There is no USCIS process that transfers an already issued green card from one employer to another. The phrase “How to transfer your green card to a new employer without losing your status” usually describes one of two different situations: you may already be a lawful permanent resident, or you may have an employment-based Form I-485 adjustment application still pending.
The AC21/INA 204(j) portability rule applies to certain pending employment-based I-485 cases. In general, the I-485 must have been pending for at least 180 days, and the new offer must be permanent, full time, and in the same or a similar occupational classification as the job underlying the I-140. The process uses Form I-485 Supplement J; it does not itself grant work authorization.

First, identify which green card situation you have
Your next step depends on whether permanent residence has already been granted or your adjustment application is still being decided. USCIS portability guidance is directed at qualifying adjustment applicants, not at moving an issued card between companies.
| Your situation | What the USCIS portability rule means | What to do |
|---|---|---|
| You already became a lawful permanent resident and have an issued green card. | AC21 portability is not a transfer procedure for the card. The USCIS guidance discussed here does not describe filing Supplement J to change an employer after permanent residence has been granted. | Do not file Supplement J merely because you changed jobs. Check the conditions and history of your own immigration case and obtain individualized advice if your original employment was subject to special conditions. |
| Your employment-based Form I-485 is pending. | You may be able to change to a qualifying job under INA 204(j) after the I-485 has been pending for at least 180 days. | Confirm the receipt date, the I-140 and category history, the new offer’s terms, and the same-or-similar occupational classification before requesting portability. |
A pending adjustment case is not the same as permanent resident status. Until USCIS approves the I-485, you remain an adjustment applicant and must maintain whatever employment authorization or other lawful basis permits you to work.

What AC21/INA 204(j) portability actually does
Portability protects the basis of a qualifying employment-based adjustment application when the applicant moves to a new job that meets the statutory requirements. It is not an assignment of a green card, an automatic approval of the new employer, or a replacement for a work permit.
USCIS describes Form I-485 Supplement J as serving two purposes:
- confirming that the original I-140 job offer remains bona fide; or
- requesting portability to a new qualifying job offer.
For a portability request, the new employer and the applicant provide the offer information requested by the form and its instructions. The current instructions for Supplement J are dated April 1, 2024, while the USCIS form edition is dated January 20, 2025. Use the edition and filing directions USCIS identifies as current when you submit.

Eligibility checklist before you leave the original job
1. Your employment-based I-485 must have been pending for at least 180 days
USCIS counts 180 days or more from the I-485 receipt date. The receipt date is the controlling starting point, not the date you attended biometrics, received an employment authorization document, started the job, or first learned about portability.
Filing a portability request before the 180-day threshold can result in rejection. Calculate the date from the receipt notice, keep a copy of that notice, and allow a margin for filing and delivery rather than treating the 180th day as a guarantee that every other requirement is met.
2. The underlying I-140 must support the adjustment case
A pending I-140 does not automatically prevent you from filing a portability request once the I-485 has reached the 180-day threshold. USCIS must, however, adjudicate and approve the I-140 before it can approve portability, assuming the other requirements are satisfied.

Review the I-140 receipt and approval notices, the employment-based category, and any notices about withdrawal, revocation, or a change in the adjustment basis. A portability filing cannot cure a defective or ultimately unapproved underlying petition.
3. The new offer must be permanent and full time
The Form I-485 instructions describe the qualifying position as permanent and full time. A temporary assignment, a short-term contract, or an offer that does not provide the required ongoing employment terms may not meet this requirement.
Have the employer describe the position in the manner requested by Supplement J. The offer should identify the employer, job, location, duties, start expectations, and other details the form requires. Do not rely on a verbal promise or an abbreviated title alone.
4. The new job must be in the same or a similar occupational classification
The comparison is between the new position and the position described in the I-140 that supports the pending I-485. A similar-sounding title does not establish eligibility, and a different title does not automatically disqualify a move. USCIS evaluates the actual occupational classification and the substance of the offers.
Build a side-by-side record of the original and new positions. Compare the duties and the occupational classification information used for each offer, then explain any change in title, department, seniority, work location, or technology. The goal is to show why the positions are the same or similar, not merely to assert that they are.
5. Your category and petition history must permit portability
USCIS says the general portability provision applies to certain EB-1, EB-2, and EB-3 adjustment applicants. The Policy Manual also identifies exclusions for specified extraordinary-ability and national-interest-waiver cases. Some self-petitioners are not tied to a particular job offer, and physicians with a national-interest waiver have distinct requirements.

Therefore, do not assume that the 180-day rule applies identically to every employment-based case. Identify whether the I-140 was employer-sponsored, self-petitioned, an extraordinary-ability petition, a national-interest waiver, or a physician NIW before treating the move as ordinary AC21 portability.
How to request portability, step by step
- Locate the I-485 receipt date. Use the receipt notice for the pending employment-based I-485. Confirm that at least 180 days have elapsed. If you have more than one adjustment filing or a transferred case, map each receipt and transfer notice so you know which application is still pending.
- Confirm the underlying basis. Gather the I-140 receipt and approval notices, the original labor-certification or job-offer materials if applicable, and notices showing whether USCIS has changed, transferred, withdrawn, or revoked the petition.
- Document the new permanent, full-time offer. Ask the prospective employer to provide the information required by the current Supplement J form and instructions. Make sure the employer understands that the filing is connected to your pending adjustment case and that the position is intended to be permanent and full time.
- Compare the two occupations. Prepare a factual comparison of the original I-140 position and the new one. Include the duties and occupational classification information available for both jobs. Explain why the new role is the same as or similar to the original classification; do not rely only on matching words in the job titles.
- Complete the correct purpose of Supplement J. Select the portability purpose when requesting a move to the new offer, rather than using the form only to confirm that the original offer remains available. Follow every edition-specific instruction at USCIS’s Supplement J instructions.
- Obtain required signatures and supporting evidence. The applicant and prospective employer should sign where the form requires. Include the evidence the form and instructions call for, such as the offer details and documents that make the occupational comparison understandable.
- File using USCIS’s current directions. The form, filing location, fee information, and delivery method can change. Use the current USCIS form page and instructions rather than an old address copied from an earlier case. Keep a complete copy and delivery proof.
- Continue tracking the adjustment case. A Supplement J request does not replace the I-485. Respond to any request for evidence, update USCIS when required, and retain proof that the new job remains available while the application is pending.
Supplement J does not authorize you to start work
USCIS expressly separates portability adjudication from employment authorization. The Supplement J instructions state: “In adjudicating Supplement J, U.S. Citizenship and Immigration Services (USCIS) does not make a determination whether you have current work authorization with the prospective employer.”
In practical terms, filing the form, receiving a receipt, or waiting 180 days does not by itself authorize employment with the new company. Confirm that you have a valid employment authorization document, another independent employment-authorizing status, or another lawful basis to work before starting. If your work authorization is expiring, address that issue separately and on its own filing timetable.
Do these 3 things before closing this tab:
1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minuteHow to evaluate “same or similar” without relying on the job title
USCIS’s standard focuses on occupational classification. A title such as “engineer,” “analyst,” or “manager” can cover materially different work, while two employers may use different titles for substantially similar occupations.
Use a written comparison organized around the evidence in your case:
- Original position: copy the duties and classification information tied to the I-140 offer.
- New position: copy the duties and classification information supplied by the prospective employer.
- Continuity: identify the responsibilities, professional field, and core work that continue.
- Differences: explain changed title, reporting line, level, location, tools, or business unit rather than hiding them.
- Classification explanation: state why the new role remains in the same or a similar occupational classification.
This comparison is an evidence exercise, not a mathematical score. A higher salary, a prestigious employer, or a familiar title does not substitute for showing occupational similarity. Conversely, a title change alone is not a legal conclusion either way.
Portability is different from transferring the adjustment case to a new basis
Applicants sometimes ask USCIS to move a pending I-485 from one employment-based category to another based on a new I-140. That is a transfer of the underlying basis, not ordinary AC21 job portability.

USCIS states that when the adjustment application is transferred to a different employment-based category based on a new I-140, the 180-day portability period is not available until 180 days after the transfer request. In effect, the transfer resets the portability clock. Do not count 180 days from the original filing if you have requested a basis transfer without analyzing the new timeline.
Keep these questions separate:
| Question | What it concerns |
|---|---|
| Can I move from the I-140 job to a new qualifying job? | AC21/INA 204(j) portability, generally after the I-485 has been pending at least 180 days. |
| Can my pending I-485 use a different employment-based category or a new I-140? | Transfer of the underlying basis, with its own rules and a potential reset of the portability waiting period. |
Cases that need category-specific analysis
Extraordinary-ability petitions
The Policy Manual identifies specified extraordinary-ability cases among the exclusions or special situations for the general portability provision. Do not assume that an EB-1 extraordinary-ability filing follows the same employer-linked analysis as an employer-sponsored petition.
National-interest waivers
A national-interest waiver can be self-petitioned and is not always tied to one employer in the same way as a labor-certification-based case. USCIS separately identifies NIW cases and describes distinct rules for physicians. The existence of a new employer does not, by itself, determine whether portability is required or available.
Other self-petitioners
USCIS explains that certain self-petitioners are not tied to a specific job offer. If your I-140 was self-petitioned, first determine whether the immigration category requires a particular offer at all; filing Supplement J as though every case were employer-sponsored can create confusion.

Organize the case before signing the form. A practical file includes:
- I-485 receipt notice and a calculation showing the 180-day date;
- I-140 receipt and approval notices, plus notices concerning any withdrawal, revocation, transfer, or category change;
- the original job offer and the occupational classification information used for the I-140;
- the new employer’s permanent, full-time offer and the completed employer sections of Supplement J;
- a side-by-side duties and classification comparison;
- your current employment authorization documentation, tracked separately from portability evidence;
- copies of every form, exhibit, signature page, delivery record, and USCIS notice.
The exact evidence required depends on the form edition and the facts of the case. Follow the instructions rather than treating this list as a substitute for them.
Common mistakes and how to avoid them
Calling an issued green card “transferred”
If permanent residence has already been granted, Supplement J is not a mechanism for changing the employer printed nowhere on the card. Reframe the question around your current permanent-resident status and any conditions or obligations that applied to the original case.
Filing before day 180
Use the I-485 receipt date and verify that the application was pending for at least 180 days. A work start date or EAD issuance date is not the portability clock.
Best Value
Assuming any new job qualifies
The new offer must be permanent and full time and must be in the same or a similar occupational classification. A new company, higher salary, or attractive title does not eliminate that comparison.
Treating Supplement J as a work permit
The form does not decide whether you currently have work authorization with the prospective employer. Keep employment authorization filings and status questions on their own track.
Ignoring a pending I-140 or a changed basis
A pending I-140 is not automatically fatal, but USCIS must approve it before approving portability. A transfer to a different underlying employment-based category can restart the 180-day period.
Using an old form edition or address
Supplement J and its instructions have edition dates. Check the current USCIS pages immediately before filing and retain the version you submitted.

Individual legal advice is prudent when the 180-day date is close, the I-140 is still pending, the employer has withdrawn or terminated the original offer, the new role changes occupational field or seniority substantially, the case involves extraordinary ability or a national-interest waiver, or you have requested a transfer to a different employment-based category.
A qualified employment-based immigration attorney can compare the two offers, identify whether the case is actually employer-linked, and coordinate portability with work authorization and any required responses to USCIS. Bring the notices, forms, offers, and job descriptions rather than relying on job titles from memory.
