What a verified citation must establish
Verification is more than checking whether a string of text resolves to a page. A reliable review answers separate questions about the authority:
- Does the case or source actually exist? Generative systems can invent opinions, citations, quotations, and even legal sources that look plausible.
- Is the identity correct? Party names, court, date, docket or reporter information, and the cited pinpoint must match the opinion you found.
- Does the passage support the proposition? A real case may be cited for a proposition it never decided, or language may be presented without the surrounding qualification.
- Is the quotation exact? Words, punctuation, omissions, and pinpoint references must be checked against the opinion itself.
- What happened later? A decision may have been overruled, limited, distinguished, or otherwise affected.
- Does it carry weight here? Confirm the deciding court, the relevant jurisdiction, and whether the decision is binding or merely persuasive for the court and issue involved.
- Can you comply with the filing rules? The governing court may require disclosure, certification, or another step when AI was used.
Each question can reveal an error even when the citation initially appears authentic.

An eight-step verification workflow
1. Locate the actual authority
Start with the case name, reporter citation or docket number, court, and decision date supplied by the AI system. Search those details in an official court repository or an authoritative legal database. Open the opinion itself, not an AI-generated result page, summary, or answer that merely repeats the citation.
The Federal Court of Australia warns that generative AI can produce fictitious cases, citations, quotations, and references to nonexistent legal sources. It also cautions that a system may confidently confirm information that is inaccurate. A plausible citation and a model’s assurance that a case exists are therefore only search clues.
If the search produces no opinion, stop using the authority until you resolve the discrepancy. Do not silently repair a missing volume, year, or court from guesswork. Search alternative spellings and databases, then record what you checked. If the authority still cannot be located, treat it as unverified and remove it from the draft.

Compare the AI output with the document you located. Check both party names, including punctuation and order; the deciding court; the decision date; the docket number; the reporter volume, abbreviation, and page; and the pinpoint page or paragraph.
A citation can be wrong even when a real case with a similar name exists. An opinion from a different court, a different year, or a related proceeding may not support the proposition. Save the exact citation used in your draft and the exact citation displayed by the authoritative source. Resolve discrepancies before moving on.

3. Read the holding in context
Finding the cited words is not enough. Read the paragraph containing the passage and enough of the surrounding reasoning to identify the question before the court, the facts material to the ruling, and any limitations or qualifications.
Then write the proposition you intend to make in your own words and compare it with what the court actually decided. Distinguish a holding necessary to the judgment from background discussion, a party’s argument, a hypothetical, or dicta. A correct case can still be misquoted or mischaracterized.

Search the opinion for every quotation in the draft. Check the exact wording, capitalization, punctuation, omissions, brackets, and ellipses. Confirm that the pinpoint identifies the page, paragraph, or section where the quoted language appears in the version you are citing.
Read beyond the quoted sentence. A qualification in the next sentence can change the meaning, and a quotation drawn from a party’s brief or a lower-court decision may not be the deciding court’s own holding. If the opinion is available in multiple formats, use the format required by the applicable citation rules and make sure your pinpoint remains reproducible.
5. Check later treatment
Use a reliable citator or equivalent case-history service to determine whether the decision has been overruled, limited, distinguished, vacated, withdrawn, or otherwise affected. KeyCite and Shepard’s are examples of services used for this purpose; the service’s treatment signal is a starting point, not a substitute for judgment.

Open the later decisions that matter. Determine whether the later court addressed the same rule, facts, procedural posture, and jurisdiction. A negative or cautionary flag does not automatically make every proposition in the earlier case unusable, while a positive signal does not prove that the earlier language fits your issue.

Identify the court that issued the decision and classify its authority for the court where you will file. A decision may be binding, persuasive, nonprecedential, unpublished, or subject to a local rule limiting citation.
Check whether the authority is from the correct federal circuit, state, province, or national court. AI outputs can attribute a decision to the wrong jurisdiction or describe persuasive authority as binding. Verify the status under the rules that govern your proceeding, not under a general assumption about the court hierarchy.
7. Check the court’s filing rules
Before filing, read the current rules, standing orders, practice notes, and judge-specific instructions for the particular court. Look for requirements concerning AI-use disclosure, certifications, confidentiality, verification of citations, or responsibility for machine-generated text.
The Federal Court of Australia practice note contains defined disclosure provisions for specified evidentiary uses and allows the Court to require disclosure in other circumstances. U.S. requirements vary among courts. General advice cannot replace the instructions that control your case.

Make the check part of your filing checklist. A citation can be accurate and still require a disclosure or certification that your draft does not contain.
8. Keep a reproducible review record
For each authority you rely on, preserve the source you checked, the citation and version, the passage and pinpoint you reviewed, and the result of the later-treatment check. Record the jurisdictional classification and any filing-rule conclusion.
When AI helped prepare a submission, retain the relevant prompts and generated text as well. A dated review log lets another lawyer retrace your work and demonstrates that the final document was examined by a human rather than filed on the strength of an automated answer.
Why a citation can fail after it resolves

Choosing tools without outsourcing legal judgment
Different resources answer different verification questions. No automated checker alone establishes that an authority supports your argument.

Use an AI system to generate search terms or possible leads if your rules and confidentiality obligations permit, but move immediately to the underlying opinion and current court materials. A green status icon, a matching snippet, or a confident explanation is not proof of authority.
What Mata v. Avianca demonstrates
In Mata v. Avianca, the U.S. District Court for the Southern District of New York found that attorneys submitted nonexistent opinions with fabricated quotations and citations produced by ChatGPT. The court emphasized that existing procedural rules place an accuracy gatekeeping responsibility on the lawyers who sign and file papers. It imposed sanctions under Federal Rule of Civil Procedure 11.
The sanctions order imposed $5,000 in 2023. That is a historical, case-specific amount, not a general schedule of penalties for every inaccurate AI-assisted filing. The practical lesson is broader: using an AI tool does not transfer the attorney’s duty to verify authorities or prevent sanctions when fabricated material reaches the court.
What court guidance says about accuracy
Section 4.4 of the Federal Court of Australia’s practice note states: The presentation of false or inaccurate information to the Court is unacceptable.
Section 4.5 says the responsible person should confirm, among other things, that cited legal authorities exist and support the proposition stated. Those provisions apply to proceedings before that court, but they express the basic verification discipline needed anywhere.

ABA practice commentary reports a U.S. court statement that no brief, pleading, motion, or other filed paper should contain citations supplied by generative AI or any other source that the responsible attorney has not personally read and verified. The commentary attributes the statement to the Noland court. Because the underlying opinion should be consulted before quoting that statement as controlling authority, treat the quotation as reported guidance and check the original decision for the jurisdiction and proceeding involved.
A practical review worksheet
Use one row for every authority that remains in the final document:
- Draft proposition: Write the exact sentence or legal proposition the authority is meant to support.
- Authority identity: Record the complete case name, court, date, docket or reporter citation, and pinpoint.
- Primary-text check: Save the official or authoritative opinion and mark the passage you read.
- Context check: Note the issue decided, material facts, holding, and any limitation that affects your sentence.
- Quotation check: Compare every quoted word, punctuation mark, omission, and pinpoint with the opinion.
- Treatment check: Record the citator search date and the later decisions that change or explain the authority.
- Status check: Identify whether the authority is binding, persuasive, unpublished, nonprecedential, or otherwise restricted in the filing court.
- Rule check: Note any AI disclosure, certification, confidentiality, or judge-specific requirement.
- Human sign-off: Have the responsible lawyer confirm that the citation, proposition, quotation, and filing treatment are accurate.
Before you submit the filing
- Open every cited opinion rather than relying on a generated summary.
- Check that each case name, court, date, citation, and pinpoint matches the document you read.
- Read the cited passage and its surrounding reasoning.
- Confirm that each quotation is exact and not misleadingly truncated.
- Review subsequent treatment and current precedential status.
- Apply the local rules, standing orders, practice notes, and judge-specific directions in force on the filing date.
- Preserve the sources, passages, treatment checks, prompts, and generated material needed to reproduce the review.
- Obtain the responsible human review required by your organization and the court.
Bottom line
An AI-generated citation is a research lead, not legal authority. The safe sequence is to find the real opinion, match its identity, read and test the holding in context, verify quotations and pinpoints, check later treatment and jurisdictional force, follow the controlling filing rules, and document a human review. Skipping any one of those gates can turn an apparently polished citation into an inaccurate or sanctionable filing.
