Use generative AI in game development as a documented, human-supervised workflow—not as an automatic rights, safety, or quality shortcut. Before sending prompts or game assets to a service, check its commercial-use terms, ownership language, attribution and disclosure requirements, distribution limits, retention settings, and training opt-outs. Then classify the use as an internal productivity aid, content shipped to players, or a runtime system that generates responses. Review every output for intellectual-property risk, safety, quality, accessibility, and audience fit; add moderation and reporting when players can trigger generation; and complete the exact disclosure or content survey required by each store.
No universal rule currently determines who owns or can copyright every AI-generated game asset, and no single storefront disclosure rule applies everywhere. Your studio remains responsible for what reaches players, even when a model produced it.

Start with the three ways AI can appear in a game
“AI-generated content” is not one compliance category. The same model can create a private draft, a finished asset installed with the game, or a response generated while a player is online. Treat those cases differently from the start.
1. Internal efficiency tools
Examples include brainstorming quests, summarizing bug reports, drafting code comments, producing placeholder textures, or translating an internal design document. The output may never reach a player. Steam’s Content Survey explicitly says, “Efficiency gains through the use of these tools is not the focus of this section.” That statement describes Steam’s survey scope; it does not exempt a studio from checking its vendor contract, confidentiality duties, or data handling.

2. Content shipped with the game
This includes generated character art, music, voice lines, dialogue, textures, animation, code, localization, or marketing copy packaged in a build and consumed by players. It needs a rights and quality review, an audit trail, and any disclosure required by the destination store. A human artist’s later cleanup does not automatically remove questions about the source material or the service’s terms.
3. Runtime or player-triggered generation
Here the model responds after launch: a chatbot talks to a character, a prompt creates an image, or a system writes a quest from player input. Runtime generation is a moderation feature as much as a content feature. You must define allowed inputs and outputs, block or transform unsafe requests, log enough information to investigate incidents, provide a report or flag route where required, and explain the feature accurately in age and content questionnaires.
Check the service terms before you upload or prompt
Make a written preflight record for every model, API, plug-in, or hosted editor. Keep the service name, plan or endpoint, date checked, governing terms URL, and the person who approved it. Terms can differ by product tier and change over time.

Confirm that the plan permits commercial game development and distribution in every territory where you intend to sell. Read whether you retain rights in your input and output, whether the provider receives a broad license, and whether generated material is offered without an exclusivity guarantee. “You can use the output” is not the same as “you receive copyright” or “the output cannot resemble another work.” Do not promise a studio or client that a model grants copyright unless current, jurisdiction-specific legal advice supports that conclusion.
Attribution, disclosure, and distribution limits
Look for required credit, notices to players, restrictions on sublicensing, limits on physical or console distribution, and rules for voice or likeness simulation. Record the exact wording you must use and where it must appear. A store’s form, a game’s credits, and an in-game notice can be separate obligations.
Training, retention, and deletion
Identify whether prompts, uploaded concept art, source code, voice recordings, telemetry, or player messages are stored, reviewed, or used to train models. Check the default retention period, enterprise controls, deletion procedure, subprocessors, geographic processing, and opt-out mechanism. Roblox’s AI data-sharing documentation illustrates why this matters: creator content may be used for model training when the creator has not opted out, and the platform documents controls for data-sharing preferences. Never upload confidential builds or personal player data until the applicable setting and contract are approved.

Make the record reproducible
Store prompts, model and version, seed or settings when available, input assets, output files, edits, reviewer, date, and final disposition. For code, preserve the generated suggestion and the human-authored change. For audio or images, keep the source file and the shipped derivative. This record helps answer a takedown, player complaint, rights question, or internal audit months later.

Who is responsible for an AI-generated asset?
The developer or publisher remains accountable for the game. Roblox states in its creator documentation: “You are responsible for the content delivered to users, even if it’s AI-generated.” Its guidance also says third-party outputs delivered to users must meet platform standards and must not be used to circumvent safety measures.
Responsibility has several parts:
- Rights: investigate whether an output copies protected art, text, music, code, a distinctive character, or a person’s voice or likeness. Keep evidence of your process and licenses for any non-generated source material.
- Law and contracts: check privacy, publicity, consumer-protection, labor, accessibility, and confidentiality obligations that apply to your region and production agreements.
- Platform standards: apply the store’s current content, safety, age-rating, and disclosure rules. Passing a model’s safety filter is not proof that a store will accept the result.
- Quality and audience fit: test factual claims, cultural references, localization, difficulty, tone, performance, and accessibility. A technically valid file can still be unsuitable for children or offensive to a community.
Use a human approval gate for anything that ships. A model can accelerate drafts; it cannot sign your rights clearance, age-rating declaration, or release checklist.
Can you use AI-generated art, sound, or code in a game?
You may be able to, but the answer depends on the service terms, the asset’s provenance, the edits you make, and the laws and platform rules that apply to your release. Do not treat “commercial use allowed” as a blanket warranty.
Asset review before integration
- Record the tool, account or plan, model/version, prompt, input references, and date.
- Check the service’s license for commercial distribution, attribution, sublicensing, exclusivity, and prohibited uses.
- Search for recognizable logos, characters, compositions, lyrics, code fragments, or voices that could indicate copying or unauthorized imitation.
- Have a qualified reviewer examine high-risk material, especially realistic people, branded elements, music, voice, and training data supplied by contractors or players.
- Make human edits where appropriate, but document them; editing does not erase an underlying rights problem.
- Approve, replace, or quarantine the asset. Do not ship an item merely because it passed a visual or automated similarity check.
Keep an asset register
For each shipped item, store its source, license evidence, review decision, editor, and the build in which it appears. Mark whether it is generated, human-authored, licensed from a third party, or a combination. Give legal and publishing teams a way to locate an item quickly if a claim arrives.
Build a responsible production workflow
A repeatable workflow prevents individual developers from making incompatible assumptions about different tools.

Step 1: Define the use case and risk level
Write one sentence describing what the model will do, who can trigger it, what data it receives, and whether the result ships. A private placeholder generator is lower exposure than a child-facing chatbot that remembers conversations. Classify the use as internal, shipped static content, or live generation, then add risk labels for personal data, minors, voice or likeness, copyrighted references, and user-generated input.
Step 2: Approve the data path
Draw the path from developer or player to provider, storage, moderation service, analytics system, and deletion endpoint. Remove unnecessary identifiers, redact secrets, and set the shortest practical retention period. Decide who can access prompts and logs. If the provider cannot explain training use, retention, or deletion clearly enough for the project, choose a different configuration or do not upload the data.
Step 3: Set technical boundaries
- Use allowlists for tools, models, domains, file types, and production environments.
- Limit prompt and output length, rate, token budget, and file size.
- Keep secrets and signing keys out of prompts and client code.
- Separate development, test, and production credentials.
- Version prompts and safety policies so a model change can be rolled back.
- Fail safely when the model times out, returns malformed data, or is unavailable.
Step 4: Test adversarially
Test direct prompts, misspellings, encoded requests, repeated attempts, context injection, image-plus-text combinations, and attempts to extract system instructions. Test both player inputs and model outputs. Include accessibility, cultural sensitivity, harassment, sexual content, self-harm, illegal activity, privacy leaks, and impersonation cases relevant to your audience. Human reviewers should sample ordinary outputs as well as obvious attacks.
Step 5: Add human and automated review
For static assets, require a named reviewer before merge. For live output, use layered controls: input filtering, model or classifier checks, output filtering, rate limits, escalation queues, and a block or fallback response. Automated moderation should inform human review rather than conceal uncertainty. Define what happens when a user reports an output and how quickly a moderator can remove it.
Step 6: Monitor after launch
Track blocked requests, reports, false positives, latency, cost, repeated abuse, and unexpected topics without collecting more personal data than necessary. Review samples under an access-controlled process. Publish a change log for model, prompt, policy, or age-label changes that could alter player experience. Have a kill switch that disables generation while the rest of the game remains usable.
Platform rules differ by destination
The following comparison is a point-in-time summary of the cited official guidance. Recheck each platform’s current form and policy immediately before submission; one store’s treatment must not be generalized to another.

Runtime generation needs moderation, reporting, and age design
A player-facing model can produce harmful material even when your examples are safe. Design the feature around failure, not only the ideal conversation.

Define what the model is allowed to do
Constrain the character’s role, topics, vocabulary, tools, memory, and output format. Prefer structured responses that your game can validate over unrestricted prose. Refuse requests outside the feature’s purpose and return a neutral fallback. Never let model output directly execute privileged code, grant items, reveal secrets, or change moderation settings.
Moderate both sides of the exchange
Filter player input before it reaches the generation service and inspect the response before display. Add rate limits and abuse controls per account, device, and network where lawful. Provide a visible report or flag action, preserve the minimum evidence needed for an investigation, and tell players how reports are handled. Google Play’s policy specifically requires covered AI content-generating apps to prevent restricted content and offer in-app reporting or flagging for offensive output.
Use age-appropriate defaults
Do not assume a general audience label makes an unrestricted chatbot safe for children. Roblox requires disclosure of player-interactive generated responses in its Content Maturity questionnaire; extended continuous interaction or cross-session memory can trigger additional questionnaire requirements and a Restricted maturity label. Explain memory in plain language, make it off by default for younger audiences where appropriate, and provide deletion controls.
Handle player data and training risk deliberately
Player chat, voice, names, location hints, support tickets, and uploaded creations can be personal or confidential. Decide whether each field is necessary before sending it to a model.
- Minimize: replace account identifiers with short-lived tokens and remove unrelated conversation history.
- Inform: tell players what is processed, why, for how long, and whether a provider may use it for training.
- Control: offer opt-out or deletion where the service and applicable law require it; honor platform-level data-sharing preferences.
- Secure: encrypt transit and storage, restrict staff access, and separate moderation evidence from general analytics.
- Respond: document a process for access, deletion, incident response, and provider termination.
Roblox’s AI data-sharing notice is a concrete example of why defaults deserve attention: creator content can be included in model training unless the creator opts out. A studio should obtain equivalent clarity from every provider it uses.
Best Value
Make disclosures precise rather than symbolic
Disclose the actual role of AI: for example, “AI-assisted concept images were edited by our art team,” “some localization drafts were generated and reviewed by human translators,” or “players can request dialogue from a moderated runtime model.” Avoid saying simply “AI was used” when the distinction affects a player’s expectations.
Map each disclosure to its destination: store survey, game description, credits, privacy notice, terms of service, age-rating questionnaire, or in-game notice. Record the submitted answer and the build it describes. If a later update adds runtime generation, new memory, or a new category of shipped content, revisit the disclosure instead of relying on the original submission.
What industry adoption statistics do—and do not—show
Google’s AI Meets The Games Industry report, surfaced in 2025, reports that 90% of game developers were already using AI, 63% expressed concern about data ownership, and 35% worried about player-data privacy. The available report extract does not establish the survey fieldwork date or methodology, so these figures should be attributed to that report rather than presented as a verified, universal industry rate. They are useful signals: adoption does not remove the need for data governance or rights review.

Where broader governance fits
The European Commission describes its General-Purpose AI Code of Practice, published July 10, 2025, as a voluntary tool addressing provider transparency and copyright obligations, with a safety and security chapter relevant to providers of the most advanced systemic-risk models. It is useful context when evaluating a model provider’s governance posture, but it is not a substitute for a game studio’s contract review, platform submission rules, privacy duties, or individualized legal advice.
A release checklist for responsible generative AI
- Use case is classified as internal, shipped static content, or runtime generation.
- Commercial-use, output-rights, attribution, disclosure, distribution, retention, training, and deletion terms are saved for the exact service plan and date.
- Inputs exclude unnecessary secrets and personal data; approved data-sharing and opt-out settings are enabled.
- Every shipped asset has a source record, human reviewer, rights assessment, and final build reference.
- Runtime features have input and output moderation, rate limits, fallbacks, logging, reporting, escalation, and a kill switch.
- Age, memory, and child-safety behavior are represented accurately in each destination’s questionnaire.
- Store disclosures match the feature that actually ships, including any live generation.
- Monitoring, incident response, deletion, and provider-offboarding owners are named.
- The team has tested ordinary use, adversarial prompts, privacy leakage, unsafe output, accessibility, localization, and service failure.
Responsible use is therefore a production discipline: choose a service whose terms fit the project, keep humans accountable for every release decision, and design player-facing generation so that unsafe or unlawful output is an anticipated failure mode with a tested response.
