Moving to India for a technology role requires three separate decisions: the Indian permission that covers your actual work, the effect of leaving the United States on any current U.S. immigration status, and your tax residence and filing obligations in both countries. An intracompany transfer, a new job with an Indian employer, and remote work for a U.S. company can produce very different outcomes.
Before booking travel or changing payroll, document your citizenship, green-card or U.S. visa status, employer structure, proposed duties, work location, expected days in each country, and family members’ statuses. Then obtain written immigration, tax and employer-compliance advice for those facts.

Define what “transfer” means in your case
The phrase can describe several arrangements that are legally unrelated. Classifying the arrangement first prevents the most common mistake: treating a U.S. immigration category as permission to work in India.

| Proposed arrangement | Primary permission question | Typical tax and payroll questions |
|---|---|---|
| Move to an Indian office of your existing corporate group | Which Indian visa permits the duties and employment relationship? | Which entity employs and pays you, and where are payroll, benefits and equity administered? |
| Accept a new job with an Indian company | Whether an Indian employment visa is available for your nationality, role and contract | Indian payroll, withholding, social-insurance treatment and U.S. filing obligations |
| Work from India for a U.S. employer | Whether the activity is authorized under the Indian category you will use; employer permission alone is not enough | Indian payroll or registration, U.S. reporting, treaty analysis and possible state ties |
| Enter the United States through an intracompany transfer | Whether the U.S. L-1 requirements are met; this is a U.S. admission category | U.S. payroll and residence rules, not Indian work authorization |
Ask your employer to state in writing the employing entity, regular work location, expected travel, payroll country, benefits, equity treatment, data-security restrictions and who is responsible for immigration filings. A verbal “remote is fine” answer does not settle immigration, employment-law, tax or corporate-presence questions.

Indian work authorization: start with the activity, not the label
India’s official visa portal lists an Employment visa and describes a grant period of one year or the employment-contract period. The portal also lists proof of employment and terms and conditions among the supporting material. Foreign nationals generally need a valid travel document and visa to enter India, subject to limited categories for which an e-visa may be available. The exact checklist depends on nationality, mission and the proposed job, so use the current instructions of the relevant Indian mission.
When an employment visa is the relevant route
If you will perform a regular job in India, an employment-visa analysis is the natural starting point. Prepare the signed offer or assignment letter, job description, employer details, compensation and the documents the mission currently requests. Check whether the role, salary, employer and worksite satisfy current Indian requirements; do not assume that approval for one position covers a later change in employer or duties.
Keep the visa’s validity and the employment contract’s term separate. The official provision describes a grant of one year or the contract period, but the applicable conditions and renewal process must be confirmed for your nationality and case. Do not begin work while relying on an application receipt or on an entry permission that does not authorize employment.

Why a business visa is not a generic work visa
India’s e-business visa page describes business purposes. A business visit can therefore be materially different from taking a position, supervising an Indian team as an employee, writing production code for the local operation or otherwise performing ordinary employment. Do not infer work authorization from a business-trip category. If your planned activity falls between meetings, training, implementation and productive work, describe it precisely to the Indian mission or a qualified adviser before travel.
Documents and facts to verify before applying
- Your nationality, current place of residence and the Indian mission that will process the application.
- The employing legal entity, Indian worksite, duties, compensation and contract duration.
- Whether the role is a transfer within a related group or employment by a new company.
- Passport validity, prior Indian visits, accompanying family members and any restrictions attached to their status.
- Whether the visa permits the full period, locations and activities you expect, including travel between Indian offices.
L-1 and an Indian employment visa authorize different things
An L-1 is a U.S. immigration classification for a qualifying transfer into the United States from a related foreign office. It does not authorize employment in India. U.S. Citizenship and Immigration Services requires evidence of the corporate relationship, qualifying U.S. duties and qualifying prior employment abroad. Its policy manual describes at least one continuous year of qualifying employment abroad within the preceding three years for the beneficiary.

| Question | Indian employment visa | U.S. L-1 classification |
|---|---|---|
| Country whose work or admission it addresses | India | United States |
| Core purpose | Permission for a foreign national to undertake authorized employment in India | Admission or status for a qualifying intracompany transfer to the United States |
| Employer relationship | Must match the Indian application and permitted employment | Requires a qualifying relationship between the foreign and U.S. entities |
| Key evidence identified by the official source | Employment proof and terms and conditions | Corporate relationship, qualifying duties and at least one year of qualifying foreign employment in the relevant three-year period |
| Does it authorize work in the other country? | No; it is not U.S. work authorization | No; it is not Indian work authorization |
If an employer says “we can transfer you on L-1” while you plan to work from India, ask which country the proposed filing covers. The L-1 discussion may be relevant to a later move to the United States, but it cannot substitute for Indian permission.
How leaving the United States can affect your current status
Your citizenship and current U.S. status determine which U.S. consequences need review. A U.S. citizen does not lose citizenship by relocating, but remains within the U.S. tax system. A green-card holder, a worker in a temporary nonimmigrant classification, and a person with a pending immigration benefit face different travel, maintenance and reentry issues. The facts include the length of the absence, the status document, any pending application and the location of the U.S. employer or sponsoring entity.
Do not cancel a U.S. lease, abandon a green card, withdraw a petition or assume a visa remains usable without case-specific advice. If you expect to return to the United States through an intracompany transfer, separately test the L-1 requirements; an Indian employment visa does not create an L-1 entitlement.
Family members require their own analysis. Their visas, school enrollment, employment permission, health coverage and travel documents may not track the worker’s status automatically. List every accompanying person and ask the adviser to address their dates and documents.
Immigration status is not tax residence
The IRS distinguishes visa classification from U.S. tax residence. For noncitizens, the green-card test and substantial-presence test are central U.S. residence concepts. A person can hold a U.S. immigration status without being a U.S. tax resident, or be a U.S. tax resident under tax rules while using a different immigration category. Determine tax status separately for each calendar year.

Indian residence uses day counts and exceptions
The Income Tax Department’s overview for assessment year 2026–27 identifies general presence tests that include:
The Tool Desk
Outbyte Driver Updater FREEScan for outdated or missing drivers - takes under a minuteDriver Scan →Outbyte PC Repair FREEClear out junk files and repair common Windows errorsFree Scan →- Being in India for 182 days or more during the relevant year; or
- Being in India for 60 days or more during that year and 365 days or more during the preceding four years, subject to exceptions and additional provisions.
The department labels the page an overview rather than an exhaustive determination. Nationality, employment status, visits in earlier years and special statutory rules can change the result. Keep an entry-and-exit calendar and confirm the rules for the relevant Indian tax year rather than relying on a rough “six months” estimate.
Indian residential status is a tax classification, not a visa category. The Income Tax Department states: “In order to determine whether an Individual is a Non-Resident or not, his residential status is required to be determined u/s 6 of the Income Tax Act, 1961.”
U.S. citizens and qualifying U.S. residents generally still file from India
Moving abroad does not by itself end U.S. filing or federal income-tax duties. U.S. citizens and qualifying U.S. residents generally remain subject to U.S. income tax on worldwide income. IRS guidance specifically states that wages earned outside the United States for a foreign employer by U.S. citizens or residents are subject to U.S. federal income tax.
Your filing package may therefore include foreign wages, foreign bank or investment information and forms associated with foreign taxes or accounts. The exact forms depend on citizenship, residence, income, assets, employer and transactions. A U.S. citizen should not treat an Indian payroll statement as a replacement for a U.S. return, and a noncitizen should not assume that leaving the country automatically ends U.S. residence for tax purposes.

Do not assume one year abroad creates a tax exclusion
The foreign-earned income exclusion is subject to a test and additional rules. Living abroad for one year alone is not enough. The IRS states: “You do not automatically acquire bona fide resident status merely by living in a foreign country or countries for one year.”
Compare the exclusion with the foreign tax credit using your actual income, Indian tax paid or accrued, housing facts, filing status and income sources. The choice can affect U.S. tax, carryovers and the treatment of different income types. It is not a universal “no U.S. tax” switch, and claiming an exclusion does not erase other reporting duties.
The U.S.–India treaty can coordinate taxes, but it does not erase compliance
The United States and India have an income-tax treaty. Treaty relief is applied article by article to particular income, residence and procedural facts; it is not a blanket promise that only one country will tax you or that one return will be sufficient. Start with the current IRS treaty publication and treaty text, then have a cross-border professional map the articles to your employment income, investments, benefits and residence status.
Potential double-tax relief can involve treaty provisions, the foreign tax credit or the foreign-earned income exclusion, but eligibility and ordering matter. A credit generally depends on the nature of the foreign tax and the related income; an exclusion changes the income included in the U.S. calculation. Model both countries together before choosing a position, especially when compensation includes equity, bonuses, deferred pay or employer-provided housing.
State taxes remain a separate U.S. question
Federal residence analysis does not decide state residence. Domicile, statutory residence, days present, home ownership, family location and continuing ties are treated differently by each state. The state you leave may still require a part-year or resident return, estimated payments or documentation that you changed domicile.

Identify the departure state at the start of planning and read that state tax authority’s current guidance. Do not infer the answer from your federal return, your Indian visa or your employer’s remote-work policy.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Remote work for a U.S. company: the employer’s approval is only one piece
“Can I work remotely from India for a U.S. company?” has at least four separate answers:
- Immigration: Does your Indian status permit the productive work you will perform?
- Employment and payroll: Which entity employs you, withholds tax and provides statutory benefits?
- Corporate tax and registration: Could your activities create obligations for the company in India?
- Security and regulation: Are customer data, export controls, regulated systems or internal policies compatible with the location?
An employer’s permission addresses only the employer’s internal decision. It does not grant immigration authorization, settle Indian employment law or determine tax residence. Have the company’s legal, payroll, security and immigration teams approve the arrangement in writing before you begin working from India.
Build a tax and payroll model before the move
Give the adviser a month-by-month timeline rather than a single relocation date. Include expected days in India and the United States, salary currency, bonuses, equity vesting, signing payments, severance, benefits, retirement contributions, housing, travel and investment income. Ask for a country-by-country schedule showing where each item is sourced, which country may tax it, the filing date, withholding method and available relief.
Confirm whether the employer will keep U.S. payroll, move you to an Indian entity, use a local employment arrangement or engage you under another structure. Each option can change withholding, benefits, social-insurance treatment, currency conversion and the company’s compliance burden. Do not choose a structure solely because it is administratively convenient.
A practical sequence for transferring your career
- Inventory status and citizenship. Record citizenship, green-card status, current U.S. visa, pending applications and every family member’s status.
- Describe the job precisely. State the legal employer, manager, worksite, duties, travel, contract term and whether the move is inside a qualifying corporate group.
- Get the Indian category confirmed. Use the current Indian mission instructions and obtain a written explanation of why the proposed visa covers the actual activity. Do not rely on a business visa assumption.
- Check U.S. immigration consequences. Ask how the departure affects the current status, future reentry and any planned U.S. intracompany transfer.
- Map physical presence. Maintain an India–U.S. day calendar for the relevant tax years, including arrival and departure dates and business travel.
- Determine tax residence independently. Apply U.S. citizenship, green-card and substantial-presence rules as relevant, then apply Indian residence rules and exceptions.
- Model treaty and relief positions. Compare foreign tax credit and foreign-earned income exclusion consequences with a professional using projected compensation and Indian tax.
- Resolve state ties. Identify the departure state, domicile facts and any continuing filing or estimated-payment requirements.
- Approve payroll and compliance. Obtain written employer confirmation covering employing entity, withholding, benefits, equity, security, data handling and corporate registrations.
- Assemble records before departure. Keep contracts, pay statements, tax returns, travel history, visa documents, equity records and proof of tax paid in an organized file.
- Recheck rules before each filing and renewal. Indian visa instructions, tax-year guidance, IRS publications, USCIS policy and state rules can change.
Common failure modes and how to correct them
| Failure | Why it causes trouble | Correction |
|---|---|---|
| Entering on a business visa and doing a normal job | Business travel and employment are different permitted activities | Describe the duties and obtain confirmation of the correct Indian category before performing work |
| Calling an India move an “L-1 transfer” | L-1 is a U.S. classification and does not authorize work in India | Analyze Indian work authorization separately; analyze L-1 only for a qualifying U.S. move |
| Stopping U.S. returns after leaving | Citizens and qualifying residents can retain worldwide-income filing duties | Determine U.S. status for each year and prepare the required federal filings |
| Assuming one year abroad qualifies for the exclusion | The bona fide residence test has additional requirements | Test eligibility and compare it with the foreign tax credit |
| Using “six months” as the Indian residence rule | Indian statutory tests use specified day counts and exceptions | Track exact days and apply the rules for the applicable assessment year |
| Relying on employer permission alone | Permission does not resolve immigration, payroll, tax or corporate-presence issues | Obtain coordinated approvals from immigration, tax, payroll and security teams |
| Ignoring the departure state | State domicile and filing rules are independent of federal rules | Check the relevant state tax authority and document the domicile change |
What to take to a cross-border adviser
- Passport, citizenship and immigration-status records for you and dependents.
- Current U.S. visa, green-card evidence or pending-case notices.
- Offer, assignment or transfer letters and a detailed role description.
- Corporate-structure information identifying the U.S. and Indian entities.
- Compensation plan, equity documents, benefits summary and expected vesting dates.
- Prior U.S. and Indian returns, withholding statements and evidence of foreign taxes paid.
- Projected travel calendar and addresses in both countries.
- State ties, housing, bank accounts, investments and retirement arrangements.
- Employer policy on remote work, data access, export controls and security.
Ask the adviser to state assumptions, tax years, countries, currencies and filing deadlines in the written advice. Revisit the analysis if your employer, role, worksite, travel pattern or immigration status changes.
How to use the official guidance
For the Indian visa decision, consult the current India Visa Online employment-visa provisions and the checklist of the mission handling your nationality. For U.S. immigration, consult the current USCIS L-1 policy and evidentiary guidance. For federal tax, use current IRS publications on residence, worldwide income, the foreign-earned income exclusion, foreign tax credits and the U.S.–India treaty. For Indian tax residence, use the Income Tax Department guidance for the relevant assessment year, including its stated limitations. For state tax, use the tax authority of the state you are leaving.
