and where it will go

Request a plain-language description of the activity the customer intends to perform with the item. For a processor, that might be training or running models, scientific computing, telecommunications, industrial control or product development. For manufacturing equipment, request the process step, facility and type of integrated circuit to be produced. The description should explain why the stated quantity and configuration are needed.

Obtain the end user’s legal name and address when the contracting customer is an intermediary. Obtain both delivery and installation addresses; a warehouse or freight-forwarder address does not answer where the item will ultimately operate. If the item will be deployed in a data center, identify the facility operator, physical site and customer using the capacity.

For advanced-computing transactions, Bureau of Industry and Security (BIS) guidance recommends collecting the customer’s headquarters, the end user’s headquarters and the ultimate parent’s headquarters, along with the item list, ECCNs and relevant attestations. A third-country office address does not by itself resolve concerns about the parent or actual user.

3. Verify corporate identity, ownership and headquarters

Confirm that the customer exists as the legal entity named in the documents. Compare registration records, tax or business identifiers, website details, domain email addresses, bank information and signed statements. Investigate transliteration differences, recently created entities, unexplained name changes and addresses shared with unrelated companies.

Document the ownership chain to the ultimate parent where practical. For new advanced-computing customers, BIS recommends evaluating the incorporation date and ownership structure, including whether the entity or its ultimate parent is headquartered in Country Group D:5 or Macau. The headquarters of a parent can be more important than the address of the local subsidiary. Apply the rule in force at the time of export rather than relying on an old corporate chart.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Ask who controls the facility, who pays for the item, who can access it and who can authorize onward transfers. A customer that cannot explain its ownership or refuses ordinary identity documentation should not be treated as verified merely because its name is absent from a screening list.

4. Screen every relevant party, then assess what the result does not tell you

Use current applicable restricted-party resources, including the BIS Consolidated Screening List entry point, for the exporter’s authorization process and again when material transaction facts change. Screen legal names, former names, aliases, parent entities, known end users, consignees, freight forwarders and other parties with a meaningful role.

Resolve a potential match before proceeding. Compare the matched entity’s address, registration details and business activity; do not dismiss a match solely because the spelling differs. Keep the search date, lists checked, search terms and disposition.

A no-match result is only one control. The BIS Military End User (MEU) List is not exhaustive, and an entity can meet a military end-user definition without appearing on it. End-use controls can create a license requirement even when the item’s classification and destination alone would not. Certain activities by U.S. persons can also be restricted. Screening therefore has to be combined with end-use, ownership, capability and destination analysis.

Dimension Questions to answer Evidence to retain
Identity and ownership Is the legal entity real, and who owns or controls it? Registration information, ownership chart, headquarters and signed representations.
Role and destination Who buys, receives, installs, operates and may resell the item? Contracts, shipping instructions, delivery and installation addresses.
Use and capability Does the stated activity require this quantity and configuration? Technical description, facility information, project documents and capacity data.
Item and authorization What is the ECCN, and which current country, end-user and end-use controls apply? Classification rationale, license history and authorization analysis.
Document consistency Do invoices, attestations, websites and shipping records tell the same story? Copies of the documents reviewed and explanations for discrepancies.
Red-flag resolution Has every inconsistency been explained credibly and documented? Questions, answers, supporting records and the final decision.

This is a practical comparison framework, not an official scoring system. A small number of serious inconsistencies can justify a hold even when most information appears normal.

6. Investigate red flags before shipment

BIS’s general know-your-customer guidance gives examples such as an order inconsistent with the buyer’s needs, refusal of normally expected installation or testing, and equipment configurations that do not fit the destination. Uncertainty about the ultimate owner or user is itself a warning sign in some advanced-computing and semiconductor-manufacturing-equipment transactions.

When a red flag appears, ask targeted questions about the end user, end use and ultimate country of destination. Reevaluate the transaction after receiving the answer. The official EAR Supplement No. 3 to Part 732 states: “However, when ‘red flags’ are raised in information that comes to your firm, you have a duty to check out the suspicious circumstances and inquire about the end-use, end-user, or ultimate country of destination.” If the explanation does not resolve the concern, refrain from the transaction or provide the relevant information to BIS and wait for direction. Do not ignore or suppress information learned during ordinary business activity.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

7. Record the review and the decision

Create a transaction file that allows another reviewer to understand why the end user was accepted, held or rejected. At minimum, retain:

  • Names, addresses and roles for all known parties.
  • The known end user, intended activity, final delivery address and installation site.
  • Customer, end-user and ultimate-parent headquarters.
  • Item description, model or configuration and ECCN rationale.
  • Screening dates, search terms, lists checked, results and match resolutions.
  • Questions raised, answers received, attestations and documentary support.
  • Applicable license analysis, authorization number if any, reviewer and decision date.

BIS’s advanced-computing industry guidance recommends collecting and reviewing these categories of information. Exact recordkeeping duties vary with the transaction and applicable EAR provisions, so apply the retention rule that governs the shipment.

Documents that help prove who the end user is

No single document proves the end user in every case. Reliability comes from consistency among independent records and from a credible explanation of the item’s deployment.

Document or evidence What it can establish Limits to check
Purchase order and contract Contracting customer, quantity, configuration and stated purpose. May identify a reseller rather than the actual user.
End-user statement or certificate Named user, activity, destination and no-resale commitments. Validate the signer’s authority and compare the statement with facility and corporate records.
Corporate registry and ownership chart Legal existence, incorporation date, parent and control relationships. Check recency; a local registration may omit ultimate ownership.
Commercial invoice and packing list Parties, quantities, ship-to address and description. A freight-forwarder or warehouse address may not be the installation site.
Facility or data-center information Physical location, operator, power, cooling and space available for deployment. Marketing material is not proof of usable capacity.
Technical project documents Why the configuration and quantity fit the stated project. Protect confidential information while checking whether the documents are specific and plausible.
License history and prior shipment records Whether the customer has an established, consistent pattern. A clean history does not authorize a changed user, destination or end use.

Advanced-computing and semiconductor red flags

BIS’s May 13, 2025 industry guidance for advanced-computing integrated circuits and systems lists non-exhaustive indicators. They are prompts for inquiry, not automatic proof of diversion.

  • The customer has no history of advanced-computing shipments before October 2022, followed by a significant increase in such exports.
  • A residential address is used for quantities inconsistent with personal use.
  • The company has little online presence, or different language versions of its website contain inconsistent information.
  • The delivery or installation address is unknown, changes without a credible reason or cannot be independently verified.
  • The ultimate consignee is a freight forwarder, mail center, retailer outside the electronics sector or logistics company that cannot explain why it is receiving a large chip order.
  • The customer’s address is co-located with, or unusually similar to, an address associated with a listed party.
  • A data center cannot affirm adequate electrical power, cooling or physical space for the proposed systems.
  • An infrastructure-as-a-service provider cannot affirm relevant information about its users, including whether users are headquartered in the People’s Republic of China where that question is material to the applicable rule.
  • The customer cannot explain an ultimate parent or headquarters connection to Country Group D:5 or Macau.

Current BIS know-your-customer material also describes semiconductor-related warning signs such as an uncertain license history, overlap between senior or technical staff and listed entities, a successor customer seeking equipment designed for a listed former customer, and facilities physically connected to sites producing advanced-node integrated circuits. The precise relevance depends on the EAR provision and the facts.

Licensing and jurisdiction checks

Classification is necessary but not sufficient

Use the item’s ECCN and technical parameters to determine which controls apply, then separately analyze destination, end user, end use, ownership and transfer route. A classification that does not independently require a license does not override an end-use or end-user prohibition. Conversely, a customer’s clean profile does not cure an incorrect classification.

Country Group D:5 and Macau headquarters rules

The current BIS advanced-computing guidance page states that a license is required to export advanced-computing items to entities headquartered in Country Group D:5 or Macau, or to entities whose ultimate parent is headquartered there, even when the entity itself is located elsewhere. BIS also reports that on April 7, 2026, it extended through December 31, 2026, the timeline for certain companies treated as authorized integrated-circuit designers, allowing additional time for applications and processing.

These are volatile policy facts. Confirm the live BIS guidance, applicable rule text, company status, destination and effective date before relying on them. Do not infer that every semiconductor shipment or every company with a multinational parent falls within the same provision.

Military end users, end uses and U.S.-person activity

The MEU List is not exhaustive. Independently assess whether an unlisted entity meets the applicable military end-user definition. Review end-use controls even where the destination and ECCN would not ordinarily require a license, and check whether restricted U.S.-person activities apply to the proposed support, service or transfer.

How to handle common transaction structures

Distributor or reseller

Require the distributor to identify the next customer, final destination and intended use when the rules or risk profile make that information relevant. A promise to “sell only to approved customers” is weaker than a named end user, verified address and documented transfer controls. Recheck the transaction if the distributor changes the ship-to party or destination.

Freight forwarder, consolidator or mail center

Confirm the forwarder’s limited logistics role and obtain the ultimate consignee and installation site. A forwarder can be a legitimate intermediate consignee, but its address cannot substitute for the final user’s address when the final destination is knowable.

Cloud or infrastructure-as-a-service deployment

Identify the facility operator, physical data-center location and customer using the computing capacity. Ask how the provider verifies user headquarters, controls access and prevents prohibited transfers. An inability to affirm relevant user information or adequate power, cooling and space is a red flag requiring further inquiry.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Contract manufacturer or systems integrator

Separate the integrator’s role from the organization that will own and operate the finished system. Obtain the production site, bill of materials or system purpose as appropriate, and document any onward shipment. Confirm that the integrator is not acquiring equipment for a listed or undisclosed successor customer.

Decision points: release, hold, escalate or decline

Decision When it is appropriate Action
Release for normal authorization review Parties, ownership, use, destination, capability and documents are consistent; screening is clear; no unresolved control applies. Complete the required license and recordkeeping steps before shipment.
Hold for information A material address, ownership, end-use, technical or role detail is missing or inconsistent. Pause shipment, ask specific questions and obtain documentary support.
Escalate A red flag remains after inquiry, a potential list match cannot be resolved, or a complex end-use or parent-company rule may apply. Send the facts to qualified export counsel or the responsible compliance officer; provide relevant information to BIS when appropriate and wait.
Decline or stop The customer will not identify the actual user or destination, explanations are not credible, or the transaction appears prohibited or unauthorized. Do not ship or facilitate the transaction. Preserve the review record.

Common verification failures and fixes

  • Relying on the ship-to address: Ask for the installation site and actual operator; a warehouse does not establish the end user.
  • Screening only the buyer: Screen the end user, ultimate consignee, parent, intermediaries and other material parties.
  • Treating a no-match result as approval: Analyze end-use, ownership, capability and current controls separately.
  • Accepting a generic end-use statement: Require a specific activity, quantity rationale, facility and named user.
  • Ignoring parent-company geography: Trace the ultimate parent and headquarters, not just the local subsidiary.
  • Assuming a distributor absorbs all risk: Obtain onward-customer and destination information when required, and document transfer controls.
  • Failing to revisit an old review: Re-screen and revalidate when the item, quantity, user, destination, ownership or policy changes.
  • Silencing an uncomfortable inconsistency: Follow the BIS duty to investigate red flags and stop or escalate if the concern remains.

Scope and final compliance reminder

This process addresses U.S. EAR due diligence. It does not establish compliance with another country’s export-control, sanctions, customs or import rules. The applicable law depends on the item, exporter, parties, destination, end use, ownership and timing. Recheck the current EAR text, BIS lists, classifications, destination controls and licensing guidance for every shipment.
