AI-generated footage is not automatically copyright-safe, trademark-safe, or free to use commercially. Before publishing or licensing a clip, identify every source asset and reference image, confirm that you had permission to use them, inspect the rendered video for recognizable protected material, and check whether the scene could imply a brand’s sponsorship or a real person’s endorsement. Keep the tool’s terms, licenses, releases, edit history, and records of your human contributions.
This guide applies primarily to U.S. law as understood from federal guidance available through October 13, 2026. Copyright, trademark, publicity, privacy, advertising, and unfair-competition questions depend on the facts, the jurisdiction, and the way the footage is distributed. The checks below reduce risk; they cannot guarantee that a particular clip is lawful.

The short answer: clear the inputs, the output, and the impression
Use this order for every AI video, whether it is a short social post, a client advertisement, a film insert, or a monetized channel segment:
- Map the inputs. List footage, photographs, music, sound effects, logos, character references, prompts containing third-party material, and images uploaded to guide a model. Mark each item as original, licensed, public domain, supplied by a client, or uncertain.
- Check the tool terms. Save the terms in force when you generated the clip and confirm what they say about your rights, commercial use, user uploads, model training, indemnity, and restrictions on real people or brands.
- Review the rendered frames and audio. Look for copied or near-copied footage, characters, distinctive products, packaging, logos, slogans, music, voices, and recognizable people. Inspect the final edit, not only the text prompt.
- Analyze the context. Ask whether a viewer could think that a company sponsored, approved, supplied, or endorsed the content, or that a real person actually performed the action shown.
- Document the human work. Preserve your script, shot list, selections, timing decisions, compositing, color work, sound edit, and other creative choices. These records matter if you later claim copyright in a mixed human-and-AI work.
If a clip contains an uncertain input, an identifiable person, a recognizable mark, or a potentially misleading commercial impression, pause publication and obtain permission or fact-specific legal advice.

Copyright has two separate questions
Who authored the expressive elements in the final video?
The U.S. Copyright Office’s Part 2 report, released January 29, 2025, says AI-assisted output may receive copyright protection when a human author determines sufficient expressive elements. Human-authored material that remains perceptible in the result, and human creative arrangement or modification of generated material, can provide a basis for protection. Merely writing prompts does not, by itself, make the machine-determined expression your authorship.
The report does not say that every AI-assisted video is uncopyrightable. A larger work can contain AI-generated material and still receive protection for the portions in which a person made the creative decisions. The scope of any protection follows the human contribution; it does not automatically cover every frame the system generated.
As Register of Copyrights and Director Shira Perlmutter said in the Copyright Office’s January 29, 2025 announcement: “Where that creativity is expressed through the use of AI systems, it continues to enjoy protection. Extending protection to material whose expressive elements are determined by a machine, however, would undermine rather than further the constitutional goals of copyright.”

Authorship of the output is separate from permission to use what went into the workflow. A clip can contain substantial human editing and still infringe if the editor incorporated unlicensed footage, photographs, music, sound effects, artwork, or other protected material. Review the license for every uploaded or imported asset, including material supplied by a customer or collaborator.
“AI-generated” describes a production method. It does not establish ownership, public-domain status, permission, or fair use. A model’s ability to reproduce a look or subject is not evidence that the source was free to copy.

| Input or reference | What to record | Warning signs |
|---|---|---|
| Video or photographs | Creator, source URL or delivery record, license scope, territory, duration, attribution terms, and expiration | “Free” wording without a license, unclear uploader, or restrictions on commercial or derivative use |
| Music and sound | Composition and recording owners, synchronization and master rights, platform limits, and any content-ID conditions | A personal streaming subscription, a sample with no clearance, or a license limited to private use |
| Client or user uploads | Written permission, warranties, indemnity language, and the person authorized to grant the rights | The sender cannot identify the rights holder or says the material was found online |
| Reference images and prompts | Who made the image, what rights cover model input, and whether the prompt names a living artist, character, brand, or person | Uploading a third party’s work without permission or asking for a close recreation of protected characters or artwork |
| Generated assets | Tool, model or feature, account, generation date, settings, source images, and the terms version | Terms that reserve broad rights, prohibit certain commercial uses, or change between generation and publication |
Keep original files and licenses rather than relying on a screenshot of a product page. If a client supplied an asset, obtain a written statement identifying the rights they are granting and the uses they authorize.
Do these 3 things before closing this tab:
1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsA practical clearance workflow
Step 1: Define the intended use
Write down where the footage will appear, who will see it, whether money is involved, and whether it promotes a product, service, person, or organization. A private experiment, editorial report, paid advertisement, in-game cinematic, and stock-footage license do not create the same risk profile. Note the countries of the creator, depicted person, client, audience, and distribution platforms.
Step 2: Classify every element
Separate four categories: your own human-authored material; licensed or permissioned third-party material; material that may be public domain; and material whose status is unknown. Do not place an uncertain asset in the “public domain” column simply because an AI system generated a new version of it.
Step 3: Generate conservatively
Use original or licensed references. Avoid prompts that request a living performer’s exact likeness or voice, a copyrighted character, a distinctive trade dress, or a near-identical recreation of a known commercial. If a client wants that result, obtain written authorization before generation and confirm that the authorization covers synthetic or altered depictions.
Step 4: Inspect the output frame by frame
Review beginning, ending, transitional, and background frames at full resolution. Check signs, labels, storefronts, uniforms, product silhouettes, tattoos, artwork on walls, vehicle markings, and screen content. Listen for accidental music, dialogue, or voice imitation. A logo that appears for a moment can still affect the commercial impression.

Pick the symptom - the matching free tool is one click away.
Step 5: Test the viewer’s likely impression
Ask an uninvolved reviewer what they think the clip communicates. Would they believe a brand supplied or approved it? Would they identify a real person and assume that person used the product, made the statement, or agreed to appear? Would the footage look like a news recording of a real event? Rewrite the scene or add a clear disclosure when the answer could mislead.

Step 6: Resolve problems before export
Replace questionable references, crop or blur marks where appropriate, remove accidental music, obtain releases, or redesign the scene. Do not assume that a disclaimer cures a misleading image or that a few altered pixels eliminate a recognizable work. Save both the rejected version and the reason for the change in your project record.
Step 7: Preserve the final record
Store the final script, prompts, generation logs, source files, licenses, releases, edit decisions, approval emails, claim substantiation, and the exact exported file. Record the publication date, territory, platforms, and any later edits.
Using copyrighted source material and fair use
If you rely on fair use in the United States, analyze all four statutory factors rather than applying a percentage rule:
Recommended Free Tools
- Purpose and character: commercial advertising generally receives less favorable treatment than criticism, commentary, news reporting, teaching, or other transformative uses, although no category decides the result by itself.
- Nature of the work: highly creative works usually receive stronger protection than factual material.
- Amount and substantiality: both the quantity and the qualitative importance of what you used matter. There is no automatically safe number of seconds, frames, words, or percentage.
- Effect on the potential market: consider whether your use substitutes for the original or harms a market the rights holder reasonably exploits.
Commercial purpose does not automatically defeat fair use, and a short excerpt is not automatically fair. The same input may be defensible in a critical documentary and indefensible in an advertisement designed to borrow the original’s appeal. When the analysis is central to a launch or high-value production, obtain advice on the specific facts.
Recognizable brands and trademarks
A generated scene can create trademark issues even when no original logo file was uploaded. Inspect for names, logos, package shapes, color combinations, storefront designs, uniforms, slogans, and other cues that identify a source. The U.S. Patent and Trademark Office explains that marks can be confusingly similar in sound, appearance, meaning, or overall commercial impression, and that the relationship between the relevant goods or services also matters.
| Screening question | Why it matters | Safer response |
|---|---|---|
| Is a mark or distinctive product cue visible or spoken? | Recognition can exist without a perfectly reproduced logo. | Remove, redesign, obscure, or obtain permission when the mark is unnecessary. |
| Does the scene imply sponsorship, approval, or supply? | Viewers may infer affiliation from placement and context. | Change the setting and script; do not rely solely on a small disclaimer. |
| Is the footage an advertisement, placement, comparison, or review? | Commercial contexts increase the importance of source and endorsement impressions. | Verify the claim, identify the relationship accurately, and document approvals. |
| Are the goods or services related to the mark? | Related markets can make confusion more plausible. | Use a fictional, non-confusing design or seek a clearance review. |
These are screening questions, not a legal opinion. USPTO guidance recommends a comprehensive clearance search before adopting a mark. Search results alone do not answer whether a particular depiction is permissible, especially when the footage combines a mark with a sales message.

Real people, digital replicas, and synthetic likenesses
A realistic AI depiction of an identifiable person raises issues independent of copyright in the video. Depending on the facts and state, claims may involve publicity, privacy, false endorsement, or a digital replica. A person can be recognizable from facial features, voice, body, mannerisms, biography, or a combination of details even when the clip says it is synthetic.
The Copyright Office’s Part 1 report on digital replicas, dated July 31, 2024, recommended federal legislation addressing knowing distribution of unauthorized realistic digital replicas. That recommendation is not itself evidence that the proposed federal protection became law.
USPTO name, image, and likeness guidance, updated September 17, 2026, explains that NIL protection generally comes from state law and varies by state. It also describes federal trademark protection when a person’s identity is used commercially as a mark for goods or services. For a recognizable real person, especially in promotion, verify a release that covers synthetic depiction, voice, edits, territories, media, duration, and paid advertising. Do not assume that changing the person’s name makes the use safe.
Advertising, endorsements, and disclosures
The Federal Trade Commission says advertising claims must be truthful, non-deceptive, and supported by evidence. Its endorsement guidance says endorsements must be truthful and not misleading; an endorser should not claim experience they did not have, and material connections that affect how consumers evaluate an endorsement should be disclosed when required.
AI footage can create an endorsement impression without a spoken testimonial. A synthetic person shown using a supplement, praising a service, wearing a product, or appearing beside a company logo may communicate approval. A fictional scene can also imply that a named company sponsored or approved production. Evaluate the overall impression, including captions, voice-over, camera framing, placement, and the surrounding ad copy.
The FTC’s endorsement guides are guidance rather than regulations, but the agency may investigate potentially unfair or deceptive practices under the FTC Act. A disclosure that is hidden, fleeting, or contradicted by the images may not correct a misleading impression. Keep the evidence supporting every objective claim made in or alongside the video.
Registering a mixed human-and-AI work
The Copyright Office’s March 16, 2023 registration announcement says applicants have a duty to disclose AI-generated content in works submitted for registration. In practice, identify the human-authored portions and describe the human creative contribution accurately. Do not claim that you authored expressive elements that were determined by the system.
Best Value
For a mixed work, your records should show which scenes, edits, arrangements, dialogue, visual effects, compositing, sound design, or other elements were created or selected by people. The Copyright Office’s January 29, 2025 framework treats human creative control as the relevant issue, not the mere presence or absence of an AI tool.
A risk triage table for publishing decisions
| Situation | Initial risk | Action before release |
|---|---|---|
| Original script and footage, AI used for background cleanup, no marks or people | Lower, subject to tool terms | Document the human edit and retain the terms and project files. |
| Licensed footage transformed with AI and substantially re-edited | Manageable if the license covers derivatives and the tool workflow | Verify license scope, platform rights, and any attribution or model restrictions. |
| Unknown image or music uploaded as a reference | High | Remove it or obtain permission; do not rely on the generated result to erase provenance. |
| Recognizable logo or trade dress in a product advertisement | High | Clear the mark and the implied relationship, or redesign the scene. |
| Real person’s face or voice used in a commercial | High | Obtain a release covering synthetic likeness and advertising use; check applicable state law. |
| Fictional person shown making a factual product claim | High advertising risk | Substantiate the claim and ensure the presentation cannot be mistaken for a real customer endorsement. |
What to do when a problem appears after generation
An accidental logo, character, or song appears
Stop the export, isolate the affected timecodes, and determine whether the element came from an input, a model output, a template, or the edit. Replace the shot or audio where possible. If the asset is licensed, check whether the license covers this use rather than assuming that possession of the file is enough.
Free tools Windows power users keep installed
One-click scans. No signup required.
A person says they did not authorize the depiction
Remove paid distribution while you investigate. Preserve the file and generation records, identify the jurisdictions involved, and seek advice on publicity, privacy, false-endorsement, and digital-replica exposure. Do not publish a revised version that remains recognizably the same person without resolving permission.
A client demands an unlicensed reference
Explain in writing which asset is uncertain, what use is planned, and what permission is needed. Offer an original or licensed substitute. If the client supplies a warranty, read its scope; a promise that they “own the content” may not cover publicity rights, music, trademarks, or synthetic alterations.
A complaint arrives after publication
Preserve evidence, pause campaigns that amplify the disputed clip, and route the notice to the person responsible for legal review. Do not delete records or make admissions before understanding the claim. A prompt, documented response can limit ongoing distribution while the facts are checked.
Geography, timing, and limits of this guidance
This article describes U.S.-focused federal guidance available through October 13, 2026. State publicity and privacy laws differ, trademark outcomes depend on the marks and markets involved, and fair-use results turn on the particular facts. Rules outside the United States may differ substantially. Recheck Copyright Office reports, applicable state and federal law, USPTO materials, FTC guidance, and the terms of the tools and platforms you use before a major release.

AI footage becomes easier to defend when you can show where every input came from, what human beings contributed, what appears in the final frames and soundtrack, and why the presentation does not imply unauthorized sponsorship or endorsement. Treat generation as one production step—not as a clearance decision—and resolve uncertain source material, marks, likenesses, and advertising claims before publication.
