Verify two things independently before you invest: the developer’s legal authority and the project’s legal, land, planning and payment records. A polished brochure, sales office or promised return cannot substitute for a regulator entry, an official title record, approved plans, a project-specific protected payment account and a contract that matches those records.
The exact documents and legal thresholds depend on the country, state or emirate, and on whether the property is on-plan, completed, leasehold, freehold or in a special economic zone. Use the process below as a cross-jurisdiction checklist, then confirm every requirement with the regulator, company registry, land registry and a locally qualified property lawyer or conveyancer.

What you are trying to prove
Before paying a reservation fee or signing a sale agreement, establish a continuous chain from the legal seller to the land, the approved project and the money route:
- Counterparty: the entity named in the offer and contract exists, is in good standing and is permitted to undertake or sell this type of development.
- Project: the advertised development is registered or licensed where local law requires registration, with the same name, identifier, address, phase and unit types shown in official records.
- Land: the developer owns the relevant parcel or has a documented right to develop it, and the offered plot or unit sits within the registered title and approved plan.
- Construction: planning, building and other technical approvals cover the project actually being marketed, not an earlier or different scheme.
- Money: off-plan payments go through the legally required project escrow or trust arrangement, verified independently with the regulator or bank.
- Contract: delivery, payment, delay, cancellation, transfer and common-area terms match the regulator’s filings and approved specifications.
Failure at any link means you have an unresolved legal or execution risk. It does not automatically prove fraud, but it is a reason to pause rather than rely on a salesperson’s explanation.

Start with the jurisdiction and property type
Identify the governing location before interpreting a document. The relevant authorities may include a company registrar, real-estate regulator, planning or building department, land registry and a special freehold-zone authority. Confirm whether the project is off-plan, under construction or complete, because escrow, advertising, registration and buyer-remedy rules often differ.
Do not transfer a percentage, deposit limit, cancellation period or registration threshold from one market to another. Himachal Pradesh Real Estate Regulatory Authority (HPRERA), for example, publishes India-specific registration and advance-payment guidance. Saudi Arabia’s Real Estate General Authority (REGA) applies its own off-plan licensing, escrow and reservation framework. Dubai Land Department publishes separate project-registration requirements. HM Land Registry’s guidance applies to England and Wales and is not a substitute for another country’s registry.
Write the jurisdiction and property classification at the top of your checklist. If the sales material uses a different address, free-zone name or legal entity from the one you expected, resolve that mismatch before doing any financial analysis.

Match the exact entity everywhere
Copy the developer’s full legal name, registration number, registered address and signatory details from the official company record. Compare them character-for-character with the reservation form, draft contract, invoice, bank instructions and advertising disclosures. Trading names, abbreviations and project brands are not proof that you are contracting with the registered company.
Ask who each participant is:
- the legal seller or developer;
- the landowner, if different;
- the main developer and any sub-developer;
- the broker or sales agent; and
- the marketing company or payment intermediary.
Each role should be identified in writing. A broker may be authorized to introduce a buyer without having authority to sell land or receive purchase money. If a different company signs the contract or receives funds, obtain the legal agreement connecting that company to the licensed developer and have counsel confirm that the arrangement is valid.
Check authorization, not just incorporation
Company incorporation only shows that an entity exists. It does not establish that it may advertise or sell an off-plan project. Where local law requires a developer registration, project license or permit to market units, verify the current status with the competent regulator. Saudi Arabia’s off-plan law, for instance, requires a developer to be registered and the project licensed before off-plan sales or advertising. That is a jurisdiction-specific rule, not a global standard.
Check expiry dates, suspended or cancelled status, permitted activity and the licensed phase. A company may be authorized for brokerage, construction or completed-property sales but not for the off-plan activity being offered.

Find the project in the regulator’s own register
Search by more than the name
Use the regulator’s public register or dashboard rather than a link supplied by the seller. Search the project name, registration or license number, developer name and, where available, the parcel or address. Record a dated copy or screenshot of the result so you can identify later changes.
Match the register to the offer on every material field:
- project name and unique identifier;
- street address, district and land or parcel reference;
- developer, landowner and listed service providers;
- phase, building and unit types;
- approved plans and stated floor areas;
- planned completion or handover date;
- construction-progress disclosures; and
- license status, expiry, suspension or cancellation notices.
HPRERA tells consumers to check a project’s registration number and provides a public dashboard with promoter and project background. REGA’s implementing regulations describe public project information that can include the developer, project land and title details, plans, units, implementation data, progress reports, service providers and dates. The precise fields vary by jurisdiction; the principle is to verify the project in the authority’s system, not merely the developer in a company directory.
Resolve phase and unit discrepancies
Large developments can have separate approvals and escrow accounts for different phases. A registered first phase does not automatically authorize a later tower or a newly advertised block. Ask the seller to identify the exact phase, building and unit in the register and in the contract. If the register lists apartments but the advertisement offers villas, shops or serviced units, stop until the authority confirms that those categories are covered.

Obtain an official title or register record
Request a current official title register or equivalent land record from the land registry, not only a brochure, an uncertified photocopy or a seller’s summary. The record should show the registered owner, title class where applicable, parcel description and any mortgages, charges, restrictions, leases, easements, notices or pending applications.
“You will always need to see an official copy of the register of the developer’s title so that you can see the class of title on offer and the burdens that affect the land.”
HM Land Registry, Practice Guide 41, supplement 4
That guidance is written for England and Wales, but the underlying diligence question is broadly useful: who owns the land, what rights burden it and what right does the seller have to develop or transfer it?

Check the plot against the plan
Compare the registry plan and parcel reference with the approved site plan and the unit’s location. Confirm that the offered building, road access, parking allocation and common areas fall within the registered title or are covered by documented rights. If the developer is not the registered owner, obtain the development agreement, long lease, power of attorney or other instrument that grants construction and sales rights, and verify that it is valid and registrable.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Scan for outdated or missing drivers - takes under a minute3Clear out junk files and repair common Windows errorsBoundary lines on registry plans may be insufficiently precise for a disputed edge. HM Land Registry advises purchasers to consult the developer and, where necessary, a competent land surveyor when the boundary is unclear. Use the local equivalent where a boundary, access route or shared facility cannot be confidently identified.
Understand burdens before paying
A mortgage or charge does not automatically make a project unacceptable, but you need to know how and when it will be released. Restrictions may limit construction, transfer, access, building height or use. A right of way, utility easement, heritage designation or lease may affect the promised layout. Ask for written release or discharge arrangements and ensure the contract states who bears the cost and risk of clearing the burden.
Recheck the title close to completion. HM Land Registry’s plot-sale guidance specifically recommends checking again for pending applications or adverse entries before completion because the register can change after the initial search.
Match planning, building and technical approvals
Obtain permits and approved architectural or layout plans from the competent authority, then compare them with the marketing material and contract. Confirm that approvals cover the same parcel, phase, building height, use, unit count, parking, amenities and construction scope.
Saudi Arabia’s off-plan licensing documentation includes a valid building license and approved designs. Dubai Land Department’s project-registration service lists final building permits and approved project plans among its requirements. These examples show the type of evidence to request; they do not establish identical requirements elsewhere.
Ask whether a material change requires regulator approval or buyer consent. A revised plan that removes an amenity, reduces floor area, changes a view, relocates parking or alters the handover phase can materially change the bargain. Keep the approved plan version and revision date with your contract. If the seller will not provide the plan or says the approval is “in process,” treat the project as not yet verified for that feature.

Trace every off-plan payment through the protected channel
Verify the account independently
Do not rely on labels such as “trust,” “escrow” or “client account.” Contact the regulator or bank using details obtained independently from its official website or branch and ask whether the account is assigned to the named project. Confirm the account holder, project or unit reference, permitted payers, payment instructions and the conditions for withdrawals.
Saudi Arabia’s law provides a separate escrow account for each licensed project, restricts the account to disbursements for that project and requires project-financing funds to be deposited there. Its implementing regulations describe controlled withdrawals. Those safeguards are examples of a local regime, not universal terms. Your jurisdiction may use a trust account, guarantee, solicitor account or another mechanism, or may not provide equivalent protection.
Ask what happens if the project fails
Read the regulator’s rules and the contract for delayed construction, license lapse, cancellation, insolvency and buyer default. Determine who can authorize a refund, whether funds are ring-fenced from other projects, how claims are ranked and whether interest or administrative deductions apply. A payment to a personal account, unrelated company or account that the bank cannot independently confirm is project-specific is a stop-and-verify signal.
Keep an auditable payment trail
Use the exact account name and reference specified by the verified authority. Preserve confirmations, receipts, bank messages and correspondence showing the project and unit. Never change the beneficiary because of an emailed “updated” instruction without reconfirming it through a trusted telephone number or in-person channel.
Read the contract against the official record
Have an independent property lawyer or conveyancer qualified in the investment’s jurisdiction review the contract before signing. The review should compare the contract, register entry, approved plans, project license and payment instructions—not assess only the sales agent’s explanation.
Identity and property description
- Exact legal seller, registration number and authority of the signatory.
- Project, phase, building, unit number, parcel and title references.
- Net and gross area definitions, tolerances, parking, storage and common areas.
- Approved specification, finishes, appliances and the process for substitutions.
Money, timing and delay
- Milestone payment schedule and the account into which each payment must go.
- Reservation-fee treatment, taxes, registration charges and other recurring or one-time costs.
- Contractual completion and handover dates, permitted extensions and the evidence required for an extension.
- Delay compensation, interest, termination, refund timing and deductions.
- Consequences of missed buyer payments and whether the developer can change the schedule.
Transfer and ownership mechanics
- When and how the title, lease or other ownership interest is registered.
- Who applies for registration and pays transfer, infrastructure or connection fees.
- Any mortgage release, completion certificate, snagging process or occupancy permit required before transfer.
- Joint ownership, homeowners’ association, service-charge and common-area rules.
Saudi regulations identify payment schedules, late-payment consequences, delay compensation and termination, completion timing and joint ownership as standard subjects for off-plan contracts. Other jurisdictions may require different terms or give buyers mandatory rights. If a contract changes the unit, delivery date, payment route or refund terms shown in the regulator’s filing, obtain a written correction or stop.

Past performance is useful risk information, but it does not prove that the current project is licensed, funded or free of title problems. Check completed projects through the regulator, company filings and independent professional reports. Confirm the developer’s role in each project; a group may have delivered through a different subsidiary or joint venture.
Best Value
Seek current construction evidence: dated site photographs, inspection or engineer reports, authority progress updates and the identity and qualifications of whoever prepared them. Compare the claimed percentage complete with the regulator’s progress record and the payment milestones. A glossy rendering or undated photograph cannot establish present progress.
REGA’s database rules describe project progress reports and developer ratings. HPRERA says registered project websites should include promoter details and information about projects developed in the preceding five years. Use those records as leads, then verify the specific project and phase you are considering.
Use a consistent framework when comparing projects
When two projects appear similar, score them against the same evidence rather than comparing projected returns alone. A project with a lower advertised price may carry greater title, approval, escrow or delivery risk.

| Execution and contract | Progress reports, delivery history, delay clauses and transfer procedure | What happens if construction, registration or handover is late? |
Keep the evidence for both projects in identical folders and record the date of every registry search. This makes missing information visible instead of allowing a stronger sales presentation to fill the gap.
Stop-and-verify signals
Pause and obtain independent confirmation if any of these occurs:
- The seller will not provide the exact legal entity, registration number or project identifier.
- The project is absent from a register where local law requires registration.
- The title, parcel, approved plan or phase does not match the advertised property.
- The title shows unexplained charges, restrictions, notices or pending applications.
- Payment is requested to a personal, unrelated or unverifiable account.
- The account cannot be confirmed as the legally required project escrow or protected channel.
- The contract changes the unit, delivery date, payment route or refund terms compared with regulator filings.
- Progress evidence is undated, unattributed or inconsistent with authority records.
These indicators are practical risk signals inferred from the official checks; no single signal independently proves that a transaction is fraudulent. The appropriate response is to stop sending money, preserve the documents and ask the regulator and an independent lawyer to clarify the issue.
A practical verification workflow
- Define the jurisdiction and property type. Identify the responsible company, real-estate, planning, land and freehold-zone authorities.
- Create an identity sheet. Record every legal entity, registration number, role, address and signatory.
- Search the regulator’s project register. Save the result and compare the identifier, phase, parcel, units, approvals and status.
- Order the official land record. Check owner, title class, burdens, development rights and the plan boundary.
- Obtain permits and approved plans. Match the physical and contractual offering to the approved documents.
- Verify the protected payment route. Confirm the project account directly with the regulator or bank and test the beneficiary details before transferring funds.
- Mark up the contract. Reconcile identity, unit, specifications, milestones, handover, delay, termination, registration and common-area terms.
- Check progress and history. Compare current authority disclosures with independent site or professional evidence.
- Get local legal advice on unresolved points. Do not sign or pay a non-refundable amount while a title, authority, escrow or contract discrepancy remains open.
- Recheck before completion. Confirm that the title, project license, charges, approved plans and payment instructions have not changed.
What the jurisdiction-specific examples show
Official sources illustrate why a universal checklist cannot replace local rules:
- Saudi Arabia: REGA’s off-plan law and implementing regulations address developer registration, project licensing, approved designs, separate project escrow accounts, controlled disbursements and contract subjects. The law also states that certain non-construction withdrawals are capped at 20 percent of sold-unit value; that figure applies to the Saudi rule described there, not to escrow accounts worldwide.
- Himachal Pradesh, India: HPRERA’s FAQ directs buyers to project registration details and its public dashboard. It also describes local registration thresholds and a 10 percent advance-payment rule tied to a written sale agreement. Those are India-specific provisions, not a general global deposit limit.
- England and Wales: HM Land Registry’s Practice Guide 41, supplement 4, emphasizes an official copy of the developer’s title, the class of title, burdens, plot inclusion and a fresh check before completion. It also recommends professional surveying help when boundaries are unclear.
- Dubai: Dubai Land Department’s project-registration service lists final building permits and approved project plans among the documents used for registering a project. The applicable requirements can depend on the project and development zone.
Use these examples to identify the kinds of records to request, then rely on the current authority for the place where you will buy. Rules, forms and project statuses can change, so check the live register immediately before signing and again before completion.
When to bring in professionals
An independent local property lawyer or conveyancer is appropriate when the seller is not the landowner, a title has charges or restrictions, the contract permits broad changes, the project is cross-border, or the payment protection is unclear. A competent land surveyor can resolve boundary, access and encroachment questions that a registry plan cannot answer. Use professionals selected independently of the developer and give them the complete record set, including advertisements and payment instructions, not just the contract.
No special device or paid product is needed for this diligence. The critical evidence comes from official registries, approvals, bank or regulator confirmation and a careful contract review.
